The application was tabled at the July 16, 2003 public hearing. The Board of Appeals approved the application as follows: Modify application from retaining wall to a terraced configuration, approval conditional upon approval of DNR and Spider Lake issuing a permit. Findings of Fact of the Board of Appeals: The hardship is due to physical limitations with ero- sion. Terracing will alleviate the problem. It is not contrary to the public interest. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiarari to review the legality of this decision within 30 days after the date of this notice. Dear MrJMs. Schmidt: The DNR has completed a site inspection and plan review to address your situation with a retaining wall near the shore of Spider Lake at Musky Run Resort. As the DNR understands the situation,there previously was an agreement to use adjacent property to moor boats and allow recreational activity by resort guests. That agreement is no longer valid. In addition,Musky Run Resort has a retaining wall approximately 15 feet from the water edge of Spider Lake and this retaining wall has been a maintenance problem. The site visit noted that the wall is "bellying out" again and would need additional work. This also is the area that resort guests will need to use for water recreational activity. Initially, the idea was to remove the retaining wall and slope the ground surface back toward the resort buildings. This would require a number of trees to be removed and would disturb a significant amount of soil and potentially degrade water quality through erosional processes. The plan that the Town of Spider Lake and Sawyer County Zoning has approved(with DNR concunence)calls far removal of the retaining wall and terracing the grade down to the lake by use of small landscaping blocks. The DNR agrees with the Town of Spider Lake's opinion that this plan is more environmentally beneficial than the current retaining wall that is deteriorating. The terraced approach will minimize disturbance and also minimize the visual impact on the shore. Therefore the DNR agrees with the proposed tenace plan with the following conditions; 1). Terrace landscaping block shall be of earth tone colors (brown,tan)to minimize visual impact. 2). Only the amount of ground to be terraced shall be disturbed to minimize erosion potential. 3). Erosion controls(best management practices for construction sites) shall be implemented to prevent impact to the lake until the area is adequately vegetated and stabilized. 4). Any vegetation destroyed or removed as a result of this project shall be replaced with in-kind native vegetation(trees and shrubs). 5).
