Dear Mr. and Mrs. Dobbertin and Mrs. and Mrs. Neiss,
On November 16, 2004, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Lot 1-C, being Part of the NE'/4 NE'/4, S 16, T 40N, R 7W, Parcel .1.6. Document
#317497. Approximately 125'/132'x338'/385' containing 1.04 acres. Property is zoned
Residential/Recreational One. Application is far an after-the-fact variance for the con-
struction of a replacement dwelling located 69' from the ordinary high water mark of the
Chippewa Flowage and on a lot that is substandard in size for both the replacement
dwelling and an already existing second dwelling. Variance is requested as Section
4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of
75' from the ordinary highwater mark of the Flowage and Section 4.417, 18.2, and 18.3
would require that each dwelling be located on its own minimum 100'x200' land area.
The Town Board has denied. This application was tabled at the October public hearing.
The Sawyer County Board of Appeals approved the application as follows: Removal of 6 feet or
closest point so that nothing is closer than 75' from the lake. Deck to be removed from 1979
cabin. One year to be compliant with 75' setback. Septic issues to be resolved with written letter
stating such.
Findings of Fact and Conclusions of Law of the Board of Appeals: Unnecessary hardship is pre-
sent since the property is unique with two buildings.
Land Use Permit is to reflect what has been constructed/remodeled on the property to show size
and location of structures in their present state. Fee will be the difference between that amount
already paid ($75) and the amount far new construction at the existing size ($275), for a total of
$200.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-027.

Dear Mr. and Mrs. Dobbertin:
This letter is in response to the Sawyer County Zoning Board decision concerning your property located
at 11003W Arrow Road in the Town of Hunter.
- 4n Thursday, October 14, 2004, I inspected your property with Mert Maki frorirfhe Sawyer County
Zoning Office. Based on our map and rough measurements, it appeared that the North-South property line
on the east edge of the property ran through the existing septic drainfield, and possibly a portion of the
wooden deck on the east side of the house. At that time I indicated to the zoning board that an accurate
survey would be needed to confirm this, but the committee/board may wish to consider this possible
encroachment issue when ruling on the variance request.
Since that time you have removed the deck from the house and the remaining septic field remains buried
in an inconspicuous manner. The Department of Natural Resources will not require you to take further
action at this time. However, at such time as the existing septic system fails and requires replacement or
the property ownership is transferred to another party we will require that the septic system be relocated
so as to be in compliance with Sawyer County zoning.ordinances.
If you transfer ownership of your property to another party you are required to disclose this information
prior to transfer.

Re: Additional comments on Variance Application 04-027 - Dobbertin/Neiss property
It was recently brought to my attention that the septic system for the Robert and Donna Dobbertin and
Randolph and Cathy Neiss property on Arrow Road may be encroaching onto adjacent State of Wisconsin
DNR property.
On Thursday, October 14, 2004, I inspected the property with Mert Maki from the Sawyer County Zoning
Office. Based on our map and rough measurements, it would indeed appear that the North-South property
line on the east edge of the Dobbertins runs through the existing septic drainfield. Mr. Maki indicated
that the drainfield could be moved to bring it within the property boundary, but quite possibly a small
corner of the deck of the older house on the property may also be located across the property line on DNR
property.
An accurate survey would be needed to confirm this, but the committee/board may wish to consider this
possible encroachment issue when ruling on the variance request.

To qualify for your requested variance, you must demonstrate that your property meets � .�E�

1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1)Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the public interests.

3) Unnecessary Hardship. � res-�-o r,vwJ -{-�� � ovv� .
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an"area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner from using the property for a permitted
purpose or would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

