This conditional approval must now be ratified by the County Board of Supervisors. The conditions set out in the Zoning office letter, together with the conditions in our letter of ` ' December 4, 2003, a copy of which was sent to you, make the proposal acceptable under the terms of the two easement interests held by the United States,identified as National Park Service Tracts 15-156 and 15-157. As soon as you have available a surveyed plat of the proposed subdivision would you please send a copy to this office. Thereafter, when the plat is approved we would like to be advised of the date and the recording information. When each individual lot is sold the document of conveyance should note specifically that it is subject to the terms of these easements and we would appreciate receiving a copy of the recorded document/s of conveyance so our files will be up to date. The Sawyer County Zoning Committee approved the application as follows: With the conditions of the National Park Service as stated in the letter of December 4, 2003 (attached); and with the conditions suggested by the Town of Bass Lake. 1. Only four lots, to be divided with one single family dwlling unit on each lot. 2. The lots are to be divided equally using the width of the parcel to Rohlf Rd. 3. A covenant to be placed on the deeds that the lots cannot be further subdivided or used for additional dwellings. Findings of Fact of the Zoning Committee: It would not be damaging to the rights of others or property v alues. I t w ould b e c ompatible w ith t he s urrounding u ses a nd the area and with the Town of Bass Lake comprehensive plan. The Sawyer County Board of Supervisars must ratify the approval of the change in zone district before it becomes final. This will be scheduled for the County Board meeting on February 19, 2004,9:00 A.M.,in the Circuit Courtroom of the Sawyer County Courthouse. This decision is a recommendation to the County Board of Supervisors. Any person or persons jointly aggrieved by the decision of the County Board may commence an action in the Circuit Court for Writ of Certiorari to review the legality of the decision within 30 days after the date the decision is ratified by the County Board. Box 676 ������ Hayward, WI 54843 Dear Ms. Taylnr: Thank you for sending information regarding an application for rezoning an area within Sawyer County and within the St. Croix National Scenic Riverway(the Riverway). The request would change zoning in land south of the Namakagon River in the NE1/4 NE1/4 of Section 7,Township 40 North, Range 9 West. The change would be from Forestry 1 to Residential, RR1. The application states the land would be subdivided into 4 home sites, excepting the wetlands areas shown on the wetland Inventory Map for this area. The National Park Service(NPS)identifies this land as Tract 13-156 and 13-157, as shown on the enclosed NPS map of the area. The USA's interest in these lands was acquired and is managed by NPS as part of the Riverway, as follows: Both tracts were acquired in a Stipulated Settlement and court order recorded in Sawyer County on August 19, 1994, in Vol. 538,page 134-146, as Doc. No. 243520.: The interest in Tract 13-156 (14.47 acres)is known as a "Riverfront Easement". This easement does not permit construction of any structure containing living quarters anywhere on the land. Accessory buildings reasonably necessary to serve single family residence/s on adjacent property may be constructed on land out of line of sight from the Namakagon river. In the case of 13-156, an area measured parallel to and within a distance of approximately 100 feet from the ord:inary high water mark of the river is considered to be within line of sight, with no construction of any xinu permitted witnin tnat area. Tnis easement restriction would be in addition to any coumty zoning restrictions in existing wetland areas. The interest in Tract 13-157 is lrnown as a"Scenic Easement." Scenic Easements do permit single family residential development, including subdividing, on lots, each meeting minimums of at least 1.5 acres of land, at least 250 feet of width on the side most nearly facing the river (the west side in this case) and a determination by NPS that each lot is out of line of sight from the � river. In the case of Tract 13-157 the entire 27.12 acres is considered to be completely out of line of sight. To summarize, the rezoning proposal contained in the November 19, 2003 application by Bergrum is acceptable to NPS, subject to the conditions set out in this letter. Tract 13-157 could be subdivided into the 4 lots mentioned in the rezoning application, since there is sufficient acreage and width in the tract to accommodate that many lots. Also, the subdivision could include an extension of each lot to cover a comparable area of Tract 13-156. However, (2) residences could be built only on the part of the lots in Tract 13-157 and the restrictions mentioned above would apply to any part of the lots extending into Tract 13-156. This subdivision proposal was inspected informally by our Rangers early in 2002 and tentative approval was indicated at that time. However, both easements require the owners' compliance with all local and state zoning and land use regulations and,before formal subdividing is completed and before any construction is begun,both of these easements require written notice to and receipt of written approval from NPS covering the subdividing and future construction plans. By copy of this letter we are notifying these o���ners of the need to comply not only with zoning �� � �� regulations,but also with the terms of the USA's easements.
