On July 15,2003,the Sawyer County Board of Appeals approved as amended your application
for variance on the following described real estate to wit:

Page 218. .46 acres.Property is zoned Residential/Recreational One.Application
is far the construction of a 35'x50'split-level dwelling(including eaves)with an
attached 12'x33'open deck at a setback distance of 60' from the ordinary high-
water mark of Lake Chetac. Variance is requested as Section 4.49(1), Sawyer
County Zoning Ordinance,would require a minimum setback distance of 75'from
the ordinary high-water mark of the lake.The parcel is located on a peninsula and
minimum lake setback requirements cannot be met across that peninsula. The
Town Board has denied the application.
The Board of Appeals approved the application as follows:Dwelling size 26'x48'without eaves,
28'x50'including eaves,centered on the lot 12'x26'deck;expiration date of October 1,2005.
Findings of Fact of the Board of Appeals Unnccessary hardship is present since strict application
of the terms of the zoning ardinance would deny the applicant all reasonable use of the property.
Hardship is due to physical limitafions of the property because of 161'lot width.It would not be
contrary to the public interest and will observe the purpose of the ordinance.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.In future correspondence,or in applying for permits,please

The zoning administrator is directed to issue a zoning permit incorporating these
conditions and certifying by the applicant's signature that he/she understands and accepts
the conditions.
Expiration of ermit. Any privilege granted by this decision must be exercised within

�`" and other permits for the proposed construction. This period will be extended if this
decision is stayed by the order of any court or operation of law.
Revocation. This order may be revoked by the Board after notice and opportunity to be
heard for violation of any of the conditions imposed.
A eals. This decision may be appealed by a person aggrieved by this decision or by any
officer, department, board or bureau of the municipality by filing an action in the circuit
court for this county within 30 days after the date of filing of this decision. Sawyer
County assumes no liability for and makes no warranty as to reliance on this decision if

Conclusions of Law of the Board of Appeals: Unnecessary hardship is present since strict application
of the terms of the zoning ardinance would render conformity with such restrictions unnecessarily
burdensome because of the size of the lot. It is confined. The variance will not be contrary to the
public interest and will observe the purpose of the ordinance.
2) Town of Lenroot—Gregory D. Pieterick et ux. #OS-015. Part of the SW '/4 SW '/4, S 25, T 42N,R 9W,
Parcel .11.1. 1.40 acres. Property is zoned Residential/Recreational One. Application is for the
replacement of that part (24'x36') of an existing dwelling at a setback of 21'4" (based on a 30" eave
overhang) to the ordinary high water mark of Nelson Lake and at a setback of 4' to the adjacent side
lot line. The replacement "addition" will be reattached to a dwelling addition approved by variance
#94-008. All construction activities will take place within the existing dwelling footprint. Variance is
requested as Section 4.21(1)(a), Sawyer County Zoning Ordinance, would prohibit the replacement of
construction of this "addition" and Section 18.4 would require a minimum setback distance of 10' to
the side lot line.No decision received from the Town Board.
WAC reads application into the record; presents tax listers map, zone district map, and wetland map.
Application was tabled in July to give Pieterick time to see if mold was present in other parts of the
home. Mary Pieterick present. No additional mold was found. Not going any closer to the lake. Needs
to replace the defective section.
AG motions to approve the application as submitted,with 6/12 pitch, and 2-yr deadline.
LR seconds motion.
Unanimous vote.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would not
be a self-created hardship. Health issues are dictating the amount of reconstruction that's being done.
It is in the best public interest.
APPEAL OF THE SAWYER COUNTY ZONING COMMITTEE DECISION
Appellant Richard S. Trenkmann. Appeal postponed to a later date to allow parties time to prepare.
NEW BUSINESS
1) James Hausman Variance #02-025 — Attorney Mike Kelsey representing, asking for extension of
variance until Round Lake level is determined. Permit will expire in May 2006.
AG motions that a 4 year variance from 4/20/04 will expire 4/20/OS.
KZ seconds motion.
Unanimous vote.
2) Elizabeth Spridco Variance #03-019 — Steve Friendshuh asking for clarification. Variance was
granted on a lot with a 60' setback from the lake. Applied for and received LUP. Building is smaller.
12'x26' open deck. Wants to put a screened-in porch on existing deck of 12'x16'. Impervious surface
is 4%, isn't the issue. Building within footprint,just wants to build screen porch on the open deck.
RZ motions to approve the 12x16' screen porch onto the existing open deck, staying within the
footprint of the variance granted.
AG seconds motion.
Unanimous vote.
3) Kissinger Variance #OS-010—Gen. Kissinger asked for 26'x20' with tuck-under garage. Clarification
of single family versus single story. Minutes reflected single story.

