Further, the purpose is to allow sand, gravel and rock extraction and processing operations, and a temporary rock crushing plant on an approximately 27 acre parcel known herein as the Arntz Property. R&P's Earth & Forest Works proposes to excavate and process sands, gravels and rock from the Arntz Property according to the enclosed development plan. The development plan describes the progressive extraction of sand, gravel and rock materials with subsequent reclamation of excavated areas. In order to permit the extraction of sand, gravel and rock from the Arntz Property, a Special Exception Permit is required from the Sawyer County Board of Adjustment for the use of a rock crusher within the 1000' setback from the residence of James A & Karen A Ehn. There are two other properties within the 100' setback, which are both owned by the Arntz family. The property will be used primarily for building and road construction in the Winter area. 1 .2 Property Owner Robert Arntz, whose address is N4900 Old Highway 70, Winter Wisconsin, is the owner of the property. 1 .3 Location and Background The Arntz Property is located near the intersection of County W South and Old Highway 70, approximately 1 mile south of the Village of Winter, Wisconsin. (See Figure 1 :Arntz Location Map. The south lot line is bordered by a row of large pines, which supplies a natural barrier for the adjoining landowners, James A & Karen A Ehn. The east lot line borders the driveways of Robert Arntz, Sr. and Robert Arntz, Jr. The west lot line borders Old Highway 70, which will be shielded with a topsoil berm, to be used for reclamation following excavation of materials. The north lot line lies along a private road, also owned by the Arntz family. The area of excavation consists of a 12' — 16' gravel and sand face. There are no waterways or wetlands within the excavation area. Elevations found at the site appeared as shown in Figure 2: Proposed Pit Area (Page 4). Two gravel pits shown on the Figure 1: Arntz Property Location Map (Page 2), are no longer in existence. Dwellings have been built where the gravel pit appears near Lake Winter and the pit west of the Arntz Property is no longer being used. One permanent residence, not belonging to the Arntz family, is located within 1000' of the Special Exemption permit application area. The residence, as stated above, belongs to James & Karen Ehn, and is shown on Figure 2: Proposed Pit Area (Page 4). 1.5 Soils and Geology Soils found within the proposed excavation area consist of gravel, sand and rock ranging from moderately rapid to rapid permeability. These soils were deposited during various phases of the Wisconsin glaciation period. The land area to be disturbed by the excavation and processing area is approximately 20 of the 30 acres owned by the Arntz family. 22 Operation Development Plan If approved,the sand,gravel and rock excavation operation is projected to begin during the year 2004. R&P's Earth&Forest Works would like to use this source for construction and road building projects in the Winter area. A minimum 50-foot setback will be maintained between the excavation and all property lines. There are three residences within the 1000-foot setback of the proposed excavation site. Two of the residences belong to the Arntr family and the last,to James&Karen Ehn. The depth of the excavation will be approximately 14-16 feet,depending on the depth of sand,gravel and rock. Previous exploration of the site,as well as a soil test conducted on the property of Robert Arntz,Jr,indicated the usable material to be to that depth. Excavation will initially begin along a private roadway used by the Arntz's, in a westerly direction. The stockpile area and pit face will initially be located approximately midway between the Arntz residence and the access roadway from Old Highway 70,where the private roadway is at iYs lowest elevation and the material is at iYs highest elevation. Based upon the total projected reserves the property may be exhausted in five to ten years. The number of years is dependent on product sales and available product. s R&P's Earth & Forest Works 2/6/2004 2.3 Operation Activity The primary operation activity will be the extraction of sand, gravel and rock, and processing for construction use. The typical excavation operation sequence will begin with the removal of the topsoil using a bulidozer, excavator, loader and haul trucks. After the sand, gravel and rock is exposed, the materials are excavated from the bank and hauled by loader to supply a rock crusher and screening plant. At the crushing and screening plant areas the material is crushed and sized into various products and stockpiled using conveyors. The crushing and screening plants are portable and are easily moved within the excavation area, and to and from the site as needed to replenish product stockpiles. An end-loader and excavator are used to load materials into haul trucks and an end-loader and skidsteer are used to supply material to the screening plant. Occasionally, clean recycled products become available, recycled concrete may be hauled to the Arntz Property. 2.4 Operation Schedule Activity at the site will normally occur during the construction season (April through December). Hours of daily operation will typically be from 5:00 a.m. to 10:00 p.m., Monday through Saturday. 