The zoning administrator is directed to issue a zoning permit incorporating these
conditions and certifying by the applicant's signature that he/she understands and accepts
the conditions.
Expiration of permit. Any privilege granted by this decision must be exercised within
�_months of the date of this decision after obtaining the necessary zoning, building
and other permits for the proposed construction. This period will be eXtended if this
decision is stayed by the order of any court or operation of law.
Revocation. This order may be revoked by the Board after notice and opportunity to be
heard for violation of any of the conditions imposed.
Appeals. This decision may be appealed by a person aggrieved by this decision or by any
officer, department, board or bureau of the municipality by filing an action in the circuit

a check in the amount of$250.00 made out to the"Sawyer County Zoning
Administration"by Friday,June 6,2003 for hearings in July 2003.
Your application will be reviewed at two public hearings.The first hearing will held by
the Town of Sand Lake at 730 P.M.,Tuesday,July 8,2003.You should contact Elaine
Nyberg,Town of Sand Lake Clerk,at(715)865-2486(home)to confirm this date.
The Sawyer County Boazd of Appeals will hold the second heazing at 7:00 P.M.,
Tuesday,July I5,2003 in the large courtroom located in the Sawyer County Courthouse.
You or your representative should attend each hearing,especially the hearing conducted
by the Sawyer County Board of Appeals.Only the Board of Appeals can grant the
variance,the decision of the Town of Sand Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested.Therefore,you should consider using any means at your disposal(i.e.,

Proposed Garage Site

I have visited your proper[y and the proposed garage site north of West Shore Lane.
While the gazage site meets all setbacks,I am unable to issue a permit for the garage at
this time for the following reasons.
1. Your parcel is divided by a public thoroughfaze (West Shore Lane—a Town road).
From a zoning perspective the proposed location for the garage is on a"vacant lot."
Additionally, the garage is considered to be an"accessory building" as it supports the use
of the dwelling (a principal building). The Sawyer County Zoning Ordinance has
provisions specific to the conshuction of accessory buildings on vacant property.
4.26 ACCESSORY USES AND STRUCTURES
1) Any permanent,roofed structure serving as an accessory use if attached to the
principal building, shall be considered a part of the principal building. If such structure is a building and is
not attached to the principal building, it shall conform to the setback and other d'unensional requirements of
the district within which it is located. The construction of accessory buildings on vacant property is
prohibited.
2)A single accessory structure may be constructed on that part of a lot divided by a Town road that
does not contain the principle structure,provided that:
a) The accessory structure cannot be constructed an that part of the lot containing the principle
structure due to the inability to meet minimum setbacks,and
b) The required minimum setbacks can be met at the proposed building site on that part of the lot
not containing the principle structure.
Based on my observations, it is possible that the proposed garage could be located on the
lakeside of the road and meet a11 minimum setbacks (i.e., 5' from a side lot line, 63' from
the centerline of the road, S from the septic system force main (the pipe from the tank to
the drainfield), 75' from the lake etc.). If this is indeed the situation, this office would not
be able to issue a permit for the construction of the gazage at its proposed location.
The only option would be if the Sawyer County Boazd of Appeals would grant a variance
to construct the garage as proposed. However, the Boazd has been very emphatic that a
vaziance would not be granted in such situations (i.e, the garage could be constructed on
the lakeside of the road and meet all setbacks).
