WAC reads application into the record;presents tax listers map,zone district map,and wetland map. Twelve(12)letters were sent. 7 were retumed with no objection; I with comments only.Lehmann present Shows poster and fact sheet. Well, septiq and pontoon storage are issues. Winter Town Board has no problem,road ends 3 mile beyond his driveway. AG motions to approve the application as submitted with a 2 year time limit. LR seconds motion. Unanimons vote. Findings of Fact: It would not be a self-created hardship.There wou]d be no change in the use in the zone dishict.It would not be damaging to the rights of others or property values. NEW BUSINESS 1) Billy George Variance#04-031—Last month this was tabled so AG could consult Corp.Counsel.Had 6 months to comply with removal of roof and sidewalk.During 6 months roof was removed,sidewalk was not. George asked for sidewalk to remain. Corp. Counsel: It is within BOA's rights to order removal of sidewalk that is non-compliant. llrainage is still an issue. BOA discusses ADA.Dale Magnuson,contractor that poured the sidewalk:Mrs.George needs the sidewalk for access to kitchrn and laundry room.George will be getting verification of disability from doctor.Mrs.George says she needs solid surface for walking she wears special boots.Magnuson says prior to sidewalk there was a ditch that drained the water.If conerete is removed another ditch would need to be constructed.LN feels an independent person needs to determine what the drainage problem is and how to correct it. Doesdt feel these two parties can resolve it.Magnuson feels the sidewalk,if considered a structure,is an accessory suucture and therefore should be allowed 5' from property line. Ordinance doesn't address that specifically.Magnuso�shows location of drain tiles.Some are on the Olson property,he could remove them.Rick Olson,property owner to the east,issues are the sidewalk and drainage.Has four 4"plastic pipes placed on his land.Doesn't lmow what they're for or why,what purpose they serve.RZ asks Olson if he would be willing to allow Magnuson and George to go on his property to remove the plastic pipes and try to cosect the drainage.RZ:BOA will only address the remaining rivo items of violation,the drainage issue and removal of sidewalk.Drainage issue to be cortected and removal of sidewalk within 30 days.LN feels this is a civil matter and BOA shouldn't be involved. RZ:BOA decision will stand.AG's opinion:The Georges have 30 days(by Dea 15)to remove the sidewalk or they can appeal the BOA decision.Other members agree. 2) Thomas Johnson appeal date—BOA decides:Wednesday,January 25,2006,9AM,no locarion yet. 3) BOA 2006 schedule—change from Nov.21 to Nov.28. 4) Membership amendment—2 altemates for staggered 3-yr terms per WI Assembly Bill.By-laws to be changed to add this language. We then walked to the George property. The concern was Mr. George's compliance with the conditions established by the Sawyer County Board of Appeals at its January 18, 2005 public hearing. In particular the concerns were the "replat" of the existing east lot line and the restoration of the lot line area to its natural drainage. Mr. George will be contacting a surveyor (Richard Stowe?) to flag the east lot line and provide a plat showing the location of the home with respect to that lot line. This will determine how much of the building must be removed. This must be done by August 30, 2005. This may result in a part of an existing sidewalk having to be removed. Restaration of the shared lot line area to natural drainage was discussed. Mr. George proposed that a trench be dug to divert along the east side of his home towards the lake.
