Purchased 4 years ago. Needs more space. Roofline would be the same as existing. Complies with 75'
setback from lake. Not seen from lake. Small ponds would be the encroachment. This approach has
least impact. KZ was on site. Found it difficult to imagine driving into the garage and backing out of
it with the present slope. DiGiorgio states that part of garage will be storage, not used for vehicle. No
problem with impervious surface. Height of proposed roof will not exceed current roof. Gutters are
used. Landscaping will be done on west side of home. Silt fence will be used to protect both ponds.
AG motions to approve as presented with a 2 year limit.

Findings of Fact: There would be no change in the use in the zone district. It would not be damaging
to the rights of others or property values. "I'he plan indicates he will adhere to sound water
management practices to protect the ponds that are on the property.

1.13 acres total. Property is zoned Residential One. Application is for the construction of a 16'x26'
addition with basement at a setback distance of 57' from the ordinary high water mark of Barber
Lake. The total footprint of existing dwelling and addition will be 1,612 square feet. Variance is
requested as Section 4.421(3), Sawyer County Zoning Ordinance, would require the addition to be
75' from the ordinary high�vater mark of the lake and Section 4.421(4) would limit the total footprint
of the existing structure and addition to not exceed 1,500 square feet. The Town Board has approved.
WAC reads application into the record; presents tax listers map, zone district map, and wetland map.
Eleven (11) letters were sent. 6 were returned with no objection; 1 with objection.Torgerson present.
Requests addition onto home. To be 416 sq ft. Present home is 800 sq ft, crowded when kids come

We would like to remind you that your variance approval #04-017 for the construction of
a garage with reduced road setbacks on the above-described property expires on
September 21, 2007.
Please complete and submit the enclosed application for permit as soon as possible. The
application for use should include a drawing of the layout including dimensions and
setbacks. Impervious surface amount should be calculated as well
If applications are not returned by September 21, 2007, it will be necessary to go through
the public hearing process again. The Sawyer County Zoning Office can issue citations,
including fines, if you construct without the proper permits. If circumstances require you
to ask for an extension, please contact the zoning office before the expiration date to
arrange a conference with the Board of Appeals. If you have decided not to proceed with

Part 2: Three-Step Test. N/1rzi���u�-;r�i t,
To qualify for your requested vaziance, you must demonstrate that your property meets
the following three requirements. This is known as the `Yhree-step test."
1) Unique Pronertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that aze not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a lazger garage etc.) aze not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a vaziance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?

2) No Harm to Public Interests.
A variance may not be granted which resu]ts in harm to public interests. In
applying this test, the Boazd of Appeals must consider impacts of your
proposal and the cumulative impacts of similaz projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this vaziance would not hazm the public interests
or how it may even enhance the public interests.

3) Unnecessary Hardship.
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then azguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hazdship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the pazcel.
You are applying for an"azea variance.' An azea variance relaxes a

On August 17, 2004, the Sawyer County Board of Appeals postponed at your request your ap-
plication for variance on the following described real estate to wit:
Lot 1, being Part of the SW 1/4 SE '/4 , S 24, T 41N, R 6W, Parcel .15.4. Document
#31394; CSM Vol 24 Page 294. 1.25 acres. Property is zoned Residential/Recreational
One. Application is for the construction of a 24'x30' detached garage (28'x32' with
eaves) at a setback distance of 10' from the centerline of a private access easement. Vari-
ance is requested as Section 4.21(3), Sawyer County Zoning Ordinance, would require a
setback distance of 30' from the centerlinc of this easement. The Town Board has ap-
proved the application.
The Sawyer County Board of Appeals has postponed the application for the September 21, 2004
hearing.
