On September 17, 2003, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Lots 3, 4, 5, and Part of Lot 6, Block 1, Abendpost Beach Subdivision, S 30, T 40N, R
8W, Parcel —12.1.3&4. Vol 422 Records Page 365, Vol 567 Page 171, Vol 572 Page 1.
Approximagely 100'x105', containing .347 acres (15,115 square feet). Property is zoned
Residential/Recreational One. Application is for the construction of a 21'x29' second
story addition above an existing dwelling, the construction of a 21'x27' dwelling addition
with loft area, the construction of a 24'x28' garage addition with loft area, all at setback
distances of 21' to the rear lot line, 29' to a side lot line, 50' to the centerline of Poplar
Lane (a t own r oad) a nd a Il e xceeding 5 0% o f t he c urrent e stimated f air m arket v alue.
Variance is requested as Section 18.4, Sawyer County Zoning Ordinance, would require a
minimum setback distance of 40' from the rear lot line and 30' to the side lot line, Section
4.21(3) would require a miniumu setback distance of 63' to the centerline of the town
road and Section 10.2 restricts the cost of construction to less than 50% of the cunent es-
timated fair market value. The Town Board has denied the application.
The Sawyer County Board of Appeals approved the amended application as follows: Eliminate
2°d story on dwelling, allow addition with loft and garage; remove out house and existing garage;
allow exceeding 50%; 2 year time limit.
Findings of Fact: It would not be the basis of economic gain or loss. He is limited with the prop-
erty he had and it is not against public interest. It would be an asset to the area, getting rid of ex-
isting garage along the roadway. It would increase the value of homes all around him.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiarari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-030.

Your Town Boazd decision is an integral part of the decision making process for the Sawyer County Boazd of
Appeals. The Boazd of Appeals would like your cooperation in stating the reasons or comments why you
approved;denied, or tabled the variance application.
Re: Catherine E. and James W. Granger.
Would be contrary. to the public interest and would not be in compliance with the spirit
or intent of the Sawyer County Zoning Ordinance.
1) The topigraphical problems o£ this area has been documented previously (see attached study
and reco�endation to the county board by letter dated 12-12-02) and,
2)Land disturbing activities, such as additions W1tIl1II 30 feet of "Grindstone Cliffs" would
likely cause increased run off draina�e and erosion.

RE: "Grindstone Cliffs" Slope Failure and Endangerment to Public Safety & Property
Damage
Dear Mr. Helwig:
At the regular monthly meeting of the Board of Supervisors for the Town of Bass Lake,
Sawyer County, on a motion by Meixner, seconded by Nies, the board instructed me to
send a letter to the County Board of Supervisors in regards to the "Grindstone Cliffs".
They are requesting that the County Board of Supervisors send a letter to the Sawyer
County Zoning Department to withhold building permits on the south side of Grindstone
Lake, known as "the cliffs" until the governmental units named in the attached letter can
find a solution to the problem as stated in that letter.
Danger to public safety is clear and present, and any failure by the county board to act
would leave the county open to litigation when the slope fails. The situation is not "if' it
will fail, but "when" and to what extent the failure will effect the existing and proposed
residents on the top of the cliffs.

This letter is in response to our November 20`t' meeting and site visit at the Grindstone Cliffs.
Present at the meeting were representatives of LCO Conservation, WDNR, Town of Bass Lake,
Sawyer County LWCD, NRCS, and one property owner. Representatives of NRCS also visited
the site in July of this year. Attached are the photos taken in July. Several shallow to
moderately deep slope failures have occurred along the steep shoreline. Review of Che USGS
' topographic maps indicates that the lake level is at elevation 1287 feet, while the top of the bank
is at approximately elevation 1330 feet. It is our understanding that several slope failures have
occurred along the approximate 1 mile long shoreline referred to as Grindstone Cliffs. Our
observations have been limited to 2 properties which we understand are representative of the
more severe failures.
The steep bank contains numerous mature conifers ranging from approximately 6 inches to 18
inches in diameter. Many of the trees have tipped toward d�e lake and are held in place by trees
further down the slope. The toe of the slope at the waters edge appears to be eroded due to wave
action. The watec depth is relatively shallow for several hu�dred feet out from the shoreline.
The fetch across the lake at this location is approximately 1'/s to 2 miles. The entire slope and a
portion of the level ground sou[h of the bank is under easement or ownership by the Town of
Bass Lake. Residential structures are located relatively close to the crest of the slope (within
approximately 15 to 25 feet) at those locations-viewed by representatives of NRCS.
The cause of the slope failures could be from one factor or a combination of sevecal factors. We
recommend that a thorough geotechnical investigation be implemented to determine the cause of
the failures prior to commencing with measures to stabilize the slope. We have preliminarily
identified the following potential causes of [he slope failure. Each may be acting alone or in
combination with others.
• Instability of the toe of the slope caused by shoreline erosion.
-� • Saturated soil conditions caused by above normal precipitation amounts in 2002.
• Wind forces on mature conifers located on the slope [ransmitting stresses to the soils.

