Dear Ms. Rang: Enclosed please find a copy of my on-site inspection report dated June 5, 2003. Thank you for assisting me in taking all the set-back measurements. As I mentioned to you during my inspection that legal setbacks must be met for a zoning rear setback of 40 feet as well as a 10 foot setback from the sewer system. It appears that you have two options available: 1.) Petition for a variance for a lesser reaz lot line setback requirement of 40 feet. Please keep in mind that you have to display that a hardship exists. 2.) If you decide to place the gazebo at the legal setback of 40 foot, the setback to the sewer system will only be 4 feet, the legal setback is 10 feet. You must apply for a variance of 4 foot setback to the sewer system with the Dept of Commerce. 3.) You also talked about the gazebo being portable with wheels undemeath. This is stretching the issue in that we consider a gazebo a structure; weighs 500— 1000 pounds and is not really portable, temporary and or moveable. I am a sanitation and soil tester and normally involved in sewers and soils. I very seldom get involved in zoning issues. I will encourage you to see or talk to William Christman, the Zoning Administrator to discuss these matters and all options available.
