Please indicate on the diagram the additions that are proposed to be constructed onto the dwelling. I have drawn a 4'x 12'deck addition on the lakeside of the dwelling and a 4'x 8'dining room addition to the rear of the dwelling. I obtained this information from the Application for Land Use Permit submitted by your builder—Mel Coblentz. However,Mel also indicates that a 3'x 41/2'deck,a12'x 18'loft and a new pitched roof will also be constructed onto the dwelling. Please indicate to scale on tbe diagram the exact location of these proposed activities. I cannot complete the variance application until I know the nature of the conshuction activities planned for the house. Mr.Frerker,you should be aware of the issues pertaining to this situation prior to applying for a vaziance. First,the Sawyer County Board of Appeals does not grant variances for decks Therefore,you can expect that the lakeside deck will be denied by the Board as the proposed deck is closer than 72'to the lake. Second,the Board does not typically grant vaziances for construction activities that exceed the"50%current esrimated fair market value"of the existing dwelling. In this situation,the 50%current estimated fair market value of the dwelling is$21,750,with proposed construction costs of approximately$120,000. What is included in the 50% Current Estimated Fair Market Value (CEFMV)? The costs of material and labor related to both the repair/replacement of structural components and structure expansion must be considered as a part of the 50% CEFMV limitations. Examples of activities that would result in 50% CEFMV considerations are, but are not limited to: • Exterior walls: ➢ Siding ➢ Sheathing ➢ Wall studs ➢ Insulation ➢ Interior finish material (i.e. sheet rock, paneling etc.) ➢ Exterior windows and doors • Roo£ ➢ Shingles ➢ Sheathing ➢ Trusses/rafters • Foundation: • Interior: ➢ Electrical ➢ Plumbing ➢ Heating/air conditioning In summary, you can expect that the lakeside deck will be denied and that the Board will require that construction activities not exceed $21 ,750. Discussion: To quafify for a variance,you must meet all th�ee requirements of a three-step test. 1) Strict aopiication of the dimensional requirements contained in the Sa�wer County Zonine Ordinance would result in unnecessary hardship.Present Wrsconsrn case Iniv describes hardship as being present only when an applicant ha.r demonstrated that he or she ivill hnve no reasonable use of the properry, in the absence of n variance.If a parcel as a whole(but not necessarily each portion of the parcel)provides some reasonable use for its owner,then the test is not met and a variance cannot be granted. Self-created hardships.A property owner may not obtain a variance for a hardship that is self-imposed.Examples include:creating a substandard lot when the owner has sold off portions that would have prevented the hardship,creatin�a land- locked parcel by selling property,building during the pendency of an appeal when the owner does not prevail, and making improvements in violation of the ordinance. b. Violations bv neighbors. In State v. Kenosha Counry Board ofAdjustment, the Board of Adjustment in part based its variance on the fact that many other neighbors have decks within the setback. The court rejected that as a legitimate factor to use in determining whether the owner had a reasonable use of her property without a deck. c. Variances run with the propertv. Variances are granted for hardship that pertains to the conditions of the property, rather than to the person making the application. Accordingly, variances run with the property and are not terminated when the property changes hands.
