On June 15, 2004, the Sawyer County Board of Appeals approved your application for variance
on the following described real estate to wit:
Lot 1, being Part of the E�/z of the SW%4 and Part of the E'/z of the NW'/4, S 6, T 40N, R
6W, Parcel .5.12. Vol 690 Records Page 380; CSM Vol 15 Page 163. 1.56 acres. Property
is zoned Residential/ Recreational One. Application is for the construction of a 30'x40'
dwelling with an attached 16'x20' screen porch at a setback distance of 34' from a non-
navigable wetland adjacent to the Chippewa Flowage. Variance is requested as Section
4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of
75' from the wetland boundary. The Town Board has denied the application. The applica-
tion was tabled at the request of the DNR at the March 16, 2004 public hearing for the
purpose of providing adequate time for the determination of the ordinary high water
mark.
The Sawyer County Board of Appeals approved the application with the following setbacks:
Change from 34' dwelling setback to 42', and 42' screen porch setback to 49'.
Conclusions of Law of the Board of Appeals: The property is unique. When purchased in 1993,
the lot was buildable. The unnecessary hardship is unnecessarily burdensome because they do not
have use of the property. The hardship is due to physical limitations of the property and not the
circumstances of the applicant because the applicant has nothing to do with these physical limita-
tions. He didn't create them. There's only a certain amount of space for building. The one
they've chosen seems like the best one for that property. DNR says he's surrounded by navigable
water, not wetlands. Variance will not be contrary to public interest. Zubrod doesn't think it is
contrary to public interest to allow people reasonable use or any use of their property. It is not
contrary to public interest and it will observe the purpose of the ordinance and do justice because
it allows the applicant to use the property for what it is zoned, RR-1.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-005.

CONCLUSIONS OF LAW
Based on the above findings of fact the Board concludes that the variance does/does not

Expiration of permit. Any privilege granted by this decision must be exercised within
months of the date of this decision after obtaining the necessary zoning, building
and other permits for the proposed construction. This period will be extended if this
decision is stayed by the order of any court or operation of law.
Revocation. This order may be revoked by the Board after notice and opportunity to be
heard for violation of any of the conditions imposed.
Appeals. This decision may be appealed by a person aggrieved by this decision or by any
officer, department, board or bureau of the municipality by filing an action in the circuit
court for this county within 30 days after the date of filing of this decision. Sawyer
County assumes no liability for and makes no warranty as to reliance on this decision if
construction is commenced prior to the expiration of this 30-day period.

I have looked over the materials you sent me and have also checked legal descriptions of adjacent
properties with buffer zone restrictions.
An}property located in the East half of the Northwes[quarter of section 6,T40N,R.6W,Town of Hunter
(Lot#1),is not encumbered by any restrictive buffer zone coveuants or right of first refusal.There does
appear to be several surveys d�at have moved the EasUWest quar[er line over ihe years and there may be
more movement in the future.Again,any part or portion North ofthe East/West quarter line in Section 6,
specifically in the Fast half of the Northwest quarter is outside of the buffer zone coveaanu.
Any portiou of land south of the EasdWest quarter line in Section 6(L,ots 2,3,and 4 of CSM#3712),is
within the buffer zone covenants.In addition to the buffer zone covenants,the Depar�nent of Naturnl
Resources does have right of first refusal on all properties south of the EasdWest quar[er line in the
Southwest quarter(lots 2,3,and 4).Both the cove�anu and right of first refusal are in full force and are
being applied to all encumbered properties.

Read the attached "Court Decisions Regarding the Granting of Variances" prior to
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional requirements contained in the Sa�wer Counri
ZoninQ Ordinance would result in unnecessary hardship. Present Wisconsin case law
describes hardshrp as being present only when an applicant has demonstrated that he
or she tivill have no reasonable t�se of the properry, in the absence of a variance. If a
parcel as a whole (but not necessarily each portion of the parcel) provides some
reasonable use for its owner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hazdship (i.e., purchasing
property �vith limitations and eYpecting that a variance would be granted to relieve
these limitations). A variance also cannot be granted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
property and are not eligible for variances.
2) The hardshio must be d�e to unique phvsicaf limitations of the propertv �vhich are not
Qenerallv shared bv other properties. Growin� families, additional living area for
guests, the desire for a larger garage etc., are not factors in deciding variances.
3) A variance mav not be ¢ranted which resuhs in harm to public interests. The Sawyer
County Zoning Ordinance was adopted "for the promotion and protection of the
pubtic health, morals, safety, and the general welfare." Additionaliy, the shoreland
zoning provisions of the Ordinance, provides for water quality, witdlife habitat,

4) Other considerations:
a. Self-created hardshios. A propeRy owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot when the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. V iolations bv neiehbors. In State v. Kenosha County Board ojAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the se[back. The court rejected that as a legitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the prooeRv. Variances aze granted for hardship tha[ peRains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.

the Trust is unable to meet the setback from the wetlands under the
current zoning ordinances.

from the wetlands and, possibly, the wetlands could have been filled.

