On March 16, 2004, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:
Lot 4, being Part of Govt Lot 2, S 18, T 40N, R 8W, Parcel :2.4. Vol 455 Records Page
62; CSM Vol 11 Page 340. .52 acres. Property is zoned Residential/Recreational One.
Application is for the construction of an approximately 28'x48' (including eaves) two
story replacement dwelling with an attached garage, at setback distances of 52' from the
ordinary high-water mark of Grindstone Lake, and 5' from a wetland area, and 24' from
the centerline of a private access road. Variance is requested as Section 4.49(1), Sawyer
County Zoning Ordinance, would require a minimum setback distance of 75' from the or-
dinary high-water mark of t he 1 ake, 4 0' f rom t he w etland a rea a nd S ection 4.21(3) r e-
quires a minimum of 30' from the centerline of an access road. The Town Board has de-
nied the application.
The Sawyer County Board of Appeals approved the amended application as follows: Remove the
appendage to the west and bring the building out 8' to the east. Road setback not an issue. Allow
22'x30' footprint, not including eaves. 1' eaves on either side. 58' from the lake. Removal of both
storage buildings. Septic system addressed. Design can be 2 stories, garage if desired. 3-year time
frame on construction.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would
not be the basis of economic gain or loss. It would not be a self-created hardship. There would be
no change in the use in the zone district. It would not be damaging to the rights of others or prop-
erty values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance 04-002.

Cabin Setbacks
On Monday, July 11 , 2005 Eric Wellauer and I visited the Orner property regarding
inquiries about wetland filling. While on the property we measured the setback (54')
from the cabin foundation to the OHWM of Grindstone Lake. The approved variance
(#04-002) setback was 58' from the OHWM. There is some confusion on the
interpretation of the inspection report for the "old" cabin as the setback could be either
58' or 55 ' depending on the report looked at.
Today I discussed this with Ray Zubrod, Chairman, Sawyer County Board of Appeals and
it was decided to allow construction to proceed as is as the new cabin will be no closer to
the OHWM than the "old" cabin.

Dear Mr Christman;
At my property yesterday we were discussing the issue of the lake setback distance of Che new
foundacion.You indicated that your measuremen[showed that the foundation is about three to
four feet too dose to the lake.
I have reviewed my documentation beginning almost two yeazs ago,leading up to the request for
a zoning variance.Al]of the documentation shows that the original cabin foundation was at a
setback of 58 feet from the high water mark at that time,and that the new cabin was to be built at
that same location on the gtound.The 58 foot requirement came from that original location,and
the variance allows rebuilding at that location.That is what was done.The new foundation is
where the old foundation was.The only thing that could have changed is location of the high
water mark.

I suspect that the cause of the discrepancy in your measurements yesterday is the fact tha[the
shoreline in front of my cabin,and all the shoreline on that end of the lake,sees signiYlcant
changes each yeaz,and especially last year,from the ice movement across the lake during the
spring thaw.I have pictures from this spring,which I can provide to you,showing that lazge
volumes of shoreline material have been pushed up by the ice,in some locations as high as the
shoreline embankment,about four feet vertically.With the shallow water depth along the shore,
the movement of this much material could indeed cause the high-water line to have changed
since the original setbacks were measured two years ago.Every year since we boughe the
property in 1990 there has been disruption of the shoreline from the ice movement across the
lake,pushing back the edge of the shoreline.In addition,the wa[er depYh is regulated by a dam
on the Lac Courte Oreilles River,and is subjec�[o variability.
Tt is my position that the foundation has been placed in conformance to requirements specified in
the zoning variance,that being in the same location as the old foundation,and that no fuRher
ac[ion is required for this matter.I can be available to meet with you ro discuss this further if
required,or you can contac�me as shown below.

Read the attached "Court Decisions Regarding the Granting of Variances" prior ro
answering the following questions.
Discussion:
To qualify for a variance, you must meet all three requirements of a three-step test.
1) Strict application of the dimensional reguirements contained in the Sa��ver Countv
Zonine Ordinance would result in unnecessan;' hardship. Present �G'isconsin case lmv
describes hardshtp ns being present only tirhen an applicant has dernonstrated thnt he
or she ivill hatie no reasonable use ojthe property, in the absence of n vnriance. If a
parcel as a whole (but not nzcessarily each portion of the parcel) procides some
reasonable use for its o«ner, then the test is not met and a variance cannot be granted.
A variance cannot be granted because of a self-imposed hardship (i.e.. purchasing
property with limitations and expecting that a variance would be granted to relieve
these limitations). A variance also cannot be eranted, when in the absence of the
variance approval, the owner will suffer loss of profit or financial hardship. Decks
and similar minor accessory structures are not essential to the reasonable use of
property and are not eli�ible for variances.
2) The hardship must be due to unigue phvsical limitations of the propem �vhich are not
generallv shared b�� other properties. Gro�cine families, additional livins area for
guests, the desire for a lar�er garage etc., are not factors in deciding variances.
3) A variance mav not be eranted �vhich results in harm to oublic interests. The Sa��yer
County Zoning Ordinance �vas adopted "for [he promotion and protection of the
public health, morals, safety, and the general �velfare." Additionally, the shoreland
zonine provisions of the Ordinance, provides for water quality, �vildlifz habitat,

