On September 16, 2003, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Richard C. Johnston et ux. Lot 12, Justamere Subdivision, S 19, T 37N, R 9W, Parcel —
5.12. Vo1754 Records Page 262. Approximately 135'/165'x252' containing .66 acres. Prop-
erty is zoned Residential/Recreational One. Application is for the construction of an ap-
proximately 36'x38' dwelling on a vacant parcel at a setback distance of 31' from the
centerline of Maple Terrace Drive (a town road) by the purchaser. Variance is requested
as Section 4.21(3), Sawyer County Zoning Ordinance, would require a minimum setback
distance of 63' from the centerline of the town road. The Town Board has denied the ap-
plication.
The Sawyer County Board of Appeals approved the amended application as follows: 26'x40'
dwelling, 14'x22' garage 40' from centerline, 6'x54' deck, 7'x 14' deck/walkway; 2 year time limit.
Findings of Fact of the Board of Appeals: It is very steep. Variance due to distance to road. It
would not be the convenience of the owner, it is the only place. It would not be the basis of eco-
nomic gain or loss. It would not be a self-created hardship. There would be no change in the use
in the zone district. It would not be damaging to the rights of others or property values. It would
be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-029.

Application for Variance
Dear Mr. Johnston:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of $250.00 made out to the "Sawyer County Zoning
Administration" by Friday, August 1 , 2003 for hearings in September 2003 .
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Edgewater at 7:00 P.M., Tuesday, September 9, 2003 . You
should contact Natalie Clemens, Town of Edgewater Clerk, at (715) 354-7747 (home) to
confirm the date and time.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 16, 2003, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Edgewater is advisory only.

It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
As a point of information, a variance should not be granted for the financial gain of the
property owner. This may be an issue in this situation as the intent of the variance is so
that Mr. Azman may purchase the property from you.

Thank you for your Rexibility last week in scheduling a site inspection and meeting with
our builder to review our variance request. Upon further discussion with our builder, on-
site inspection of the property and yow `-official" determination of the 75-foot lake
setback mark, 1 am submitting the following chan�es to our application.
The discancc between the "flagged" watertiont setback and the centerline road setback
has now approximately 23 feet in width. We had previously believed fhe widfli to be 28
feet. As a result, I have met with our home designer and reconfigured the home ro better
fit the lot. The home dimensions aze as follows:
• 40 X 26 foundation
. 54 X 56 total dwelling dimensions including deck, porch and gara�e. (The garage
and deck had not been included on the previous layout that John Small discussed
with you).
. The dwelling will now run pazallel witl� the 102' frontage on the town road (it
will basically "sif' on the cleared area from dte boulder wali towards the town
road).
Your �nitial drawing shows a 31' closest point to the road. Our request cllanges this
slightly to a 30' closest point to the road(86 feet from 75' lalcefront setback point to
centerline of road less 56' width dimension).
Also, Norm Arndt, updated me on his conversation with you concerning a holding tank
on this property. Since you both concur that a conventional system will not fit on this
property, we will pursue a holding tank option. Norm has requested that thc holding tanl:
be as accessible as possible to the road. We are requesting this tank be placed to thc
southwest of the garage within the right of way setback. Please advise if this is
acccptable.
