Dear Mr. Czarnecki,
On December 20, 2005, the Sawyer County Board of Appeals approved with conditions your
application for variance on the following described real estate to wit:
Part of the NW'/4 NW'/4, S 9, T 40N, R 6W, Parcel .6.3. Doc #320885.
90'/152'x277'/344'containing 1.0 acres. Property is zoned Commercial One. Application
is for the construction of a 24'x30' (26'x32' with eaves) detached garage at a setback dis-
tance of 47' from the centerline of River Road (a town road). Variance is requested as �
Section 4.21(3), Sawyer County Zoning Ordinance, would require a minimum setback
distance of 63' from the centerline of a town road. The Town Board has denied the appli-
cation.
The Board of Appeals approved the application contingent upon elimination of 1 driveway as
suggested by the Town of Hunter Board, with a 2 year time limit.
Findings of Fact of the Board of Appeals: Removal of one driveway is a safety factor. Although
it is zoned C-1, it is not being used for commercial purposes. A garage is a necessity here, but
safety is a prime concern.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-040.

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Boazd of Appeals on:
Tuesday, December 20, 2005
This hearing will begin at 7:00 P.M. at the Sawyer County Courthouse, 10610 Main,
Hayward, WI 54843. It is recommended that either you or a representative be present at
the Hearing. A lack of information about the situation may result in unnecessary delay of
a decision. Failure to appeaz may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Raymond Zubrod, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by confornung to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hazdship.
Your application will also go before the Town Board. Please contact your Town
Clerk Patricia Swaffie1d; 462-9429 for the day and time of the Town Board meeting
so you or your representative may appear.

Dear Mr. Czarnecki:
I have enclosed the following documents with this letter.
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return ii to this office witn a cneck in the amount of$250.Ov made out to fhe "Sawyer
County Zoning Administration" by Friday, November 4, 2005 for hearings in December
2005. Please indicate on the application your anticipated time of presentation to the
Board.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Hunter at 6:30 P.M., Wednesday, December 14, 2005. You should contact
Patricia Swaffield, Town of Hunter Clerk, at (715) 462-9429 to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, December 20, 2005, in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board can grant the
variance, the decision of the Town of Hunter is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
