Dear Mr. and Mrs. Senne,
On November 16, 2004, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Lot 1, being Part of Govt Lot 7, S 34, T 40N, R 9W, Parcel :7.4. Vol 755 Records Page
440; CSM Vol 16 Page 25. 166'/29Tx250'/256' containing 1 .34 acres. Property is zoned
Residential/Recreational Two. Application is for the construction of a 24'x34' ground
level combined garage and living area addition and the construction of a 24'x34' (26'x35'
with eaves) 2°d story addition above the proposed ground level addition all onto an exist-
ing dwelling and all at setback distances of 37' to a wetland area, 44' to Durphee Lake
and resulting in a total dwelling footprint area of 1812 sq ft. Variance is requested as Sec-
tion 4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback dis-
tance of 40' to the wetland area and Section 4.42(1)(b) would require that the additions be
on the landward side of the dwelling but not closer than 75' to the lake and that the total
dwelling footprint not exceed 1500 sq ft. The Town Board has approved the application.
This application was tabled at the September 21, 2004 hearing.
The Sawyer County Board of Appeals approved the application as follows: Allow basement, re-
move 3-season porch, reduce size of deck so no closer than 40', and two-story garage on back
staying within 1500 sq ft, with a two-year completion date.
Findings of Fact and Conclusions of Law of the Board of Appeals: Unnecessary hardship is pre-
sent due to the uniqueness of the property. It is not a self-created hardship. It would not be the
convenience of the owner. It would not be the basis of economic gain or loss. It is not contrary to
the public interest. There would be no change in the use in the zone district.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, ar in applying far permits, please
refer to Variance 04-019.

Tovn's annroval is onlv if the followine limitations are made. 1) Size of addition
limited to a total footprint not to exceed 1500 sq. ft. 2) Addition to be 40 feet or
greater from the vetland. By alloving 1500 sq. ft. this requirement can be met.
The Variance would not be contrary to the public interest and would be in compliance
with the spirit and intent of the Zoning Ordinance and the Town of Bass Lake's
Comprehensive Plan (Section 8.10) .

Part 2: Three-Step Te�t. �
To qualify for your requested vaziance, you must demonstrate that your property meets
the following three requirements. This is known as the `Yhree-sfep test."
1) Unictue Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that aze not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant(growing family,
need for a lazger gazage etc.) aze not a factor in deciding variances. Neazby
ordinance violations, prior vaziances or lack of objections from neighbors or

166'/297'x250'/256' containing 1 .34 acres. Property is zoned
Residential/Recreational Two. Application is for the construction of a 24'x34'
ground level combined garage and living area addition and the construction of a
24'x34' (26' 10"x35' with eaves) 2°d story addition above the proposed ground
level addition all onto an existing dwelling and all at setback distances of 37' to a
wetland area, 44' to Durphee Lake and resulting in a total dwelling footprint area
of 1812 sq ft. Variance is requested as Section 4.49(1), Sawyer County Zoning
Ordinance, would require a minimum setback distance of 40' to the wetland area
and Section 4.42(1)(b) would require that the additions be on the landward side of
the dwelling but not closer than 75 ' to the lake and that the total dwelling
footprint not exceed 1500 sq ft. The Town Board has approved the application.
The application was tabled for the November 16, 2004 public hearing.

Application for Variance
Dear Mr. Senne:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance — Additional Information,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of $250.00 made out to the "Sawyer
County Zoning Administration" by Friday, July 2, 2004 for hearings in August 2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Bass Lake at 6:30 P.M., Monday, August 9, 2004. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town
Hall) to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, August 17, 2004, in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