2.5 Operation Equipment List and Employees Equipment involved in the sand and gravel operation is listed below: Overburden Removal: 1 excavator 1-2 bulldozers 1 skidsteer 1-3 haul trucks Processing Operations: 1 crushing and screening plant (only when needed) 1 front end-loader 1-2 bulldozers 1-4 conveyors/stackers (only when crushing) s R&P's Earth & Forest Works Z6/2004 2.6 Sand and Gravel Use R&P's Earth & Forest Works plans to use the aggregate materials for building and road construction in the Winter area. 2.7 Haul Routes The primary haul route to be used by loaded trucks from the Arntz Property will be northward, then westward from the excavation area via the private access road to Old Highway 70 (a Winter township road). Loaded trucks will utilize both Old Highway 70 and County W. The number of truckloads that are projected to leave the site on a daily basis will vary considerably depending on the scope of work scheduled that day. This also depends on the time of year and the number of active road projects in the area. The most active months of hauling during the year will coincide with the construction season (March through December). There will be no hauling during the four to six weeks that Old Highway 70 and County Highway W have weight limits posted. Also, d�ring the winter months, very few trucks, if any, will haul from the site. � R&P's Earth & Forest Works 2/6/2004 SECTION 3.0 ENVIRONMENTAL CONSIDERATIONS 3.1 Site Screening The aggregate excavation and processing area is currently screened from the Ehn Property to the south, by a row of large red pines. Perimeter berms will be constructed around the pit area, which is also shielded from Old Highway 70 to the west, by the face itself. Any temporary berms will be constructed with soil and overburden materials removed from the top of the sand, gravel and rock. Berm height may vary somewhat in different areas of the property depending on the need to effectively screen the operations from view or direct surface runoff. 32 Air Quality The Wisconsin DNR Bureau of Air Management regulates crushing and screening operations at the site. The processing equipment will be in compliance with the opacity requirements permitted under the Aggregate Processing General Permit. The general permit provides flexibility for using different processing configurations and various pieces of equipment, depending on the type of aggregate product being produced. It outlines production requirements, including record keeping, employee training, malfunction prevention and abatement and fugitive dust control measures that must be maintained for compliance with the permit. The requirements of the general permit will be used during the aggregate processes. 3.3 Ground Water The sand, gravel and rock excavation and processing operation will employ a variety of screening, crushing and conveying equipment, including loaders and trucks. The lubrication, and repair practices used to maintain the equipment will be designed to eliminate petroleum products from ground contact. The Storm Water Pollution Prevention Plan and Spill Prevention Control and Countermeasures (SPCC) plans address practices for proper storage, handling and use of petroleum products, as well as inspection and response procedures. No fuel will be stored on-site. 8 R&P's Earth 8 Forest Works 2/6/2004 3.4 Surface Water The Wisconsin Department of Natural Resources Storm Water Program regulates the proposed non-metallic mining operation. R&P's staff has attended training on Best Management Practices (BMP's) for pollution prevention and employs these practices. The management practices listed in our storm water management plan address erosion control, and petroleum product handling. With the exception of limited lengths of the access road and natural runoff area to the east of the road, all storm water and spring snowmelt water from the operation will be contained in the below grade excavation, with no runoff leaving the processing area. There will be no hazardous wastes produced in conjunction with the excavation or processing operations. Used oil and lubricants from equipment maintenance will be collected for recycling. Any waste receptacles will be located away from active operation areas. 3.6 Safety and Health The United States Department of Labor, Mine Safety and Health Administration (MSHA) regulates the safety; and health considerations of the non-metallic mining operation. The site will be subject to annual inspection by MSHA and must meet noise and dust exposure limits established for personnel employed in the operation activity. Noise will be mitigated on the site by maintaining functional mufflers and exhaust systems on all internal combustion engines and by shielding mechanical processes with noise barriers such as berms and below grade processing. A 10-miles/hour speed limit will be enforced at the facility for loaders and trucks to provide safe working conditions and reduce fugitive emissions. Hard hats are mandatory for all personnel within the excavation and processing areas. Visitors must have permission to enter the site and must observe all safety regulations while visiting the site. s R&P's Earth & Forest Works 2/6/2004 SECTION 4.0 RECLAMATION PLAN 4.1 Reclamation Plan Area The Arntz Property will be reclaimed according to the requirements set forth by Sawyer County Land & Water Conservation personnel. Reclamation will occur after the excavation activity is exhausted. A reclamation will be established as required by Sawyer County Planning and Zoning for the acres disturbed by the excavation and processing operations. 4.2 Reclamation Sequence A Reclamation Plan has been ordered by R&P's Earth & Forest Works, from Sawyer County Land & Water Conservation Department. The proposed size of the mine is 25 acres and will be used for the purpose of gravel and sand extraction. Paula has requested the Land and Water Conservation Department to write a reclamation plan for the mine. Due to the amount of snow cover at the present time it is not possible to write a plan that would be accurate for the site at this time.
