centerline of Chippewa Trail (a town road). Variance is requested as Section 4.49(1),
Sawyer County Zoning Ordinance, would require a minimum setback distance of 75'
from the ardinary high water mark of the lake and Section 4.21(3) would require a mini-
mum setback distance of 63' from the centerline of the town road. The Town Board has
approved the application.
The Sawyer County Board of Appeals approved the application with a 2 year time limit on com-
pletion.

On April 16, 1996, the Sawyer County Board of Appeals approved your application
for a variance on the following described real estate to wit:
Part NE} of the SW} S 26, T 41N, R 9W. Parcels .9.3 and .14.21.
QCD Vol 288 Records Pg 83. Parcel size contains 10,870 square feet
or .25 acres. Property is zoned Residential/Recreational One.
Application was for the razing of an existing dwelling and
construction of a 28' x 48' new dwelling at a waterline setback of
56 feet from the normal highwater mark of Lake Hayward and at a road
setback of 52 feet from the centerline of Chippewa Trail on a parcel
containing 10,870 square feet. Variance was requested as Section
4.49 (1) , Sawyer County Zoning Ordinance requires a waterline
setback of 75 feet from the normal highwater mark of the lake;
Section 4.21 (4) requires a road setback of 63 feet from the
centerline of a town road; and Section 18.2 requires a minimum
parcel size of 20,000 square feet. Town Board denied. City
Council, City of Hayward, denied.
The Board of Appeals approved the application as submitted.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship.
There would be no change in the use in the zone district. It would not be

Part 2: Three-Step Test.
To qualify for your requested vaziance, you must demonstrate that your property meets
the following three requirements. This is known as the `Yhree-step test."
1) Unique Proaertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requixements. The circumstances of an applicant (growing family,
need for a larger garage etc.) aze not a factor in deciding variances. Neazby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Boazd do not provide a basis for granting a vaziance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?

2) No Harm to Public Interests.
A variance may not be granted which results in hann to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessacily all of these
considerations are: (1) Public health, safety and welfaze, (2) water quality, (3)
fish and wildlife habitat, (4)natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.
Explain how the granting of this vaziance would not harm the,public interests

3) Unnecessazv Haidship.
An applicant may not claim hardship because of conditions which aze self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hazdship does not
justify a variance. When determining whether unnecessazy hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an"azea variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot azea, or height. For an
azea variance, unnecessary hardship exists when comnliance would
unreasonabi�prevent the owner from usinQ the pronertv for a permitted
purnose or would render conformity with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

CONCLUSIONS OF LAW
Based on the above findings of fact the Board concludes that the variance does/does not
meet all three of the following tests:

zoning ordinance would/would not render conformity with such restrictions
unnecessarily burdensome:

ORDER AND DETERMINATION

and other permits for the proposed construction. This period will be extended if this
decision is stayed by the order of any court or operation of law.
Revocation. This order may be revoked by the Board after notice and opportunity to be

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This statement
should include a description of the general terrain; surrounding development; your
proposed intentions; and the purpose of the request. Photographs of the property and/or
buildings are requested. Explain the undue zoning hardship inflicted upon the owner by
conforming to the required minimum regulation, which induced the variance request.
Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact
the Town Clerk, Jodi Longtine, PO Box 13260, Hayward WI 54843, 715/634-4123, to
obtain the time and confirm the date of the Town Board meeting for your attendance or the
attendance of your agent. Since the property is within 1 %z miles of the City of Hayward,

Dear Mr. Johnson:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance—Additional Information,
• Board of Appeals Conclusions of Law Form(This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
You should review the inspection report and application for correctness. If correct, sign
the application and return it to this office with a check in the amount of$250.00 made out
to the"Sawyer County Zoning Administration"by Friday, July 2, 2004 for hearings in
August 2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The"Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Hayward at 7:00 P.M., Tuesday, August 10, 2004. You
should contact Jodi Longtine, Town of Hayward Clerk, at (715) 634-4123 (Town Hall) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, August 17, 2004 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hayward is advisory only.
It is your responsibility to convince the Board of Appeals to grant�the var�iance that has
been reqiiested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
