On August 19, 2003, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:

R 8W, Parcel -4.29.2. Vol 714 Records Page 105. 20'x250'x74'x103'x224' con-
taining .39 acres (17,000 square feet). Property is zoned Residential/Recreational
One. Application is for the construction of a 28'x28' (including eaves) one and a
half story replacement garage (not for habitation) at a setback distance of 30' from
the centerline of Peninsula Road (a town road). Variance is requested as Section
4.21(3), Sawyer County Zoning Ordinance, would require a minimum setback
distance o f 6 3' from t he c enterline o f t he t own road. The Town Board has ap-
proved the application.
The Board of Appeals approved the application as amended: 1 year time limit.
Findings of Fact of the Board of Appeals: It would not be the basis of economic gain or loss. It
would not be a self-created hardship. There would be no change in the use in the zone district. It
would not be dmaging to the rights of others or property values. It would be due to special con-
ditions unique to the property, being the shape of lot and bounded by lake and road.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-024.

Dear Mr. and Mrs. Ablan:
I have enclosed the following documents with this letter:
• Inspection Report for the above property and a
� Completed Variance Application.
Please review the inspection report and the application for correctness. If correct, sign the
application and return it to this office with a check in the amount of$250.00 made out to
the "Sawyer County Zoning Administration" by Thursday, July 3, 2003 for hearings in
August 2003.
Your"Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Hayward at 7:00 P.M., Tuesday, August 12, 2003. You should
contact Jodi Longtine, Town of Hayward Clerk, at (715) 634-4123 at the Town Hall
between 10:00 AM and 2:00 PM, Mon., Tues., Wed. to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, August 19, 2003, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
