Dear Mr. Getzelman,
On October 19, 2004, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:

Document #320879. 60'x100' containing .138 acres, approximately 6,011.28 sq ft. Prop-
erty is zoned Residential/Recreational Two. Application is for the construction of a
12'x12' (14'x16' with eaves) enclosed addition and a 12'x12' open deck onto an existing
dwelling all at setback distances of 23' to an adjacent side lot line and 41'6"to the center-
line of Evergreen Avenue, a town road. Variance is requested as Section 4.21(3), Sawyer
County Zoning Ordinance, would require a minimum setback distance of 63' to the cen-
terline of the road, and Section 18.4 would requrie a minimum setback distance of 30' to
the side lot line. The Town Board has approved the application.
The Sawyer County Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. It would be due to spe-
cial conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within

To qualify for your requested variance, you mus demonstrate that your property meets
the following three requirements. Tliis is known as tlie "tlaree-step test."
1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant(growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations,prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.

3) Unneces a y ardship. �
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner from using the propert fY or a permitted
purpose or would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main

Dear Mr. Getzelman:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
� Application for Variance — Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of $250.00 made out to the "Sawyer
County Zoning Administration" by Friday, September 3, 2004 for hearings in October
2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Bass Lake at 6:30 P.M., Monday, October 1 l, 2004. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town
Hall) to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 19, 2004, in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance,the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore,you should consider using any means at your disposal(i.e.,
photographs,dxawings,a good verbal presentation,etc.)as you present the facts to the
Board.
Mr.Getzelman,you submitted an estimated cost of construction(materials$16,097.56
andlabor$1500.00)of$17,097.56. Your calculation was$31,097.56 total cost,but I
assume that you misread the$1500 as$15,000. The assessed value of the dwelling is
$19,600 which results in a current estimated fair market value(CEFMV)of$25,100 and
a 50%CEFMV of$12,550. Therefore,the project costs will exceed 50%CEFMV of the
dwelling.
