On April 15, 2003, the Sawyer County Board of Appeals approved with conditions your appli-
cation for variance on the following described real estate to wit:
Part of Govt Lot 6, S 12, T 39N, R 9W, Parcel :6.2. Vol 441 Records Page 370.
Approximately 100'/155'x382'/449' containing 1.37 acres. Property is zoned Resi-
dential/Recreational One. Application is for the construction of a 4'x8' addition
onto an existing non-conforming dwelling at a setback distance of 97' from the
ardinary high water mark of Whitefish Lake and the construction of an 18'x24' re-
placement roof section over part of the existing roof creating a partial loft area, all
at a construction cost exceeding 50% of the current estimated fair market value.
Variance is requested as Section 10.2, Sawyer County Zoning Ordinance, would
restrict the cost of construction to less than 50% of the current estimated fair mar-
ket value. The Town Board has approved the application.
The Board of Appeals approved the application, with a three-year project completion dead-
line.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. There
would be no change in the use in the zone district. It would not be damaging to the rights of oth-
ers or property values. It would be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decsion of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-011.

Application for Variance
Enclosed with this fax is a diagram of the existing dwelling. Please indicate on the
diagram the additions that are proposed to be constructed onto the dwelling. I have
drawn a 4'x 12'deck addition on the lakeside of the dwelling and a 4'x 8'dining room
addition to the rear of the dwelling. I obtained this information from the Application for
Land Use Permit submitted by your builder—Mel Coblentz.
However,Mel also indicates that a 3'x 41/2'deck,a12'x 18'loft and a new pitched roof
will also be constructed onto the dwelling. Please indicate to scale on tbe diagram the
exact location of these proposed activities. I cannot complete the variance application
until I know the nature of the conshuction activities planned for the house.
Mr.Frerker,you should be aware of the issues pertaining to this situation prior to
applying for a vaziance. First,the Sawyer County Board of Appeals does not grant
variances for decks Therefore,you can expect that the lakeside deck will be denied by
the Board as the proposed deck is closer than 72'to the lake. Second,the Board does not
typically grant vaziances for construction activities that exceed the"50%current
esrimated fair market value"of the existing dwelling. In this situation,the 50%current
estimated fair market value of the dwelling is$21,750,with proposed construction costs
of approximately$120,000.
What is included in the 50% Current Estimated Fair Market Value (CEFMV)? The
costs of material and labor related to both the repair/replacement of structural components
and structure expansion must be considered as a part of the 50% CEFMV limitations.
Examples of activities that would result in 50% CEFMV considerations are, but are not
limited to:
• Exterior walls:
➢ Siding
➢ Sheathing
➢ Wall studs
➢ Insulation
➢ Interior finish material (i.e. sheet rock, paneling etc.)
➢ Exterior windows and doors
• Roo£
➢ Shingles
➢ Sheathing
➢ Trusses/rafters
• Foundation:
• Interior:
➢ Electrical
➢ Plumbing
➢ Heating/air conditioning
In summary, you can expect that the lakeside deck will be denied and that the Board
will require that construction activities not exceed $21 ,750.
Please provide me with the requested information as soon as possible. The next
application deadline is 4:00 P.M. , Friday, March 7, 2003.

• "Application for Variance -Additional Information"
• "Variance Application" - completed.
You should review the application for correctness, sign it, and return it to this office with
a check in the amount of$250.00 made out to the"Sawyer County Zoning
Administration"by Friday, March 7, 2003 for hearings in April 2003.
The "Application for Variance -Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Sand Lake at 7:30 P.M., Tuesday, Apri18, 2003. You should contact Elaine
Nyberg, Town of Sand Lake Clerk, at(715) 865-2486 (home)to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, April 15, 2003 in the large courtroom located in the Sawyer County Courthouse.
You or your representative should attend each hearing, especially the hearing conducted
by the Sawyer County Board of Appeals. Only the Board of Appeals can grant the
variance,the decision of the Town of Sand Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

Discussion:
To quafify for a variance,you must meet all th�ee requirements of a three-step test.
1) Strict aopiication of the dimensional requirements contained in the Sa�wer County
Zonine Ordinance would result in unnecessary hardship.Present Wrsconsrn case Iniv
describes hardship as being present only when an applicant ha.r demonstrated that he
or she ivill hnve no reasonable use of the properry, in the absence of n variance.If a
parcel as a whole(but not necessarily each portion of the parcel)provides some
reasonable use for its owner,then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship(i.e.,purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations).A variance also cannot be granted,when in the absence of the
variance approval,the owner will suffer loss of profit or financial hardship.Decks
and similar minor accessory structures are not essentia(to the reasonable use of
property and are not eligible for variances.
2) The hardship must be due to unique phvsical limitations of the propertv which are not
�enerallv shared bv other properties.Growin�families,additional livino area for
guests,the desire for a larger garage etc.,are not factors in deciding variances.
3) A variance mav not be aranted which results in harm to public interests.The Sawyer
County Zoning Ordinance was adopted"for the promotion and protection of the
public health,morals,safety,and the general welfare."Additionally,the shoreland
zoning provisions of the Ordinance,provides for water quality,wildlife habitat,
fisheries and natural scenic beauty protection of[he County's lakes,rivers and
streams
4) Other considerations:
a. Self-created hardships.A property owner may not obtain a variance for a hardship
that is self-imposed.Examples include:creating a substandard lot when the owner
has sold off portions that would have prevented the hardship,creatin�a land-
locked parcel by selling property,building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations bv neighbors. In State v. Kenosha Counry Board ofAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the propertv. Variances are granted for hardship that pertains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.

The existing structure , WITHOOT IMPROVEMPNTS , encroaches into current setbacks by
2 ' 0" at one corner . The design for the remodel DOES NOT further encroach upon the
setback and maintains the same foot rint save for the ro osed 4 ' x8 ' dining room
addition, which is located at the back of the structure and therefore maintains a

County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main

owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute zoning hardship.
