Dear Ms. Springer,
On January 20, 2004, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:
Lot 1 and Lot 1, being Part of Govt Lot 2, S 16, T 39N, R 9W, Parcel :2.5. Vol 547 Rec-
ords Page 329; CSM Vol 5 Page 360 and CSM Vo17 Page 138. 1.29 acres (56,192 square
feet). Property is zoned Residential/Recreational One. Application is for the construction
of a 17'x34' addition with a 6'x17' front deck at a setback distance of 119' from the cen-
terline of State Highway 27/70 and a 17'x 14' rear deck and a 20'x20' attached garage, all
exceeding 50% of the current estimated fair market value. Variance is requested as Sec-
tion 4.21(1), Sawyer County Zoning Ordinance, would require a minimum setback dis-
tance of 130' from the centerline of a state highway, and Section 10.2 restricts the cost of
construction to less than 50% of the current estimated fair market value. The Town Board
has approved the application.
The Sawyer County Board of Appeals approved the application as follows: New front deck as
proposed is not allowed; 2 years to complete; application is singular, Darnell Smith as purchaser
only, approval to her alone, does not transfer approval to others if sale falls through; basement
allowed also.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It would
not be the basis of economic gain or loss. It would not be a self-created hardship. There would be
no change in the use in the zone district.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future coi-respondence, or in applying for pernlits, please
refer to Variance 04-001.

Dear Ruth Springer:

Please review the inspection report and the application for correctness. If correct, sign the
application and return it to this office with a check in the amount of $250.00 made out to
the "Sawyer County Zoning Administration" by Friday, December 5, 2003 for hearings in
January 2004.
Remember, only the property owner can apply for a variance and one of the criteria that
the Board of Appeals follows is not to grant variances for economic gain of the property
owner.
Your "Variance Application" will be reviewed at two public hearings. The first hearing
will held by the Town of Sand Lake at 7:30 P.M., Tuesday, January 13, 2004. You
should contact Elaine Nyberg, Town of Sand Lake Clerk, at (715) 865-2486 to confirm
this date.
The Sawyer County Board of Appeais will l►old the second hearing at 7:00 P.M.,
Tuesday, January 16, 2004, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of thc Town of Sand Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractors, excavators etc.).
