construction of a 250' above ground level communication tower on this parcel.
Variance is requested as Section 4.53, Height Limitation, Sawyer County Zoning
Ordinance, would require that the maximum height of the proposed tower not ex-
ceed 1360' above mean sea level as indicated on the Height Limitation Zoning
Map for the Hayward Municipal Airport.
The Board of Appeals approved the application as submitted, not to rise above 216' above
ground or 1414' above mean sea level.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. It would be due to spe-
cial conditions unique to the property.
Any person ar persons jointly aggrieved by this decsion of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please

Grand Towers' proposed tower
Mr. Mayberry:
I received a phone call today from Mike Reger of Grand Towers LLC asking whether or
not FAA had taken in consideration the proposed ILS when they reviewed the proposed
tower location (study #02-AGL-5227-OE). Based on the attached email I had received,
FAA had taken the ILS precision approach into consideration during their analysis.
Therefore FAA would issue a favorable determination provided the structure does not
exceed 216' above ground level (1414' above mean sea level). Based on FAA's review
and response, we would also concur with their approval and the issuing of a variance to
the zoning ordinance. If you have any questions, please feel free to give me a call at

We (flight procedures) are protecting for the proposed Localizer RWY 02
approach at HYR. The evaluation of subject OE included not only the
Localizer eval but a full blown precision eval as well.
Just to make sure, this morning I double checked the subject obstacle. It
is 1.29NM left of the inbound Localizer course line and 12291 feet straight
line from RWY 02 . It clears all three precision surfaces and is clear of
Localizer inner and outer surfaces. It is below the controlling obstacle
for the current GPS approach and is even below the required Adverse
Assumption Obstacle (AAO) evaluation. An AAO eval is an assumption that if
there are no obstacles identified in final, what would the effects be if we
took detailed terrain information and protected for a 100 foot obstacle and
called that our controlling obstacle and determined our MDA against that
MSL height. That would mean any and all obstacles above the assumed 100
AGL height would violate all TERPS surfaces if found in one of those
surfaces. This is a very stringent eval and in reality isn't fair to
existing (or proposed) obstacles .
I know . . . more in£ormation than you were iooking for. I just wanted to
assure you that as far as flight procedures is concerned, we are making
sure we protect for your proposal .

Not sure what you saw in the i0E/AAA database, but 02-5227 remains a
Presumed Hazard (DPH) , dated 11/19/02 . FYZ, the DPH was based on a
77 .23 (a) (2) bust of 37 feet, not any IFR effect (none noted) . The sponsor
has not gotten back to us yet to either accept the 216 £eet, or request
further study for the 253 feet.

This is a proposal for a 253 ' AGL cell tower 14, 000 ' SSW of the Sawyer
County Airport (KI-IYR) .
We received a PRESUMED HAZARD dated 19-Nov-02 if > 216' AGL. Just looked
in
the OEAAA database and noticed that has apparently been changed to a NO
HAZARD at the proposed 253 ' AGL.
Two questions:
1. What happened to the presumed hazard at 253 ' AGL?
2 . We (feds, state, and locals) are about to invest $3+ million for a
localizer to RWY 02 . Don't know if the LOC is yet in the database for
OEAAA
analysis. We want to make absolutely sure this tower would not degrade any
of that $3 million investment.

Sawyer County Law Enforcement Center. Motion carried.
The Committee reviewed the monthly expense vouchers of the Maintenance Department. Motion
by Kelsey, 2nd by Hirschfeld, to approve the vouchers. Motion carried.
The Committee reviewed the proposal developed by the Wisconsin Department of Transportation
Bureau of Aeronautics to update the Sawyer County Airport Layout Plan. Brad `✓olker (Cooper
Engineering), Dan Leslie (L & L Aviation), and Robert Stuchal (Hayward Area Development
Corporation) were present for the review. The update presents several options for development of
the Airport and serves as a guide for the County and State in developing plans for Airport
improvement projects. Approval of an updated Airport Layout Plan is a requirement for the State
to proceed with assistance and funding for Airport improvement projects. Motion by DeLong, 2nd
by Hirschfeld, to recommend approval of the updated Sawyer County Airport Layout Plan to the
County Board. Motion carried.
The Committee reviewed a request to approve a proposed Bill of Sale and Assignment of Ground
Lease transferring Illinois Data Mart's hangar area lease at the Sawyer County Airport to Schull
Properties of Hayward. Motion by Olson, 2"d by Kelsey, to approve the request. Motion carried.
The Committee reviewed Wisconsin DepaRment of Transportation Bureau of Aeronautics Airport
Development Engineer Wendy Hottenstein's letter dated January 23, 2003. The letter indicated
the Bureau's concurrence with a Federal Aviation Administration determination to recommend
Gounty approval of the request of Grand Towers for the construction of a communications tower in
the City of Hayward. The approval is conditioned upon the tower not exceeding 216 feet above
ground level (1414 feet above mean sea level).
Dan Leslie, of L 8� L Aviation (contracted Airport management), reported on operations and
conditions at the Sawyer County Airport. The Committee discussed sending letters requesting that
the Bureau of Aeronautics proceed with the installation of deer fencing and runway approach
lighting if funding for the more ambitious project to install a full instrument landing system is not
approved.
The Committee discussed whether to proceed with arrangements to have the value of the
Raymond Vallem property appraised in anticipation of negotiations for the purchase of the property
by the County. Motion by DeLong, 2"a by Kelsey, to authorize the appraisal. Motion carried.
Hayward Development Corporation Executive Director Robert Stuchal presented a proposed letter
to be sent to the individuals and corporations that made financial contributions for recent Airport
improvements. Mr. Stuchal will refine the letter for signature and distribution. FuRher recognition
of the donations will be made at on open house when improvements are completed.
The Committee reviewed the monthly expense vouchers for the Airport. Motion by Kelsey, 2"d by
Hirschfeld, to approve the vouchers. Motion carried.

