On November 18, 2003, the Sawyer County Board of Appeals approved your application for
variance on the following described real estate to wit:
Part of Govt Lot 1, S 29, T 40N, R SW, Parcel :1.7. Vol 357 Records Page 163. Ap-
proximately 130'x250' containing 2.51 acres. Property is zoned Residential/Recreational
One. Application is for the construction of a 28'x45' second story addition onto an exist-
ing dwelling at a setback distance of 37' (eave setback) to the ordinary high-water mark of
the Chippewa River/Barker Lake. The proposed addition will be constructed no closer to
the ordinary high-water mark than the existing dwelling. Variance is requested as Section
4.49(3), Sawyer County Zoning Ordinance, would require a minimum setback distance of
40' as the average setback was determined at that distance from the river/lake. The Town
Board has approved the application.
The Sawyer County Board of Appeals approved the application as follows: 2-year expiration
date.
Findings of Fact of the Board of Appeals: It would not be the basis of economic gain or loss. It
would not be a self-created hardship. There would be no change in the use in the zone district.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-035.

• a copy of the Sawyer County Board of Appeals Conclusions of Law Form(This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the vaziance that you have requested.)and a

If you believe that you meet the cciteria for the requested variance you should review the
application for correctness. If conect,sign the application and retum it to this office with
a check in the amount of$250.00 made out to the"Sawyer County Zoning
Administration"by Friday,October 3,2003,2003 for heazings in November 2003.
The"Application for Variance-Additional Information"must also be filled out and
returned with the Variance Application.Both documents together make up the entire
application that will be reviewed by the Sawyer County Boazd of Appeals.Failwe to
retum both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your"Vaziance Application"will be reviewed at two public meetings.The first meeYing
will be held by the Town of Winter. The Town of Winter holds multiple monthly
meetings.You should contact Arlene Bishop,Clerk,Town of Winter,at(715)266-3131
to confirm the date at which your variance application will be discussed. Mrs.Bishop
may be reached at(715)266-3131,Monday—Wednesday,from 8:00 A.M.to 3:00 P.M.
at the town hall.
The Sawyer County Board of Appeals will hold a public heazing at 7:00 P.M.,Tuesday,
November 18,2003 in the large courtroom located in the Sawyer County Courthouse.
4'ou or your representative should attend each hearing, especially the hearing ccmduct�d
by the Sawyer County Board of Appeals. Only the Board of Appeals can grant the
variance, the recommendation of the Town of Winter is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance(s) that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
