On February 18, 2003, the Sawyer County Board of Appeals denied your application for vari-
ance on the following described real estate to wit:
Lots 5 & 6, Block 2, Grindstone Heights Subdivision, S 20, T 40N, R 8W, Parcel
—15.2.5&6. Vol 516 Records Page 300. 100'x160'/190' containing .413 acres.
Property is zoned Residential/Recreational One. Application is for an after-the-
fact variance for the construction of a 28'x31' second story addition onto an exist-
ing dwelling, at a setback distance of 38' from the ordinary high-water mark of
Grindstone Lake and exceeding 50% of the current estimated fair market value.
Variance is requested as Section 4.49(2), Sawyer County Zoning Ordinance, re-
quires a minimum setback distance of 55' as the average lake setback distance
was determined at that distance from the lake, and Section 10.2 would restrict the
cost of construction to less than 50% of the current estimated fair market value.
The Town Board has denied the application.
The Board of Appeals denied the application as submitted. The Board of Appeals has required
removal by July 1, 2003. The new roof must follow the same pitch of the garage without the
habitable area. There can be no second story. Cannot exceed 50% of the current estimated
fair market value.
Findings of Fact of the Board of Appeals: It would be the convenience of the owner. It would be
a self-created hardship.
Any person or persons jointly aggrieved by this decsion of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 03-007.

Dear Mr. Duffy:
The Sawyer County Board of Appeals held a public hearing at 7:00 P.M., Tuesday,
February 18, 2003. At this hearing the Board considered Variance # 03-007, applicant —
James H. Sincula. Mr. Sincula did not attend the hearing. The Board denied the
application for variance with the following conditions:
• Second story addition to be removed by July 1, 2003.
• Replacement dwelling roof shall have the same pitch as the roof of the
attached garage.
• No second story or habitable area to be created.
• Construction activities shall not exceed 50% of the current estimated value of
the dwelling.
• A Land Use Permit shall be required from the Zoning Office for the
construction activities.

Dear Mr. Sincula:
I have enclosed the following documents with this letter:
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information," and a completed
• "Variance Application."
Please review the inspection report, read the summary on court decisions and complete
the request for additional information.
If you believe that you meet the criteria for the requested variance, you should review the
variance application for correctness, sign it, and return it to this office with a check in the
amount of $250.00 made out to the "Sawyer County Zoning Administration" by Friday,
September 6, 2002 for hearings in October 2002.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, October 14, 2002. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-2172 (home) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 15, 2002, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance,the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
The 50% current estimated fair market (CEFMV) rule applies in this situation as the
dwelling is a nonconforming structure—it is closer than 75' to the lake. The "50% rule"
restricts the cost of improvements to a nonconforming structure to no more than 50% of
the CEFMV of the structure. The 50% CEFMV for the dwelling is $25,400.
Construction costs exceeding $25,400 would require the approval of a variance by the
Sawyer County Board of Appeals.
The above information was determined from assessment records available from the
Sawyer County Tax-lister's office. In reality, the 50% CEFMV should be determined
from the Town of Bass Lake assessor's records but I have not been able to contact him.
His telephone recording states that he will not be returning to his office until September
8tn, which is past the September 6`h deadline for October public hearings. My feeling is
that the construction activities probably exceeded the 50% CEFMV, but if you can
present evidence to the Board to the contrary, the Board would not consider this as a part
of the variance application. My intent now is to get the process started and to make
adjustments later based on the information that I receive from the assessor.
The costs related to the 50% CEFMV are the costs of materials and labor to enclose an
addition and to finish the interior of the addition (i.e., sheet rock). Costs related to
plumbing, heating electrical, window and floor coverings etc.; are not related to the 50%
CEFMV.
You must be prepared to discuss the proposed construction costs with the Board of
Appeals at the public hearing. It would be helpful if you could have an itemized estimate
available for presentation to the Board of the materials and labor associated with this
project. The Board of Appeals may postpone the hearing on your application until
November 2002 if this information is not available for their review.

Public Hearing
Dear Ladies and Gentlemen:
I have reviewed the variance application by James H. Sincula requesting variance from Sawyer
County Zoning Ordinance Section 4.49(2) and Section 10.2. The application requests after-the-
fact variance for construction of a second story addition at a setback distance of 38 feet from the
ordinary high-water mark and exceed the 50% of current estimated fair market value.
The basic purpose of the shoreland zoning ordinance is to protect navigable waters from
degradation and deterioration, which results from uncontrolled use and development of
shoreland. According to Wisconsin case law, re-affirmed in the recent Wisconsin State
Supreme Court decision State of Wisconsin v. Kenosha County Board of Adiustment, when an
applicant submits a request for a variance, he or she must show that unless a variance is
granted, he or she has no reasonable use of the property.
In other words, the party seeking the variance must prove that an unnecessary hardship will
result if the variance is not granted. The hardship must be the result of a unique condition of the
property or land, and not a condition personal to the landowner. The granting of a variance
cannot be to alleviate (or accommodate) a self-created hardship, or merely for self-convenience.

The minimum setback helps to spread-out development and offers a separation between
potentially intrusive or conflicting uses and minimizes the potential for aesthetic impact.
Granting variances that would reduce the setback requirement could also set a precedent and
have a detrimental cumulative impact.

To qualify for a variance,you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sawver Counte
Zonine Ordinance would result in unnecessary hardship.Present IVisconsin case laiv
describes hardship ns being present only tirhen nn npplicant has dernonstrated that he
or she ivill hoi�e no reasonnble use of the properly, in the absence of a variance.If a
parcel as a whole(but not necessarily each portion of the parcel)provides some

variance approval,the owner wi11 suffer loss of profit or financial hardship.Decks
and similar mi��or accessory structures are not essential to the reasonable use of
property and are not eligible for variances.
2) The hardship must be due to unic�ue phvsical limitations of the propertv which are not

4) Otlier considerations:
a Self-created hardships.A property owner may not obtain a variance for a hardship
that is self-imposed.Examples include:creating a substandard lot when the owner

Dear Sir/Madam,
This application is not for a second story addition onto an existing dwelling. Due to the
prior condition of the roof(a sagging 3/12 pitch, failing shingles and leaks) I determined
a long-term remedy would best suit my needs.
I intend to own this house for many years and felt a steeper pitch roof would not only be
less likely to have sagging rafters, but also shed snow and rain better. My neighbor has a
12/12 pitch roof and recommended that I take a similar course of action.
The increased size of the attic space allows me additional storage. This is all the space
will be used for as it has no insulation, heat, plumbing, drywall and only one pull chain
light above a retractable pull-down attic stairway.
The cost of this improvement is considerably less then 50% of the CEFMV, as my
receipts will substantiate. In addition, the footprint of the house has not been affected
because I only removed the old roof and replaced it with another.
