Dear Mr. Treland;
This letter is reiterating the conversation between you, Mr. Brent Van Vonderen of
Hayward Evergreens, and myself at Pat's Landing yesterday. It can be considered an
addendum to your mitigation plan. The following were topics we discussed:
o Buffer areas will most likely be edged with field stone. This should
help to deter people from trampling new plantings. Before the plants
mature, it would be a good idea to temporarily fence the iiewly planted
buffer sites.
o A snowmobile trail of approximately eight feet in width will be used in
winter months next to the existing lodge building. This area was
originally designated as re-planted buffer for the 40' length. It will be
reduced to 32'.
o Pier pathways were anticipated to be four feet in width. The new plan
is for three foot pathways of filter fabric overlain with permeable
natural materials.
o Installation may be accomplished within the first year as opposed to
the schedule in the draft plan.
o Native plants will be used, however, some individual species will be
substituted due to availability.

Vonderen contact us for inspection once t11e project is complete. Also,please sign both
copies of the mitigation plan and return to my office. I will return after County
signatures.

On January 16, 2001, the Sawyer County Board of Appeals approved your variance on the fol-
lowing described real estate to wit:
Lot 1, Ogema Lake Shores Subdivision, S 36, T 40N, R 8W, Parcel —1.1.1. Vol
456 Records Page 32. The existing lot as now laid out is approximately
75'x172'/205' containing 0.35 acres. The proposed lot is approximately
92'/104'x261'/218' containing 0.54 acres. Property is zoned Residen-
tial/Recreational Two. Application is for the creation of a substandard sized lot
with an average lot width of 99.5 feet and the construction of a replacement
dwelling on said lot. Variance is requested as Section 4.416, Sawyer County
Zoning Ordinance, would require a minimum lot width of 100 feet on Chief Lake,
a Class #1 lake. Town Board has approved the application. This application was
tabled at the November 28, 200 public hearing.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. It would be due to spe-
cial conditions unique to the property.

ln 2001-2002,we tore down 3 existing older cabins and replaced them with
3 brand new units. After completing these new units and after 2 seasons of
rental,65%of our annual receipts came from these new units.
We are going into our 40`h year of business and we realize to stay afloat,we
have to replace old buildings with new. With the value of real estate,we
have to maximize the number of units using the shoreline.
With the new zoning regulations,we decided to undertake a huge
commitment to our future. We plan to tear down 11 existing buildings and
replace them with one 16 unit multi-family building. Each unit will have a
handicap accessible bathroom and bedroom,kitchen,dining area and living
room on the first floor. The second floor will have two different floor plans.
One with 2 bedrooms and 2 baths,the other with lbedroom, lbath and a
sitting room. There will be a deck on grade on the lake side of each unit.
All units will have new septics and all parking will be to the non-lakeside.
This is what our clientele is looking for in their family vacations. Presently,
we have a waiting list for our new units and want to stay competitive to
serve the needs of our clientele.
In doing this upgade,it will enable us to continue as a family resort for
future generations.

Purpose: This plan will meet the requirements of Sawyer County Zoning Ordinance
4.410 "Shoreline Vegetation Protection Area". It is important to note that 4.410(3)
specifically allows for resorts to combine use corridors in any manner, but not to exceed
30% of the entire frontage. Most of the requirements of Wisconsin Department of
Natural Resources Administrative Rule NR115(3)(c) "The cutting of trees and shrubbery
shall be regulated to protect natural beauty, control erosion and reduce the flow of
effluents, sediments and nutrients from the shoreland area" will also be met.
Upon signature from the Landowner and Zoning Committee representative, this plan
shall fulfill all mitigation requirements necessary for issuance of a Land Use Permit.

This area is currently hard packed sod. Treatment should include: Chemical or
physical (black plastic for 4-6 weeks) eradication of sod. The area should then be
mulched 5-7 stems thick with bark, excelsior, or weed free straw. Plant plugs
should be spaced in a 1.5 foot by LS foot grid. Maintenance of the plantings will
be included in a separate plan. It is recommended to rope off this area to reduce
the probability of foot traffic. Since the soil is quite depleted here and the area
has full sun, prarie plants are most likely the best suited.

This site has a storm water permit for site "cheharlin". The permit was issued with the
understanding that he get the Erosion Control Plan and the Storm Water Management plan to
me by September 15, 2004 . I have not yet received it. I informed him that silt fence was
considered to be siltation control not erosion control. He needs to implement both erosion
control and siltation control on this site.
He also must implement a site design that adequately addresses post construction storm
water management for peak flow, pollutants and volume.

about it - some related to the building, scme related to the public landing. Harold has a
storm water permit from DNR, but does not have a 341 grading permit.
Harold was confused as he remembers the definition of 'bank' from our Feb. talks (75
feet) . I explained that the new grading rule went into effect toward the end of April .
The current definition of bank is 300 feet from a priority navigable waterway. Harold
will complete a grading permit application and submit it to us. I recommended that he
curl the silt fence near the boat landing and place silt fence around the single struct=ure
on the north side of the landing.
