Enclosed please find a copy of a portion of the minutes from the August 16, 2005
meeting of the Sawyer County Board of Appeals.
At this public hearing, your request for a clarification of Variance #03-026 was
discussed. The Board approved a motion to allow this variance for the Town of Bass
Lake and to amend existing deadline of 2 years to 10 years from this date [8/16/OS] with
setbacks of 30' from road and 67' from the ordinary high water mark of the lake.
The amended variance approval will be noted in your variance file.

Will also construct restrooms. Has applied for a grant. AG: For safety's sake, bathrooms should be
placed on same side of road as pavilion. A 10 year time frame is discussed and agreed due to special
circumstances.

On September 17, 2003, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:

cords Page 468. 150'x90'/100' containing .322 acres. Property is zoned Residen-
tial/Recreational One. Application is for the construction of a 40'x80' replacement
dwelling (includes a 15'x80' deck) on a parcel containing 14,026.3 square feet and at a
setback distance of 40' from the ordinary high water mark of Grindstone Lake and
41'/42' from the centerline of Poplar Lane (a town road). The proposed dwelling will
replace three existing nonconforming dwellings. Variance is requested as Section 18.2,
Sawyer County Zoning Ordinance, would require a minimum lot area of 20,000 square
feet, Section 4.49(1) would require a minimum setback distance of 75' from the ordi-
nary high water mark of the lake and Section 4.21(3) would require a minimum set-
back distance of 63' from the centerline of the town road. The Town Board has tabled
the application.
The Board of Appeals approved the amended application as follows: 28'x80' replacement
dwelling, 3 existing dwellings to be removed; setbacks of 30' from centerline, 67' from ohm;
expires 2 years from time of floodplain determination by DNR.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship. There would be
no change in the use in the zone district. It would not be damaging to the rights of others or prop-
erty values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court far Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please

Dear Mr. Corbin:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of $250.00 made out to the "Sawyer County Zoning
Administration" by Friday, August 1 , 2003 for hearings in September 2003.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, September 8, 2003. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town
Hall) to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, September 16, 2003, in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince theBoard of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. The applicants should be prepared to discuss this issue with the
Board (i.e., proposed date that construction would begin, any anticipated construction
delays that may be caused by the availability of contractors, excavators etc.).
There are a few issues that I should discuss with you concerning this variance.
1. Dwelling deck. You have requested a variance that includes a deck 40' from
the lake. The intent of a variance is to provide reasonable/minimum use of the
property. The Board has established a policy that decks are not necessary for a
property owner to have reasonable use of his/her property. You can expect
that the deck issue will be a discussion issue with the Board.
2. Dwelling size. The Board attempts to match the size of a dwelling to the size
of the lot. In this situation you have a 14,026.3 square feet lot and a proposed
3,200 square feet dwelling (2,000 square feet of habitable area and a 1,200
square feet deck). You can expect that the Board will discuss this issue and
may request that the dwelling be downsized.
3. Grindstone Lake 100-year flood elevations. The Flood Insurance Rate Map
for Grindstone Lake indicates that your property would be subject to flooding
in the event that a 100-year lake flood should occur. A 100-year flood is a
flood that has a 1% chance of occurring in any year. Even if the requested
variance were to be approved, this office could not issue a permit to construct
the new dwelling unless we were assured that the dwelling would not be
subject to flooding. The only way that we would know whether the property
would be flooded is to compare the lake's 100-year flood elevation with the
building site elevation. Unfortunately, the 100-year flood elevation for
Grindstone Lake has not been determined. However, Sawyer County has
contracted with an engineering firm to have this elevation determined and
hopefully the elevation will be determined and approved this fall.
In a worse case situation, the dwelling may have to be built on fill with the fill
extending at least 15 feet around the perimeter of the dwelling. However, the
depth of fill cannot be determined until the 100-year flood elevation for the
lake is known.
