On February 2Q 2004 the Sawyer County Zoning Committee did not arrive at a
majority vote required on your application for a conditional use on the following
described real estate to wit:
Lot 2, Being part of Gov't lot 2, S 19, T 37N, R 9W; Parcel :2.19. WD Volume 615
Records page 354; CSM Volume 12 page 217. 0.89 acres. Property is zoned
ResidentiaURecreational One.Permit is desired for the use of lot 2 as mainland access for
two additional lots on Garbutt Island. (Note: On November 14, 1997 a conditional use
application was granted for the use of lot 2 for two island lots. Applicant is seeking
approval for the use of lot 2 for two more lots on the island totaling 4 island lots using one
mainland access.)The Town Board has approved the application.
On Monday, February 23, 2004 the Sawyer County Zoning Administrator, William
Christman and myself, met with our Corporation Council, concerning your request and
the motion that was made on the request. It is our Corporation Councils opinion, that
based on the motion to deny,the second and the failure to obtain a majority vote on the
motion,that your application request for conditional use was denied.
The Findings of Fact for the denial was it would not be compatible with the sunounding
uses and the area and that it would not be in compliance with the zoning ordinance.
Any person or person jointly aggrieved by the decision of the Zoning Committee may
commence an action in the Circuit Court for Writ of Certiorari to review the legality of the
decision within 30 days after the date of this notice.

Dear Mr.Christman:
Please be aware that I have a significant work conflict which prohibits my ability to appear at this
important meeting. It is my understanding that the committee will discuss fiow to best appioach
my request and the two-to-two vote which ended up in a denial of my request.
It is my sincere hope that the committee will decide to re-hear this request when the full
committee is available to render a decision regazding it. It is important for me to be able to better
darify my request and the basis of it at a subsequent meeting with the hope that[he committee
will see the positive tax-base implications and other advantages of granting llus request. Should
there be:estrictive ordinanccs on the use of this land which renders it less valuable,I do have
questions about how to adjust the taxes with which I have been paying on this piece of property.
I appreciate your time and consideration of this request and trust that I will have an oppor[unity
to present my conditional use request at your next meeting. I look forwazd to hearing from you at

Cindy and I had a meeting with TJ yesterday afternoon about the Committee's action concerning the A&L
Investments request for mainland lot use for access to four inland lots. It is TJ's opinion, that based on the motion
to deny, the second and the failure to obtain a majority vote on the motion, that the A&L Investments request for
the conditional use was "denied." We will inform the applicant of TJ's opinion. We will also inform Bruce, Don
and John.
TJ suggested that, in order to prevent this situation from happening in the future, that at least one alternate
member be appointed to the Zoning Committee. We probably all agree that an applicant deserves a conclusive
"approval" or "denial" on a request. Not a decision based on a split vote. I'll leave this decision up to you.
The good news is that there will not be any zoning issues before the March 2004 meeting of the County Board.

Re:Garbutt Island lots and mainland access
Dear Mr.Johnston;
This letter is a follow up of our phone conversation we had yesterday with regards to the
Garbutt Island and the mainland access's to it.
According to our records, in November of 1997 a Conditional Use application was
approved by the Zoning Committee for mainland access for is(and development. This
access was lot 2 of Certified Survey Map Volume 12 page 217.
Our records also indicate that in February of 1999,a Rezone application was approved for
the rezoning of the island from Forestry One to ResidentiaVRecreational One. The
purpose of the request was to return to the zone district that existed prior to the
comprehensive rezone change. A Conditional Use application was also granted at that
hearing for another mainland access,which was lot 5 of Certified Survey Map in Volume
10 page 77. With the two mainland access's approved, it allowed you to develop four
island tots.
In our discussion, you asked whether or not lot 2 could be divided into two sepazate
parcels,which would allow two additional island lots.However,it was determined that lot
2 does not have sufficient width to allow the division and therefore a variance would need
to be granted. This particular variance application would be heard by the Sawyer County
Zoning Corrunittee due to the deviation of Sawyer County Zoning Ordinance of Sections
4.413(1) and Section 4.413(2) of Islaod Development; Section 4.417 of Lake Class
Development Standards and Section l 8.3 of the Dimensional Requirements. Keep in mind
that if a variance is granted, it's only for the division of the lot and a Conditional Use
application must also be obtained which would require another public hearing per Section
4.413(4)of the ordinance. I have also included an application for Conditional Use which
will require a check in the amount of $100.00. This application could be heard in
conjunction with the variance at the same Public Hearing.

As I understand it, you aze requesting to apply for a variance for either the division of lot
2 or to use lot 2 as it eatists for 1-2 additional lots on the island.
Should you choose to apply for a variance to use lot 2 as it eacists for 1-2 additional lots on
the island, the Sawyer County Board of Appeals would heaz that variance application due
to the deviation of Section 4.413 of the ordinance. Please keep in mind that the Boazd of
Appeals has specific criteria for granting/denying variances. The granting of variances is
based on hardship and reaso�able use of the property.
I am enclosing two sepazate vaziance applications and a Conditionai Use application, as
well as copies of those sections of the ordinance in which the above pertain to. Each
application has different requests for the variance. Please review, sign and send back to
this office the application that best suits your needs along with a check in the amount of
$250.00 made payable to Sawyer County 'Loning. Once received, I will then place you on
the February docket for Public Hearing provided it reaches us no later than January 2,
2004.