Dear Members of the Sawyer County Board of Appeals:
We feel it is of the utmost importance for us to address the letters written by adjacent property
owners that were received by your office regarding the "After-the-facY' variance application 04-027. T'he
letter put forth by the Zoning office legally stated the issues at hand. However, we believe the part-time
residents or absent landowners who are basing their decision solely on this letter do not clearly understand
what they are objecting to. Even though the variance is asking for an "After-the-fact" decision, the letter can
be interpreted as if we are asking to replace one of the dwellings (too close to the water) and haven't yet
begun to build. It aiso doesdt address the fact that there was a permit issued to build the addition, which is
already in place, and that the conflict here is a result of unforeseen circumstances in the construction stage.
One objection in particular came from a landowner that has not been around since the early eighties.
We would like to address some of the comments in the objection letters. First of all, we would like
to thank the neighbors who had no objection. They asked direct questions, were on the job site and
understand the depth of the variance request. There are several items that have come up that have absolutely
NO Bearing on this variance. They are inappropriate comments and can be addressed in other ways.
However it does seem that some of the objections were based specifically on these non-related items.
■ "Not following the rules" IS NOT an issue. The project was "started properly" with visits to the
Zoning office, a blueprint drawn up to meet their specifications and regulations, and a valid permit
was ganted. (Guppy, Toczek, J. Kurtweil, Benda)
■ Renting is not an issue. Our being allowed to keep the dwellings we purchased and improved
should not be objected to because they are concerned about our intended use of them. In fact,
renting has taken place with the Benda's next door neighbor for many years. (Benda, Schneider)
■ We do not have any intention of running a "Marina': The dock has been repaired and made safe.
The Humann's pontoon boat and fishing boat are now parked here in season, relieving the boat
congestion and foot traffic in the deeded easement area where they share ownership of a dock near
the other houses. (Penkala)
■ We do not even understand why the comment "no plumbing should be installed in the garage"
was made and how it has any bearing on this hearing. (J. Kurtzweil)
■ The cost of this project has no bearing on this variance hearing; the size of the project is acceptable
and follows Zoning regulations. (Benda)
■ "Two homes on such a small lot would ereate congestion in the area': The two dwellings on this
property as they stand today would not look any different if the three walls in question had remained
intact. The house would still be the same size (approved by Zoning). T'here were two dwellings on
this properiy when the next door neighbors decided to make their home a permanent residence;
knowing the zoning rules as well as they do, they would know that we had the same rights to
improve our property as they did. (Schneider)
Addressing other comments in these letters regarding the variance, it is ow understanding that
variances are decided on an individual basis, based on individual circumstances. If all future variances
were approved on the decision of one variance outcome there would be no need for individual hearings
ar an Appeals Board. We understand this concern of the property owners, but they need to trust the
knowledge and decision making of this board.
■ The suggestion of "three dwellings being upproved on a 125' wide lot and dwellings creeping
closer to the water" because this variance might be approved is clearly a misunderstanding of our
intentions. (Guppy)
■ It is insinuated that we assumed we would "easily get a variance passed"and therefore continued
our project.At the time we started this project all materials ordered were to complete the addition
project as allowed in our valid land-use permit The shingles were already being installed when
Zoning appeared onsite. The special-order windows and metal work were then installed as to not
jeopardize the building to any rotting and deterioration as we were told the variance could be a
lengthy process. We then returned all materials that carried the project beyond this point.(Dorazio)
■ Although one of the owners is a construction contractor,this variance request is a result of
unforeseen rotting,mildew,and deterioration over which we had no control and not being able to
use the walls was totally unanticipated. These comments by the adjacent landowners are made
without knowing what actually occurred from the very beginning or having any first-hand
information.(Dorazio)
■ "Applicant could have met the setback distance". Yes,that was possible if we had purchased the
property to tear everything dowri and start over,however the property was purchased jointly by two
families because it already had two dwellings.The addition was permitted by Zoning.(DNR)
■ We appreciate all the knowledge our neighbars have gained through their personal building
experiences. We,too,have learned many lessons from this experience. It is our first experience
building that involved zoning as well. "The after-the fact variance could have been avoided if the
owners stopped construction and had the Board inspect the walls in question";the fact is that there
would still have been the need for a variance hearing regardless at that point. Most of the addition
was already erected by then as the construction crew was waiting for the completion of repairs and
two additional rows of block to the old foundation(weather played a big part in that delay).Once
that work was done we then had to wait for backfilling,and construct a floor deck before the walls
in question were safe to work on. (Schneider,J. Kurtzweil)
■ "Not seeking the opinion of the Board"at that point of discovering the impossibility of re-using the
walls due to rotting and mold does not make this circumstance self-created.At this point we felt
building codes were of the utmost importance to follow and we had a responsibility to our families
and future owners of the property to build a safe and healthy home.Calling the Zoning office didn't
even occur to us.(Schneider)
■ It is unnecessarily burdensome for us to move back the dwelling in question and to dispose of the
other dwelling. There are three(3)very large trees that would need to come down,more excavating,
a new foundation,a chimney foundation to tear-out and build further back,removal of old
foundation and footings,a new permit to account for probable changes,and the hiring of a
professional moving company to safely move the building back 6 feet.This doesn't even touch the
loss of the initial investment of a property purchased with two existing homes with our life's
savings. It is not feasible for 12 or more people to share one home of this size for lengths of time on
end. We are families of teachers and our vacation times and schedules are very similar. The two
families plan to use both homes for many years to come,but now could have the burden of always
sharing one dwelling,splitting time,and taking away the option for impromptu trips up north.The
possibilities and strain of this type of ownership presents hardships on friendships and families.

■ The natural beauty of t6e shoreline is being preserved on this property.The 35'buffer zone is
being established and we aze in compliance with all these regulations.The building in question is
barely visible from the lake due to the density of the pines.The water run-off from the roof has been
improved since the roofline was moved a foot further back than before. The water now sheds to the
sides of the home instead of offthe front toward the lake. (Schneider)
We appreciate the time the Board has taken to review the matters concerning this variance. We
realize that the final decision is in your hands and we regret that many of these objections were made on
our behalf with limited knowledge and unrelated issues.We arixiously await the results of the upcoming
meeting.

tabled the following application:
Lot 1-C, being Part of the NE1/4 NE'/4, S 16, T 40N, R 7W, Parcel .1.6. Document
#317497. Approximately 125'/132'x338'/385' containing 1.04 acres. Property is
zoned Residential/Recreational One. Application is for an after-the-fact variance
for the construction of a replacement dwelling located 69' from the ordinary high
water mark of the Chippewa Flowage and on a lot that is substandard in size for
both the replacement dwelling and an already existing second dwelling. Variance
is requested as Section 4.49(1), Sawyer County Zoning Ordinance, would require
a minimum setback distance of 75' from the ordinary highwater mark of the
Flowage and Section 4.417, 18.2, and 18.3 would require that each dwelling be
located on its own minimum 100'x200' land area. The Town Board has denied.
The application was tabled for the November 21, 2004 public hearing.

Dear Mr. Dobbertin:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance — Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation ineets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of $250.00 made out to the "Sawyer
County Zoning Administration" by Friday, September 3, 2004 for hearings in October
2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Hunter at 6:30 P.M., Wednesday, October 13, 2004. You

The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
