Notice is hereby given that on December 18, 2007, the Sawyer County Board of Appeals
withdrew the following application:
Lots 1 & 2, being Part of Govt Lot 1, S 36, T 41N, R 8W, Parcel :1.19. Doc
#298944. 1.04 acres. Property is zoned Residential/Recreational One. Application
is for an after-the-fact variance for the construction of an approximately 7'x21'
replacement porch onto an existing dwelling at a setback distance of 64' to the
ordinary high water mark of Round Lake. The porch was reconstructed in the
original location. The ordinance provides for the replacement of foundation and
roof support systems; however the exterior walls must remain in place. Variance
is requested as Section 4.421(2)(b)(2)&(3), Sawyer County Zoning Ordinance,
would require that any additions to this building be located on the landward side
of the structure or no closer than 75' to the ardinary high water mark of the lake.
The Town of Hayward has approved the application.
The Board of Appeals determined that the variance is not necessary. The Board also
voted to return the variance application fee. A request has been made to the County
Treasurer for a refund check.
The Zoning Administrator wishes to remind you that Land Use Permits are still required
for this project and proposed projects. He will discuss these projects with you further..

Rd: Application for Land Use Permit
Dear Mr. Horlbeck:
Yesterday the Sawyer County Board of Appeals determined that a variance was not
required for the replacement lakeside porch; however an after-the-fact Land Use Permit is
required to be issued by this office. Section 9.2 LAND USE PERMITS, Sawyer County
Zoning Ordinance, requires that a Land Use Permit be issued for construction activities
exceeding 100 square feet in area. The porch has an area of approximately 150 square
feet. Also, since the project was started prior to the issue of a permit a double permit fee
($150) applies.
I have enclosed an application packet for a"Shoreland" Land Use Permit and a partially
completed application. I have also enclosed a copy of the 10-25-2007 inspection report
that can be attached to the application as the plot plan.
After you left the hearing room one of the Board members mentioned that during his visit
to the property he had an opportunity to talk to one of the contractors. The contractor
stated that when they were through with the house they would then begin work on the
cabin. The cabin is significantly closer to the lake than the home and falls under an
entirely different set of rules. The following are the permitted activities related to the
cabin.
Section 4.421(2)(a), STRUCTURES WITH NONCONFORMING SHORELINE
SETBACKS, Sawyer County Zoning Ordinnace.
(a) A nonconforming principal structure any portion of which is less
than 40 feet from the ordinary high-water mark is permitted ORDINARY
MAINTENANCE AND REPAIR and INTERNAL IMPROVEMENT.
Expansion is not allowed except by variance.
(1)New basements, additional stories, lofts, lateral expansion or accessory
construction outside of the perimeter of existing enclosed dwelling space
are not allowed except by variance.
(2)Renlacement of foundation and/or roof support systems is allowed only per
4.421(4)below and shall meet the requirements of Section 4.419
MITIGATION.
4) Replacement of Poundations and Roof Support Systems.
(a) A land use permit is required for replacement of all structure
foundations(i.e.basements,crawl spaces,piers,posts,slabs,etc.)and roof
support systems(i.e.rafters,trusses,beams,purlins,ete.).
(b)Exterior walls must remain in place.
(c) Foundation support components:
(1)May be replaced to existing FOOTPRINT dimensions only.
(2)Footings may be extended below the generally accepted frost line of the
locality.
(3) Habitable area requiring exterior ingress/egress(i.e.,walkouts,doors,
windows ete.)shall not be created.
(d)Roof pitch may be increased for ventilation,snow-load or aesthetic
purposes but may not create additional habitable area.
(e) Mitigation may be required.See Section 4.419 MITIGATION for details.
(fl SYandard erosion and storm water runoff control measures must be
implemented.
Definitions:
"ORDINARY MAINTENANCE AND REPAIR":Includes replacement of roofing,
siding,windows,doors,painting and other general maintenance acrivities limited to the
existing siructural envelope. A land use perniit is not required for these activities.
"INTERNAL IMPROVEMENT":Modifications/alterations within a DWELLING UNIT
that do not result in the alteration of the DWELLING IINIT envelope.A land use permit
is not iequiied for these activities.
