Dear Mrs. Lawry,
On October 19, 2004, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:
Part of Govt Lot 4, S 36, T 41N, R 8W, Parcel :4.15. Vol 595 Records Page 71, Docu-
ment #322337. .38 acres. Property is zoned Residential/Recreational One. Application is
far the construction of a 15'x36' (17'9"x41'6"with eaves) cooler, freezer and storage ad-
dition onto an existing bar/restaurant located less than 40' from the ordinary high water
mark of Round Lake, with the addition being at setback distances of 11' to a rear lot line
and 11' to the centerline of an access roadway. Variance is requested as Section 4.21(1),
Sawyer County Zoning Ordinance, would require that the expansion of any principal
structure, any portion of which is less than 40' from the ordinary high water mark, be by
variance only; Section 184. would require a minimum setback distance of 40' to the rear
lot line and Section 4.21(6) would require a minimum setback distance of 30' to the cen-
terline of the access roadway. The Town Board has approved the application.
The Sawyer County Board of Appeals approved the application as follows: Allow separate build-
in,g not to exceed 15'x32'; one year time limit.
Findings of Fact and Conclusions of Law of the Board of Appeals: Hardship is present because
of physical limitations of the property. It is not contrary to the public interest. There would be no
increase of impervious surface. It would not be the convenience of the owner. It would not be the
basis of economic gain or loss. There would be no change in the use in the zone district.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiarari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-026.

reasons that you rejected them.

House is too close to the side lot lines and the lake." ,
2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and(6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests
or how it may even enhance the ublic interests.
', tid ►o ,` u.

3) UnnecessaryHardship.
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior oner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, ar height. For an
area variance, unnecessary hardship exists when compliance would
unreasonably_prevent the owner from usinthe propertv for a permitted
purpose or would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.
Is unnecessary hardship present?
 Yes. Describe. Gldd t'r' Z I^ fd 1 E V' 7r1 Le:
❑ No. A variance cannot be granted.
b) Alternatives you considered that require a lesser variance and reasons
you rejected them.
(e.g., "Addition is the minimum size that is required.").

r
Describe the imact on yourroperty and adiacent properties if the variance is granted.
(e.g., "Erosion during construction—will be controlled with silt fencing.
After construction there will be a greater impervious surface area.
Gutters and downspouts will be used to divert water away from other properties
and the lake. Shoreline buffer zone will be planted with native vegetation, trees
and shrubs."). 5 hc'G Iµ tG rti;t
Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the "three-step test."
1) Unique Property Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?
Yes. Where are they located on your property? Please show the
oundaries of these features on the site map that you used to describe
alternatives considered. ,r'r^C w''1 jjyjo'
(e.g., "There is a wetland area that extends around oneide of the house
and also behind the house.").
❑ No. A variance cannot be granted.

CONCLUSIONS OF LAW
Based on the above findings of fact the Board concludes that the variance does/does not
meet all three of the following tests:
A. Unnecessary hardshi is 's not present since strict application of the terms of the
zoning ordinance wou /would not render conformity with such restrictions
unnecessarily burdensome: _t?'`
_ .
  l ,z •
B. The hardshi is is not due to physical limitations of the property rather than the
circumstances of the applicant because:
C. The variance wil will no be contrary to the public interest and wilUwill not observe
the purpose of the or inance and do justice because:

Re: Part of Godt lot 4, S 36, T 41N, R 8W; Parcel :4.15
Dear Deanne;
Your appGcation for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Boazd of Appeals on
October 19, 2004
This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appeaz may result in the denial of the application.
ff it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financialloss or gain does not constitute a zoning hazdship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, Jodi Longtine; 634-4123 to obtain the time and confirm the date of the Town
Boazd meeting for your attendance or the attendance of your agent.

Re: Parcel :4.15, S 36, T 41N, R 08W: Application far Variance
Dear Ms. Lawry:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance — Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a completed
• "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of $250.00 made out to the "Sawyer
County Zoning Administration" by Friday, September 3, 2004 for hearings in October
2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Hayward at 7:00 P.M., Tuesday, October 12, 2004. You
should contact Jodi Longtine, Town of Hayward Clerk, at (715) 634-4123 (Town Hall) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 19, 2004 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hayward is advisory only.
, ,
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to
4:00 P.M., Monday through Friday.
Yours truly,
