Please review the inspection report and the application for correctness. If correct, sign the application and return it to this office with a check in the amount of$250.00 made out to the "Sawyer County Zoning Administration" by Friday, June 6, 2003 for heazings in July 2003. Your "Variance Application" will be reviewed at two public hearings. The first hearing will held by the Town of Bass Lake at 6:30 P.M., Monday, July 14, 2003. You should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town Hall) to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday, July 15, 2003, in the large courtroom located in the Sawyer County Courthouse. You or your representative should attend each hearing, especially the heazing conducted by the Sawyer County Boazd of Appeals. Only the Board of Appeals can grant the variance, the decision of the Town of Bass Lake is advisory only. It is your responsibility to convince the Board of Appeals to grant tbe vaziance that you have requested. Therefore, you should consider using any means at yow disposal (i.e., photographs, drawings, a good verbal presentation, etc.) as you present your facts to the Board. At its October 2002 public hearing, the Board members decided to apply expiration dates to future variances. You should be prepared to discuss this issue with the Board (i.e., proposed date that construction would begin, any anticipated construction delays that may be caused by the availability of contractors, excavators etc.). �Please contact Mrs. Kitty Taylor if you have any questions. Read ?he attached "Court Decisions Re�arding the Granting of Variances" prior to answering the follow'ing question�. Discussion: To qualify for a variance, you must meet all three requirements of a three-step test. 1) Strict application of the dimensional requirements contained in the Sa«��er Countv Zonino Ordinance �vould result in unnecessar� hardship. Present lG"isconsin ense lair descr�ibes hardship as being presen! only� ii�hen nn applicant hns demonsh-ated that he or she ivill hai e no reasonable irse of the pro�er�ty, in the absence of a vnrinnce. If a parcel as a whole (but not necessarily each portion of the parcel) provides some reasonable use for its o�cner, then the test is not met and a variance cannot be gi'anted. A variance cannot be granted because of a self-imposed hardship (i.e., purchasing property �vith limitations and especting that a variance would be eranted to relie�e these limitations). A variance also cannot be oranted, ���hen in the absence of the �ariance approval, the o«ner �cill suffer loss of profit or financial hardship. Decks and similar minor accessory structures are not essential ro the reasonable use of property� and are not eligible for variances. 2) The hardship must be due to unique ohcsical limitations of the propertv which are not aenerallv shared bv other properties. Gro�vine families, additional livin� urea for guests; the desire for a larger garaee etc., are not factors in deciding variances. 3) A variance mav not be eranted which results in harm to public iniersts. Ttie Sa�v}'er County Zonin� Ordinance was adopted `'for the promotion and protection of the public health, morals, safety, and the general ���elfare.'� Additionally, the shoreland zonin2 provisions of the Ordinance, pro��ides for w'ater qualit}•, �vildlife habitat, fisheries and natural scenic beauty protection of the County's lakes, rivers and streams 4) Other considerations: a. Self-created hardships. A properCy owner may not obtain a variance for a hardship that is self-imposed. Examples include: creating a substandard lot �vhen the o�vner has sold off portions that w�ould have pre��ented the hardship, creating a land- locked parcel by selling property, building during the pendency of an appeal when Ihe owner does not prevaif, and making improvements in violation of the ordinance. b. Violations bv nei�hbors. In State u. Kenosha Coi�nry Bourd ofAdjus(ment, the Board of Adjustment in part based its variance on the fact that many other neighbors have decks wiihin the setback The court rejected that as a legitimate factor to use in determining whether the owner had a reasonable use of her property without a deck. c. Variances run with the property. Variances are granted for hardship that pertains to the conditions of the propeRy, rather than to the person making the application. Accordingly, variances run with the property and are not terminated �vhen the property changes hands. Having the lot be buildable, meeting�tback requirements from the lake and wetlands. Desaibe the hardship(s) that exists that does not no�v allow you "reasonable use ' of your property. If a QaraKe is built to meet current setbacks it will be built�� in the center of the lot. Its placement will render the lot unbuildable when a new cabin structure is required. Our three year old septic system is located in the area adiacent to the lane. Also there is a traffic issue, as the lane from KK is angled such that there is poor visability leaving. Please refer to the diagram attached. There is also the issue of emergency vehicles being a e to turn-aroun in t e property w ic nee s to e considered.* Did this hardship(s) exist when you became the property owner? No, *In August of 1994 a request to fill to build the garage was made and permission to build was granted, see attachment. We intentionally allowed the ground to go through a freeze-thaw cycle. Then one of the owners had a personal issue that prevented the garage from being built. Explain how the granting of this variance will provide you with"reasonable use" of your property. No structure will exist forever. -There will come a tim ��h n the current cabin must be replaced.
