ance on the following described real estate to wit:

tial/Recreational One. Application is for the construction of a 24'x26' second story addi-
tion above an existing walkout basement, the construction of a 12'x26' two story addition
and the construction of two second story open decks (8'x26' and 6'x32') all located at a
setback distance of 20' from the rear lot line. Variance is requested as Section 18.4, Saw-
yer County Zoning Ordinance, would require a minimum setback distance of 40' from the
rear lot line. The Town Board has approved the application.
The Sawyer County Board of Appeals approved the application as submitted, with no expiration
date.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship. There would be
no change in the use in the zone district. It would not be damaging to the rights of others or prop-
erty values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-037.

In November of 1991 I bought.from David Hoard the builcling�and
lothe showect me. The next day in talking to Dave Eieder he�told
me the buildingvyas nat nn the c�rrect�lot..
I contacted David Hoard and he agreed to�urchase_�ro}�rtyfrom
Gordon Hoff to include the building and o�her 1Qt tc�gether.
Dave Rider the�urveyor,David Hoard and Gordnn 13nff agreed
upa�the size-af�:ot1 which David Hoard�aid for and transfarred
ownershi�to�e.
Ift�e rear Yot setbackhad been caught in 1991 vslhenlotl�was
c�eatect to inelude:the existing building ivQ tivouldhave corr�cted
the problenr then and added another 20'to make a 40' sQtback.
As ittnrned-out the setback distance was missed byzoning.�The
surve�v�as approved by David Heath on Feb. 11;19�1 znning
administrator at that tjme.

Twelve years later the �roblem showed up,which I had nothing to
do wit�r. I didn't have the sli.ghtest idea there as a:�roblem�vith
s�tbacks until I ap�lied for a building �ex�mit.
After learning of the problem with the setback the fust thing3 did
was contactthe ow�rs of the�ro�erty to the westt o try an�l�uy
at least 20 feet from them so as to meet the 40'setback. As it

turrred aut th�ywere nat in favor of selling the 20' because .they
had a hi�ng trai�nn a�rtann�of it.
In s�a�ng to Pec�Flacksbarth the owner to the �est ahflnt 10
day��go he said they had no�roblem with the 2D'�etback.
`Plre up�er�ortion of the building was removed be�ayse ��floor
system wasrotten. The first 6 to 10 years David-�Ioard harl�ived
ttrere itwasone.story vs�ith a flat roof. After tim�the fla�roof
leaked aird�3avld-�ut u� the outer shell above. T�en we remnved
thre ceiiing'downstairs it e�osed the rotterr floor�isf,, it vva.s not
safe to try and repair them. Had the floor system been in.good
shape we had ��anned on remodeling and using the u��er s�ory.
David Hoard �urchased the }�roperty in June of 1976. The vs�alkout
24'x26' foundation was built in 1978 at which time he staxted

has a recerrt 6" well added and �lumbed into the dovvn stairs; ,also
there is plumbing and a drain in the concrete floor vyhich leads to
the se�tic tank: Also the electric is buried from thernad to the
met�r onth� outside of the walkoutwith a with a electrical�anel
mounted inside of the walkout.

Dear Mr. Skar:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of$250.00 made out to the "Sawyer County Zoning
Administration"by Friday,November 7, 2003 for hearings in December 2003.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your"Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Edgewater at 7:00 P.M., Tuesday, December 9, 2003. You
should contact Natalie Clemens, Town of Edgewater Clerk, at(715) 354-7747 (home) to
confirm the date and time.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, December 16, 2003, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefare, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

request. Convenience and financial loss or gain does not constitute a zoning hazdship.
