The Town Board has denied the application. The Sawyer County Board of Appeals approved the application contingent on the recording of affidavit removing easement. Findings of Fact of the Board of Appeals: It would not be the basis of economic gain or loss. It would not be a self-created hardship. There would be no change in the use in the zone district. It would not be damaging to the rights of others or property values. It would be due to special con- ditions unique to the property. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. If you believe that you meet the criteria for the requested variance you should review the application for correctness. If correct,sign the application and return it to this office with a check in the amount of$250.00 made out to the"Sawyer County Zoning Administration"by Friday,November 7,2003 for heazings in December 2003. The"Variance Application"will be reviewed at two public hearings.The first hearing will held by the Town of Bass Lake at 630 P.M.,Monday,December 8,2003. You should contact Shirley A.Miller,Town of Bass Lake Clerk,at(715)634-8469(Town Hall)to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday,December 16,2003,in the large courtroom located in the Sawyer County Courthouse. You or your agent should attend each heazing,especially the hearing conducted by the Sawyer County Boazd of Appeals. Only the Boazd of Appeals can grant the vaziance,the decision of the Town of Bass Lake is advisory only. It is your responsibility to convince the Boazd of Appeals to grant the variance that has been requested. Therefore,you should consider using any means at your disposal(i.e., photographs,drawings,a good verbal presentation,etc.)as you present the facts to the Board. I visited your property today. I was urable to find the rear lot line markers. However, comparing your measurements�vith mine, I believe that the garage slab is approximately 23' from the reaz lot line. Of course you always have the option of having a surveyor flag the rear lot line. I am enclosing a list of surveyors who work in Sawyer County. Apex Surveying (Jeff W. Mulock), surveyed your lot in the summer of 2000. The property owner at that time was Brent Van Vondoren. The variance application that I have completed for you states that the garage dimensions are 26' x 38' including eaves. I assumed that you would want eaves on the garage and I also assumed that the eave overhang would extend one foot from the garage walls. Please let me know if this is not satisfactory. As we discussed yesterday, the Board members are of the opinion that a garage is neazly a necessity in this climate. However, they refuse to grant a vaziance for a gazage that would be located closer than 75' to navigable water. The proposed garage is approximately 190' from the lake. Your arguments should probably include: • You did not cause this problem(hazdship), as the situation existed when you purchased the proper[y. • You purchased the property expecting to be able to construct a garage on the existing slab. • There are not any dwellings in the immediate vicinity of the proposed garage, in fact there is a group of trees and an open field immediately behind the garage site.