I have enclosed with this letter a completed "Variance Application" for the construction
of a communications tower on the above property. Please review the application for
correctness, sign it, and return it to this office with a check in the amount of$250.00
made out to the "Sawyer County Zoning Administration" by Friday, February 7, 2003 for
hearings in March 2003.
The Sawyer County Board of Appeals will hold a public hearing on your application at
7:00 P.M., Tuesday, March 18, 2003, in the large courtroom located in the Sawyer
County Courthouse. You or your representative should attend this hearing. Only the
Board of Appeals can grant the variance.
Since the Hayward Municipal Airport is located in the Town of Hayward, the Town will
be provided the opportunity to respond to your request for the variance. The TownBoard
of Hayward will hold a town meeting at 7:00 P.M., Tuesday, March 11 , 2003. You should
contact Jodi Longtine, Town of Hayward Clerk, at 634-4123 to confirm this date.
It is the responsibility of you or your agent (Grand Tower LLC) to convince the Board of
Appeals to grant the variance that you have requested. Therefore, you should consider
using any means at your disposal (i.e., photographs, drawings, a good verbal presentation,
etc.) as you present your facts to the Board. In this particular situation, you must present
any documentation/correspondence that you may have from the FAA, the State DOT or
any other agency involved in the instrument landing system (ILS) project at the airport,
that states that the proposed tower will not adversely impact the installation of the ILS.

Deaz Mr. Hanka:
The purpose of this letter is to clarify the issues regazding any public hearings that may be
required to grant a vaziance to exceed the height limitations indicated on the Height
Limitation Map of the Haywazd Municipal Airport dated September 11, 1975 for the
construction of the proposed antenna tower.
Back r�und:
The Sawyer County Zoning Ordinance, Section 4.5 AIRPORT SAFETY
REGULATIONS, regulates construction activities within the boundaries of the Height
L'unitation Map of the Haywazd Municipal Airport, now referred to as the Sawyer County
Airport(HYR). The concern with the proposed antenna tower is that the height of the
tower(145 P AMSL) exceeds the m�imum height limitation(1360' AMSL) as required
by the height limitation map. I understand that the m�imum tower height may now be
reduced to 1414' AMSL—still above the maximum height requirement. It is obvious that
a variance must be granted to construct the tower if its height will exceed 1360' AMSL.
Issues:
1. Wluch governmental entity should conduct variance public hearings? One of the
issues confronting this office regazding this particulaz project is which governmental
entity(Sawyer County or the City of Haywazd) should conduct variance public
heazings. This issue was resolved today, as this office was informed that WiStat
146.136 Airport approach protection, requires that Sav✓yer County conduct the
hearings as the Sawyer County Zoning Ordinance contains the aerial approach height
requirements pertaining to the Sawyer County Airport.
2. Instrument Landing System (ILS)project on-going at the airport. There is currently a
$3,000,000 ILS project underway at the airport. A County concem is that this project
not be jeopazdized in any manner. The construction of your proposed tower may very
well adversely effect this project.
3. Input from all concerned agencies. The County is taking the position that variance
public hearings not be held on the proposed tower height until all concerned agencies
(i.e., Federal Aviation Administration, Federal Communications Commission,
Wisconsin Depar[ment of Transportation—Bureau of Aeronautics etc.)have provided
written input as to the possible impact this tower will have on the ILS project and the
safe operation of the airport.
Conclusion: Sawyer County is willing to address the issue of the proposed tower;
however, Sawyer County will definitely oppose the granting of any vaziance that would
jeopardize the ILS project and the safe operation of the airport.

this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statemen[ should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings aze requested. Explain the undue zoning hardship inflicted upon thc
owner by conforming to the required minimum regulation, which induced the variance
