Susan Miley has copy of easement. There is no access issue. Reads into record from Vol 807 Page
621, description of easement, item 2L Also reads Section 8 of covenants. Nelson: State plat review
not concerned with DNR issues and wetlands. Bodenschatz speaks on master declaration of PUD re-
corded in Vol 818 Page 169. TJ suggests a brief recess while ZC reviews these documents. Matt Van-
delac, Big Fish Golf, says road does not need to go through Lot 25 to access other lots.
KM motions to recess for 20 minutes for attorneys to review documents.

TJ: The PUD document was created after the public hearing to create the PUD. This document is for
the owners of the property. The owners have to enforce it among themselves. Attorney for Boden-
schatz believes access is an issue. Approaches and points out lot lines and the ending of access. The
access is restricted to golf course use, it can't be used for roads or lots. Discussion of possibly placing
the recorded Vol and page of easement on the plat near the cul-de-sac. WAC recommends approval
with conditions which AM puts into motion.
AM motions to approve with the condition that the road (outlot 1) be extended to the east lot
line and to include the volume and page of the instrument to show easement to H�vy. K.

4) Ag fences — Discussion for possible amendment. WAC to come up with a draft for ZC in May. Re-

5) Subdivision control ardinance—At a meeting earlier, surveyors provided comments. ZC members re-
ceived comments and draft previously. Wetland was an issue with surveyors. They're not qualified to
delineate. Also it's very costly. WAC and Mike Kemp draw sample situations on board. They want to
create an outlot from neighbor far purpose of garage in exchange with easement with the neighbor.
Discussion held on whether they need a sur��ey for remainder of property after outlot is created.
Neighbor also owns adjoining land. No survey required for the remainder. Kemp to have new CSM
done on his lot to include new outlot as being all one lot. Surveyor Dan Ploeger would like to see wet-
lands addressed in the ordinance. Hardship having to delineate the wetlands. ZC decides to move
forward to public hearing with proposed draft of Subdivision Ordinance. Also meet with Pleoger re-
garding the wording for the wetland issue.
6) Determining Land Use Permit fees — Clarify policy to charge for every building project, effective
Monday, Apri124, 2006.
7) Extension of conditional use permit#04-016, James Giewedik—Single family dwelling in A-l.

Lake no longer wants to create a special zone district for Northwoods Beach. Proposal is to request

Enclosed please find an application for a Conditional Use Public Hearing on the above
described property for the purpose of constructing a single family dwelling, not being
engaged in farming. If the property is not being used for farming activities (raising crops
or livestock or renting out fields for these purposes) a public hearing is necessary before
the permits can be issued to build a dwelling in the A-1 zone district.
The application and $200 public hearing fee are due Friday, April 7, 2006 in order to be
