Bruggeman 1 Black Lake Court North Oaks MN 55127 Dear Mr. and Mrs. Bruggeman, On April 20, 2004, the Sawyer County Board of Appeals approved your application for variance on the following described real estate to wit: Lot 16 and Part Lot 17, Lac Courte Oreilles Beach Subdivision, S 36, T 40N, R 9W, Par- cel -21.16&17. Vol 715 Records Page 280. 23.48 acres. Property is zoned Residen- tiaURecreational One. Application is for the construction of a 14'/39'x42'/64' single story garage and mudroom addition onto an existing dwelling at a setback distance of 10' from the centerline of a private access easement. Variance is requested as Section 4.21(6), Sawyer County Zoning Ordinance, would require a minimum setback distance of 30' from the centerline of an access road. The Town Board has approved the application. The Sawyer County Board of Appeals approved the application with the condition that the 2"d driveway has a 15' width and with a 2-year time limit. Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would not be the basis of economic gain or loss. It would not be a self-created hardship. It would not be damaging to the rights of others or property values. Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within 30 days after the date of this notice. In future correspondence, or in applying for permits, please refer to Variance 04-007. Yours truly, Cindy K. Your application for a variance will be considered at a Public Hearing before the Sawyer County Zoning Board of Appeals on April 20, 2004 This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main Street, Hayward, Wisconsin. We hope that you have not been inconvenienced in any way by incorrect information. It is recommended that either you or a representative be present at the Hearing. A lack of information about the situation may result in unnecessary delay of a decision. Failure to appear may result in the denial of the application. If it is impossible for a representative to be present, please submit a written statement to this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This statement should include a description of the general terrain; surrounding development; your proposed intentions; and the purpose of the request. Photographs of the property and/or buildings are requested. Explain the undue zoning hardship inflicted upon the owner by conforming to the required minimum regulation, which induced the variance request. Convenience and financial loss or gain does not constitute zoning hardship. Your application will come before the Town Board for their review. Please contact the Town Clerk, Shirley A. Miller, 7829N Evergreen Ave., Hayward WI 54843, 715/634- 8469, to obtain the time and confirm the date of the Town Board meeting for your attendance or the attendance of your agent. pc: Brian Mast Offlce of Sawyer County Zoning Administration P. The date of public hearing was incorrectly listed as April 16, 2004. The public hearing date for this variance is April 20, 2004 at 7:00 PM in the Sawyer County Courthouse. I hope this correction of the date does not inconvenience you. Yours truly, Kitty Taylor Zoning Secretary Oftice af Sawyer County Zoning Administration P.O.Box 676 Haywazd,Wisconsin 54843 (ts)63a-szas URL:www.saryercountygov.org E-maih zone.adminsawyercountygov.org March 2,2004 Thomas W.Bruggeman 1 Black Lake Court North Oaks,MN 55127 Re:Pazcel-2L16&17,S 36,T 40N,R 09W:Appiication for Variance Deaz Mr.Bruggeman: I have enclosed the following documents with this letter. • "Court Decisions Regarding the Granting of Variances," • "Application for Vaziance-Additional Informafion," • a copy of the Sawyer County Boazd of Appeals Conclusions of Law Form(This is the form that the Board members will use to determine if your situation meets the requirements for the granting of the variance that you have requested.)and a • completed"Variance Application." If you believe that you meet the criteria for the requested variance you should review the application for conectness. If correct, sign the application and return it to this office with a check in the amount of$250.00 made out to the"Sawyer County Zoning Administration"by Friday,March 5,2004 for heazings in April 2004. The"Application for Vaziance-Additional Information"must also be filled out and returned with the Variance Application. Both documents together make up the entire application that will be reviewed by the Sawyer County Board of Appeals. Failure to return both of the documents or failure to complete either document in its entirety will cause the variance application to be rejected by this office. The"Variance Application"will be reviewed at two public hearings. The first heazing will held by the Town of Bass Lake at 630 P.M.,Monday,April 12,2004. You should contact Shirley A.Miller,Town of Bass Lake Clerk,at(715)634-8469(Town Hall)to confirm this date. The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M., Tuesday,Apri120,2004 in the lazge courtroom located in the Sawyer County Courthouse. You or your agent should attend each heazing, especially the hearing conducted by the Sawyer County Boazd of Appeals. Only the Board of Appeals can grant the vaziance, the decision of the Town of Bass Lake is advisory only. It is your responsibility to convince the Board of Appeals to grant the variance that has been requested. Therefore, you should consider using any means at your disposal (i.e., photographs, drawings, a good verbal presentation, etc.) as you present the facts to the Board. At its October 2002 public hearing, the Board members decided to apply expiration dates to future variances. You should be prepared to discuss this issue with the Board (i.e., proposed date that construction would begin, any anticipated construction delays that may be caused by the availability of contractors, excavators etc.). Mr. Bruggeman, one of the questions that you will be asked to answer is, "Is there another location on your property where you could construct this garage where a variance would not be required?" If the answer to this question is "yes" t6en you probably should not apply for this vaziance. Also, presently thc home is a conforming structure in that it meets all minimum setback requirements of the Sawyer County Zoning Ordinance. This variance, if granted, would make this building a non-conforming structure. Also, the Board of Appeals has a policy of granting only a single variance far a pazcel of land. This variance, if approved, would "use up"that vaziance allotment. Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to 4:00 P.M., Monday through Friday.