• Groundwater seepage along less pervious soil layers.
• Changes in overland and groundwater flow due to near shore development,
Regardless of the cause of the slope failures, additional weight should not be placed on the slope.
In particular, soil should not be placed in an ePfort to regrade the existing failure areas and new
structures should not be built until such time that the slope is stabilized.
Due to the extent of the existing failure and the proximity of existing (and proposed) residential
structures, we recommend that a full slope stability analysis be performed at representative
locations along Grindsrone Cliffs. This would e�tail performing soil borings and in-situ soil
testing afong with appropriate laborarory soi( testing. The soil borings should extend to an
elevation equivalent to 20 feet below the elevation of the toe of the slope. Continuous sampling
should be performed in order to identify the presence and location of less permeable soil layers
that may be causing groundwater seepage within Che failure zone. The purpose of the soil
borings would be to provide soil s[rength parameters and ground water information for input into
a slope stability analysis. If it is determined that the presence of sabsurface water is contributing
to the instability of the slope, measures may be required to intercept the water prior to it en[ering
� the potential failure zone.
NRCS does not have the technical capabilities and necessary equipment to perform the field
investigation and geotechnical analysis. In addition, this project would require a significant
engineering time commitment, which would have to be approved by the NRCS Management
Staff. We would recommend that a geotechnical engineering consulting firm be retained for the
soil investigation and slope stability analysis. NRCS could provide engineering assistance in the
following areas as it relates to this project, subject to State Conservation Engineer consultation
and State Conservationist approva] to proceed with technical assistance:
• Assistance with developing a request for proposals to re[ain a geotechnical
engineering consulting firm.
• Assist counry staff in performing a topographic survey and/or representative slope
cross sections. This would include downloading and plotting the information using
Autodesk Land Desktop 3.0
• Assistance with development of a construction cost estimate based on the
geotechnical consultant's recommendations.
• Assistance with designing wave protection measures at the toe of the slope.
This project also may not fit into the existing Job Approval/Certification system, so it would
require State Conservation Engineer and State Conservationist approval to proceed with any
technical assistance.

As a minimum, we would recommend that the toe of the slope be stabilized from further wave
erosion. However, additiona] measures may be necessary and simply stabilizing the toe may not
provide an adequate factor of safery against further slope movements. The Streambank and
Shoreline Protection Standard (Code 580) of Section IV of the Field Office Technical Guide
limits the types of projects to "controlling erosion on shorelines where the problem can be solved
with relatively simple structural measures, vegetation, or upland erosion control practices.
Failure of structural measures shall not create a hazard to life or result in serious damage to
propeny.,
Some units of govemment within Wisconsin require that prior to new construction near a steep
shoreline, the property �owner is responsible for hiring a geotechnical consultant to evaluate the
site specific slope stability. These same requiremenCs are usually applied to remodeling projects
and additions. Consideration should be given to requiring something similar along the
Grindstone Cliffs.

Read the attached "Court Decisions Regarding the Granting of Variances" prior to
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sa�wer Countv
Zoning Ordinance would result in unnecessary hardship. Present Wisconsin case lativ
describes hardship as being present only when an applicant has demonstrated that he
or she tivill have no reasonable isse of the properry, in the absence of a variance. If a
parcel as a whole (but not necessarily each portion of the parcel) provides some
reasonable use for its owner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship (i.e., purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be granted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
property and are not eligible for variances.
2) The hardship must be due to unique�hvsical limitations of the propertv which are not
generally shared b oy ther properties. Growing families, additional livin� area for
guests, the desire for a larger garage etc., are not factors in deciding variances.
3) A variance mav not be granted which results in harm to public interests. The Sawyer
Gounty Zoning Ordinance was adopted "for the promotion and protection of the
public health, morals, safety, and the general welfare." Additionally, the shoreland
zoning provisions of the Ordinance, provides for water quality, wildlife habitat,
fisheries and natural scenic beauty protection of the County's lakes, rivers and
streams
4) Other considerations:
a. Self-created hardships. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot when the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when

the owner does not prevail,and making improvements in violation of the
ordinance.
b. Violations bv nei ng bors.In State v. Kenosha Counry Board oJAdjustment,the
Board of Adjustment in part based its variance on the fact tha[many othec
neighbors have decks wi[hin the setback.The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
propeRy without a deck.
c. Variances run with the propeRy.Variances are granted for hardship that pertains
to the conditions of the property,rather than to the person making the application.
Accordingly,variances run with the property and are not terminated when the
propeRy changes hands.

Dear Mr. Granger:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance -Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of$250.00 made out to the"Sawyer County Zoning
Administration" by Friday, August 1, 2003 for hearings in September 2003.
The "Variance Application"will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, September 8, 2003. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at(715) 634-8469 (Town
Hall) to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 16, 2003, in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision o t e Town of Bass Lake is advisory on y.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to app13�expiration dates
to future varianoes. THe applicanEs should be prepared to discuss this issue with the
Board (i.e., proposed date that construction would begin, any anticipated construction
delays that may be caused by the availability of contractors, excavators etc.).