Finding of Fact: Unnecessary hardship is present since strict application of the terms of the zoning
ordinance would render conformity with such restriction unnecessarily burden: because limitation set up
by the wetland which was not self created. The hardship is due to physical limitations of the property
rather than the circumstances of the applicant because; it is not a self created hardship, it is not for
economic gain and it is not for the convenience of the owner. The variance will not i�e contrary to the
public interest and will observe the purpose of the ordinance and do justice because: It is not contrary to
the public interest and there would be no change in the use in the zone district and it would not be
damaging to the rights of others or property values. Time limit of 2 years.
NEW BUSINESS
1) James Hausman(not present, no one to represent him)—Initially asked to be placed on agenda
for an extension of completion time. In reviewing the file the variance doesn't expire unti12007
(this was mentioned to Mike Kelsey, Hausman's attorney).
AG-Motion not to extend time.

2) Office guidance or approved variance. Bill explains the situation- Board is not in favor of changing
anything on the variance once its approved.
3) CEFM—according to handbook on Zoning Non-conformities the 50% rule is done by an admin-
istrative appeal. Bill just wanted to point this info out to the board. Board discussed—Board feel
they want to continue as they have been.
4) BOA-Training- Put on by Lynn Markham- Land Use Specialist. Board to pick dates for training.
Board picks July 20th or July 27th ,possibly from 9-12:OOam . BC will let Lynn know what dates
BOA picked. Lynn will then set up training.
5) BOA Appeal date for Ayotte—BOA picked July 13`h. 9:OOam Closed Session with Attorney at
8:30 am. Briefs will be submitted& Time limits to file then. No more than 30 Minutes to state
their case. Appeal to follow same format as last appeal.

The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday,July 15,2003,in the large courtroom located in the Sawyer County Courthouse.
You or your representative should attend each hearing,especially the hearing conducted
by the Sawyer County Board of Appeals. Only the Board of Appeals can grant the
variance,the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant tbe variance that you
have requested. Therefore,you should consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present your facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators,plumbers etc.).

Discussion
To qualify for a variance,you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sa�wer Countv
Zoning Ordinance would result in unnecessary hardship.Present Wisconsin case Imv
describes hardship as being present only when an npplicant hns demonstrated lhat he
or she ivill have no reasonable zise of the properry, in the absence of cr tiariance.If a
parcel as a whole(but not necessarily each portion of the parcel)provides some
reasonable use for its owner,then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship(i.e.,purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations).A variance also cannot be granted,when in the absence of the
variance approval,the o�vner will suffer loss of profit or financial hardship.Decks
and similar minor accessory structures are not essential ro the reasonable use of
property and are not eli�ible for variances.
2) The hardstiip must be due to unique phvsical limitations of the grooertv which are not
�enerallv sllared bv other prooe�ties.Growing families,additional living area for
guests,the desire for a larger garage etc.,are not factors in deciding variances.
3) A variance mav not be granted which results in harm to public interests.The Sawyer
County Zoning Ordinance�vas adopted"for the promotion and protection of the
public health,morals,safety,and the general�velfare."Additionatly,the shoreland
zoning provisions of the Ordinance,provides for water quality,wildlife habitat,
fisheries and natural scenic beauty protection of the County's lakes,rivers and
streams
4) Other considerations:
a. Self-created hardships.A property o�vner may not obtain a variance for a hardship
that is self-imposed.Examples include:creating a substandard lot when the owner
has sold off portions that would have prevented the hardship,creatine a land-
locked parcel by selling property,building during the pendency of an appeal when
the owner does not prevail,and making improvements in violation of the
ordinance.
b. Violations bY nei he bors.In State v.Kenosha Counry Board ofAdjustment,the
Board of Adjustment in part based its variance on the fac[that many other
neighbors have decks within the setback.The couR rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the property.Variances are granted for hardship that pertains
to the conditions of the property,rather than to the person making the application.
Accordingly,variances run with the property and are not terminated when the
property changes hands.

Street, Hayward, Wisconsin.

statement should include a description of the general terrain; surrounding development;
