On September 21, 2004, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Lots 9&10 and 11&12, Block 13, lst Addition, Abendpost Beach Subd , S 31, T
40N, R 8W, Parcels -13. 13.9&10 and -13.13. 11&12. Vol 594 Records Page 205.
Approximately 100'x120' containing .276 acres. Property is zoned Residen-
tial/Recreational One. Application is for the construction of an irregularly shaped
732 sq ft single story addition with full basement onto an existing dwelling con-
taining 504 sq ft, also with existing full basement, at a setback of 2' to a rear lot
line, construction costs exceeding 50% of the current estimated fair market value
of the existing dwelling and all on a substandard parcel containing .276 acres.
Variance is requested as Section 2.0(2), Sawyer County Zoning Ordinance, would
require that a minimum of 75% of the existing dwelling's exterior wall area re-
main as exterior walls, Section 10.2 would restrict the cost of construction to less
than 50% of the current estimated fair market value, Section 4.49(6) would re-
quire a minimum rear lot line setback of 10 ft and Section 4.25 would require a
minimum parcel area of 20,000 sq ft. The Town Board has denied the application.
The Sawyer County Board of Appeals approved the application as follows: Allow 46'x28' foot-
print (addition of 28'x28' without eaves) and basement. Deck to be removed. 3 of 4 walls to re-
main untouched. Allow exceeding 50% and construction on lot size of 12,165 sq ft, rear lot line
setback of 14'. Expiration date of 2 years.
Findings of Fact of the Board of Appeals: There would be no changes in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values. Conclusions of Law:
Hardship is present because the size of the lots is pre-determined. The hardship is due to physical
limitations because of the size of the lot and there is no additional land to add. The variance will
not be contrary to the public interest and will do justice by allowing full use of the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-018.

Expiration of permit. Any privilege granted by this decision must be exercised within
months of the date of this decision after obtaining the necessary zoning,building
and other permits for the proposed construction. This period will be extended if this
decision is stayed by the order of any court or operation of law.
Revocation. This order may be revoked by the Board after notice and opportunity to be
heard for violation of any of the conditions imposed.
Appeals. This decision may be appealed by a person aggrieved by this decision or by any
officer,department,board or bureau of the municipality by filing an action in the circuit
court for this county within 30 days afrer the date of filing of this decision. Sawyer
County assumes no liability for and makes no warranty as to reliance on this decision if
construction is commenced prior to the expiration of this 30-day period.

Part 2: Three-Step Test.
To qualify for your requested vaziance, you must demonstrate that your property meets
the following three requirements. This is known as the `Yhree-step test."
1) Unique Pronertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shazed by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger gazage etc.) are not a factor in deciding variances. Neazby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Boazd do not provide a basis for granting a vaziance.

2) No Harm to Public Interests.
A variance may not be granted which results in hann to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some,but not necessarily all of these
considerations are: (1) Public health, safety and welfaze, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this variance would not harm the public interests

3) Unnecessary Hardshin.
An applicant may not claim hardship because of conditions which aze self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then azguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hudship does not
justify a variance. When determining whether unnecessazy hardship exists,
the property as a whole is considered rather than just a portion of the pazcel.
You are applying for an"area variance.' An area variance relaxes a
dimensional standazd such as a setback, frontage, lot azea, or height. For an
area vaziance, unnecessary hardshin exists when compliance would
unreasonablv prevent the owner from usinQ the nropertv for a permitted
purnose or would render conformitv with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact

One of the questions that the Boazd may ask you is if you have attempted to purchase
additional property from adjacent property owners. We discussed your mother's
property,but this does not seem feasible as her property is already substandazd in size.
The property to the west (lots 6-8) is also substandard in size (0.207 acres) and it also
does not seem practical for the owners to sell any of their property to you. The owner of
lots 6-8 is Bruce J. Frederick, 1725 Dublin Trail,Neenah, WI 54956
