Dear Mr. Plummer,
On August 17, 2004, the Sawyer County Board of Appeals denied your appeal of the
Sawyer County Zoning Committee's decision on the following described real estate to
wit:
Town of Sand Lake—Richard Plummer et ux. Lots 3 & 4, Victory Heights Subdi-
vision Addition C, S 10, T 39N, R 9W, Parcel -16.1.3&4. Vol 651 Records Page
51. 1.06 acres. Property is zoned Residential/Recreational One.
On Friday, June 18, 2004, the Sawyer County Zoning Committee held a public
hearing on the appellant's request to grant a Conditional Use Permit to exceed the
allowable imprevious surface on the appellant's property to a total of 19.8%. Sec-
tion 4.22, Sawyer County Zoning Ordinance, provides the opportunity for the is-
sue of a Conditional Use Permit not to exceed 25% of the total shoreland lot area
within 300' of the ordinary high water mark of navigable waters. The Sawyer
County Zoning Committee denied the appellant's request as the Committee de-
termined that "it would be damaging to the rights of others" to grant the Condi-
tional Use Permit. The appellant is requesting that the Sawyer County Board of
Appeals approve his request based on the evidence provided.
The Board of Appeals denied the application. The Board of Appeals determined that the
Zoning Committee was within its jurisdiction; did base its decision on the correct theory
of law; was not arbitrary, oppressive or unreasonable; and did reasonably make the deci-
sion in question.
Any person or persons jointly aggrieved by this decsion of the Board of Appeals may
commence an action in the Circuit Court for Writ of Certiorari to review the legality of
this decision within 30 days after the date of this notice. The decision of the Board of Ap-
peals was made on August 17, 2004 and the decision filed on August 20, 2004.

4)Nonconfortning structures within the shorelands which are damaged or destroyed by violent wind,vandalism,
fire or flood may be reconstructed provided:
a. Damage which is due to an intentional act of the owner may only be repaired in conformiry with the
ordinance.
b. The owner must establish by competent evidence the specific extent of damage to a structure and
its improvements.
c. Repair and reconstruction are limited to that part of a structure and its specific improvements which
were actually damaged and similar building matenals are employed_
d. Repair and reconstruction are in compliance with all other provisions of applicable ordinances.
e. MITIGATION may be required.See Section 4.419 MITIGATION.
f. A land use permit is required.
g. Standard erosion and storm water runoff control measures must be implemented.
5)Existing nonconforming boathouses.The ORDINARY MAINTENANCE AND REPAIR of nonconforming
boathouses that extend waterward beyond the ordinary high-water mark of any navigable waters shall comply
with the requirements of s.30.121,Wisc Stats(Overv✓ater Boathouses).
4.422 IMPERVIOUS SURFACE LIMITATIONS
INTRODUCTION:Extensive research shows that shoreland development resuRs in increased quantities and
velocities of runoff that may overwhelm infiltration capacity and transport sediment,nutrients and other pollutants
directly to surface wa[ers if proper management is not employed.
1)The maximum total area of impervious surfaces shall not exceed fifteen percent(15%)of a total shoreland lot
area within 300'of the ordinary high-water mark.
2)The limitation on impervious surfaces may be increased to no more than twenty-five percent(25%)only with a
Conditional Use Permit.A conditional use application shall include,at a minimum,the following documentation:
a. A topographic survey of sufficient scale(not less than 1"=20')showing pre-construction and pre-
excavation conditions including slopes/contours,water bodies,wetlands,vegetative cover,drainageways,
roadways,buildings and all other impervious surfaces and any unique physical features of the lot.
b. (b)A site plan of similar scale showing the information required in(a)as proposed post-construction
conditions,and shall include all erosion/sedimentation control measures,diversionlcontainment structures
and total calculations of lot area and impervious surfaces-
3)The limitation on impervious surfaces located more than 300 feet from the ordinary high-water mark may be
increased to no more than thirty percent(30�)onty with the submission and approval of the Zoning DepaRment
of a Rainwater/Snow Runoff Retention Plan containing the same information required in 2(a)and 2(b)for a
Conditional Use Permit.
4.5 AIRPORT SAFETY REGULATIONS
4.5'I Definitions.For the purpose of these regulations,certain words or terms used herein are amended into
Section 20,Definitions of the Sawyer Country Zoning Ordinance.
4.52 Airport Zones.All zones established by this section are shown on the map dated September 11,1975
entiUed,Height Limitation Map of the Hayward Municipal Airport.This map,together with all explanatory matter
and regulations thereof are an integral part of this ordinance.The official copies of the Height Limitation Map of
the Hayward Municipal Airport together with a copy of this ordinance shall be kept at the County Zoning
Adminishators office and shall be available for public inspection during office hours.
4.53 Height Limitation.Except as otherwise provided in this ordinance,no structure shall be constructed,altered,
located,or permitted to remain after such construction,alteration,or location,to a height in excess of the height

Enclosed in this packet is all the information on the Richard Plummer Conditional Use
application that was denied by the Sawyer County Zoning Committee on June 18, 2004
and subsequently is being appealed to the Board of Appeals.
Since this will not be a de novo hearing (a new hearing with new testimony and evidence),
I have transcribed the Plummer application hearing and have enclosed the corresponding
maps, Town Board decision and opinion letters, as well as the evidence Mr. Plummer
submitted at the Zoning Committee hearing.
This appeal will be held on Tuesday, August 17�' following the regularly scheduled
variance applications(one of which has been tabled till September).

On Friday, June 188, 2004 the Sawyer County Zoning Committee held a public

This Hearing will begin at 9:00 A.M. in the Sawyer County Courthouse, 10610 Main