Ed:
The Sawyer County Boazd of Appeals addressed the Padilla Family Trust vaziance at its
March 15`h public heazing. At that time the Boazd also reviewed the DNR letter dated
February 24,2004.
The boazd determined that Tateoka v. Ciry of Waukesha Bd. Of Zoning Appeals would not
apply in this situation,primarily because the Boazd has not adopted a rule that pertains to
the rehearing of vaziance applications that do not contain significantly changed conditions
or circumstances.
The Board acted on the DNR request to table the application until an ordinary high-water
mazk(OHWM)determination could be made. The Boazd tabled any further action on
this variance application until the Board's Tuesday,June 15,2004 public hearing. The
Board felt that this would provide adequate time for the requested OHWM determination.

RE: Padilla Variance Application
Dear Sawyer County BOA:
The Department would like to respond to the application for a variance by the Padilla Family Trust. In
reviewing this application the request is for the same thing that was applied for in 2001 and ultimately
denied by the Court of Appeals. Since this case has already been decided we do not feel the applicant is
entitled to another request without a significant change in the facts. The Court of Appeals has noted that
in general, when a new variance application is made, changed conditions or circumstances must be
shown. See Tateoka v. Ciry of Waukesha Bd. ofZoningAppeals, 220 Wis. 2d 656, 665, 583 N.W.2d 871
(Ct. App. 1998). The Trust's application does not show changed conditions or circumstances.
Another issue raised by the application is that the Trust states that it is seeking relief from the setback
requirements for a wetland area. However, it is our understanding that the area referenced in the
application is lakebed attached to the Chippewa Flowage. Due to the time of year we would not be able
to do a survey of this area until the snow and ice are gone. Therefore, if the Board decides to go ahead
with this application and hold another hearing even in light of the previous decision and subsequent
litigation,the DNR reyuests that the application be tabled until we are able to conduct an Ordinary High
Water Mark determination.

On Friday, February 6, 2004 this office received an application for variance far the above
parcel. This is the letter of instrucrion that is relevant to that application.
The following documents aze attached to this letter:
• "Court Decisions Regarding the Granting of Variances,"
• "Application for Variance - Additional Information" and a
• copy of the Sawyer County Boazd of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requixements for the granting of the variance that you have requested.).
The "Application for Vaziance - Additional Information" must also be filled ouC and
returned to this office by 4:00 P.M., Wednesdav, February 11, 2004. Both documents
(the variance application and the "Application for Variance—Additional Information")
together make up the entire application that will be reviewed by the Sawyer County Board
of Appeals. Failure to return both of the documents or failure to complete either
document in its entirety will cause the variance application to be rejected by this office.
Your application will be reviewed at two public heazings. The first hearing will be held
by the Town of Hunter at 630 P.M., Wednesday, Mazch 10, 2004. You should contact
Patricia Swaffield, Town of Hunter Clerk, at (715) 462-9429 (home) to confirm this daYe.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M..,
Tuesday, March 16, 2004, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Boazd of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Hunter is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you

photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.

conveyed is n pledge or assignment of Purchaser's interest under this Contract solely as securi6y fur un indebtedness of

Vendor shall mnke ell paymente when due under any mortgage outstnnding aguinst the Property on the date of
this Contract(exceptfor uny mortgage granted by Purchaser) or under any note secured thereby, provided Purchaser
makes timely puyment of the amounts then due under thia Contruct. Purchuser may make any such payments direcLly to
the Mortgagee if Vendor fails to do so and all payments so made by Purchaser shall be considered puyments made on
this Contract.
Vendor muy waive any default without waiving any other subsepuent or prior default of Purchaser.
All terms of this Contract ehall 6e binding upon and inure to the benefits of the heire, legal representativea,
