On November 15, 2005, the Sawyer County Board of Appeals approved your application for
variance on the following described real estate to wit:
Lot 29, Block l, lst Addition Bauers Heights Subdivision, S 28, T 38N, R 3W, Parcel -
3.29. Vol 429 Records Page 432. 100'x226'/230'containing .58 acres. Property is zoned
Residential/Recreational One. Application is for the construction of a 36'x32' (40'x36'
with eaves) single story, detached garage at a setback distance of 33' to the centerline of
Johnson Road (a town road). Variance is requested as Section 4.21(3), Sawyer County
Zoning Ordinance, would require a minimum setback distance of 63' from the centerline
of this road. The Town Board has approved the application.
The Board of Appeals approved the application as submitted with a 2 year time limit.
Findings of Fact of the Board of Appeals: It would not be a self-created hardship. There would
be no change in the use in the zone district. It would not be damaging to the rights of others or
property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-037.

request. Convenience and financial loss or gain does not constitute zoning hardship.

• Inspection Report for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
application tor correctness. lt correct, sign the application and return it to this oftice witn
a check in the amount of$250.00 made out to the "Sawyer County Zoning
Administration" by Friday, October 7, 2005 for hearings in November 2005.
Your"Variance Application"will be reviewed at two public meetings. The first meeting
will be held by the Town of Winter on Wednesday,November 9, 2005. You should
contact Arlene Bishop, Clerk, Town of Winter, at (715)266-3131 to confirm this date.
Mrs. Bishop may be reached at(715) 266-3131, Monday—Wednesday, from 8:00 A.M.
to 3:00 P.M. at the town hall.
The Sawyer County Board of Appeals will hold a public hearing at 7:00 P.M., Tuesday,
April 15, 2005 in the large courtroom located in the Sawyer County Courthouse. You or
your representative should attend each hearing, especially the hearing conducted by the
Sawyer County Board of Appeals. Only the Board of Appeals can grant the variance, the
recommendation of the Town of Winter is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
