On November 16, 2004, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Part of Govt Lot 3, S 25,and Part of Govt Lot 1, S 36, all in T 41N, R 8W, Parcels :3.1 &
:3.2 and :1.17. Document#324621. 1.09 acres. Property is zoned ResidentiaURecreational
One. Application is for the construction of a 20'x31' (22'x35' with eaves) single story
addition onto an existing dwelling at a setback distance of 40' to the ardinary high-water
mark of Round Lake. The existing dwelling is located as close as 24' to the ordinary
high-water mark of the lake. Variance is requested as Section 4.21(1)(a), Sawyer County
Zoning Ordinance, would require the prior approval of a variance for the expansion of a
dwelling, if any part of that dwelling is located less than 40' to the ordinary high-water
mark of navigable waters. Town Board has approved the application.
The Sawyer County Board of Appeals approved the application as follows: Removal of boat
house, no part closer than 40' to water, and a two-year time limit.
Findings of Fact and Conclusions of Law of the Board of Appeals: It would not be the basis of
economic gain or loss. It would not be a self-created hardship. There would be no change in the
use in the zone district. It would not be damaging to the rights of others or property values. It
would be due to special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-029.

We are requesting a variance to allow us to add a 20' addition to the back
side of our cottage at 12587 W. Moreland Road. The cottage is a recent
purchase. The existing cottage is 31' wide, thus the 20' extension would add
620 sq. ft. to the existing building. To support our request, we provide the
following:
1. We have fully cooperated with county zoning for inspection of the the
existing septic system. (system failed). Soil tests, state and county
applications have been approved to install a two bedroom mound
system. This mound system will be completed next spring.
(Attachment #1)
2. We contracted Heart of the North Survey to address the impervious
surface requirement. The survey shows the existing impervious
surface is 3,591 sq. ft. or 7.5°/o of the total area of 47,800 sq. ft. The
addition of 620 sq. ft. will bring the total surface to 4,211 sq. ft. or
8.8°/o of the total area. This is well within the 15% maximum
impervious surface requirement. (Attachment #2)
3. Attachment#3 is the inspection report completed by Mr. Christman in
July, 2004. We have shown the 31' x 20' addition in red. The eaves
overhang on the south side are currently at 39' from normal high
water mark. This setback will be increased to 40'by changing the
roof-line if the variance is approved. (Attachment #3)
4. Pictures showing the existing cottage and the proposed addition
outlined. (Attachment #4)

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the gzneral terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildin�s are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, Jodi Longtine; 634-4123 to obtain the time and confirm the date of the
Town Board meeting for your attendance or the attendance of your agent.

Dear Mr. Tyson:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance — Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
You should review the inspection report and application for correctness. If correct, sign
the application and return it to this office with a check in the amount of $250.00 made out
to the "Sawyer County Zoning Administration" by Friday, October 1, 2004 far hearings in
November 2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Hayward at 7:00 P.M., Tuesday, November 9, 2004. You
should contact Jodi Longtine, Town of Hayward Clerk, at (715) 634-4123 (Town Hall) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, November 16, 2004 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board(i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