4) Other considerations:
a. Self-created hardshins. A property owner may not obtain a variance for a hardship
that is self-imposed. Examples include: creating a substandard lot �rhen the owner
has sold off portions that would have prevented the hardship, creating a land-
locked parcel by selling property, building during the pendency of an appeal when
the owner does not prevail, and making improvements in violation of the
ordinance.
b. Violations b�ghbors. In State v. Kenosha Coimty Board oJAdjustment, the
Board of Adjustment in part based its variance on the fact that many other
neighbors have decks within the setback. The court rejected tha[ as a (egitimate
factor to use in determining whether the owner had a reasonable use of her
property without a deck.
c. Variances run with the �ropertv. Variances are granted for hardship that pertains
to the conditions of the property, rather than to the person making the application.
Accordingly, variances run with the property and are not terminated when the
property changes hands.

Reasonable use of our property is lake access for recreational activities, and adequate shelter for
our family and our associated belongings.

The hardship is the fact that the 75' lake setback and 40' wetlands setback are mutually exclusive
for a building or structure of any kind. It is physically impossible to satisfy both requirements. The
75' setback line from the lake is about 7' from the rear wall of the existing cabin. The wetland
delineation flag behind the cabin is 5' from the foundation. A 40' setback from that flag is then
located 15' in front of the cabin.
Did this hardship exist when you became owner of the property`l
I believe so. The hardship came into existence when the 75' lake setback and the 40' wetlands
setback requirements came into effect. I don't know when that was. The cabin and the property
have remained essentially unchanged since the cabin was built in about 1950.

Granting of the variance will allow us to continue to use the property in the same manner as we
have been for 13 yeazs.
A variance wil!not be conhary to the public i�iterest because...
it will not change the existing actual lake and wetland setbacks to the structure by any significant
amount, and it does not change the intended use of the property. The addition of a new septic
system will be a positive contribution to the public interest by conformi�g to the latest standards.

Subject: Groberg Variance Hearing 12/16/03
Bill, I see that Gregory/Janice Groberg has applied for a variance that will
be heard on Dec. 16th. This is the site that we reviewed the wetland
delineation report with Jason Berkner this past summer on Grindstone Lake.
I would request that consideration be given to adjusting tbe proposed
building location on the lot Specifically, I'd request thaY the setback
from the lake be increased. The original structare (22' x 30') is proposed
to be replaced with a larger (26' x 50') cabin. A large portion of the
current structure and surrounding property is most likely sitting on
historic wetland fill. Since the proposed structurc cannot meet the zoning
setbacks, i.e.; wetland setback under any situation, I'd prefer to see a
plan that would increase the lake setback and reduce the wetland setback to
the side(s) of the proposed new cabin.
I suspect that the structure at 8667N Brossard Rd. will be asking for a
variance in the future too, since we received a wetland delineation report
for that lot. I'd ask that the lake setback be increased far tbat
particular lot too (if and when an application is submitted). That will put
the two structures nearer the setbacks that currently exist with the
neighbaring structures (8677N, 8659N).

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
infoRnation about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Arvid H. Vallem, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surcounding development;
your proposed intentions; and the purpose of the request. Photographs of the propeRy
and/or buildings are requested. Explain the undue zoning hazdship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does no[ constitute a zoning hardship.
Your application will come before the Town Boazd for their review. Please contact the
Town Clerk, Shirley Miller, 634-2172 to obtain the time and confirm the date of the Town
Board meeting for your attendance or the attendance of your agent.

Application for Variance
Dear Mr. Orner:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• "Court Decisions Regarding the Granting of Variances,"
� "Application for Variance - Additional Information,"
• a copy of the Sawyer County Board of Appeals Conclusions of Law Form (This is the
form that the Board members will use to determine if your situation meets the
requirements for the granting of the variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of $250.00 made out to the "Sawyer County Zoning
Administration" by Friday, January 2, 2004 for hearings in February 2004.
The "Application for Variance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Bass Lake at 6:30 P.M., Monday, February 9, 2004. You should
contact Shirley A. Miller, Town of Bass Lake Clerk, at (71 S) 634-8469 (Town Hall) to
confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, February 17, 2004 in the large courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore,you should consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present the facts to the
Board.
At its October 2002 public hearing,the Board members decided to apply expiration dates
to future variances. The applicants should be prepared to discuss this issue with the
Board(i.e.,proposed date that construction would begin,any anticipated construction
delays that may be caused by the availability of contractors,excavators etc.).
Based on our conversation yesterday,you should have an understanding of how the Town
of Bass Lake and the Sawyer County Board of Appeals dealt with the Groberg variance
application for a replacement dwelling. Essentially,both agreed that the Groberg's
should be allowed to construct a two-story replacement dwelling to the same approximate
dimensions(footprint)of the existinQ cabin. This same criteria could quite possibly be
applied to your situation. Also,the Board,as a condition of approval of the Groberg
variance,required that the accessory buildings be removed from the property and that a
holding tank be installed.
