On October 18, 2005, the Sawyer County Board of Appeals approved as amended your applica-
tion for variance on the following described real estate to wit:

225; CSM Vol 6 Page 39. Approximately 100'x191'/206' containing .44 acres. Property
is zoned Residential/Recreational One. Application is for the construction of a 28'x32'
(31'x35' with eaves) detached garage at a setback distance of 55' to the centerline of
Badger Bay Lane (a town road). Variance is requested as Section 4.21(3), Sawyer County
Zoning Ordinance would require a minimum setback distance of 63' to the centerline of
this road. The Town Board has approved the application.
The Board of Appeals approved the application of a 23'x25' garage 46' from the centerline of the
road, and with a 2-year deadline.
Findings of Fact of the Board of Appeals: There would be no change in the use in the zone dis-
trict. It would not be damaging to the rights of others or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-035.

Part 2: Three-�tep�est.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as t/ie "three-step test."
1) Unique Pronerty Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circLtmstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.
Do unique physical characteristics of your property prevent compliance with
the ordinance?

2) No Harm to Public Interests.
A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1)Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.

3) Unnecessary Hardship. ,�9� C/��� � }� �``'4 c�'•
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a
vacant lot and then arguing that there is no suitable location for a home.).
Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance.' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessar�hardshi�exists when compliance would
unreasonably prevent the owner from usin�the property for a permitted
purpose or would render conformity with such restrictions unnecessarily
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.

statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact

will use to determine if your situation meets the requirements for the granting of the

returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.

�vill be he.ld by the Town of Edgewater at 7:00 P.M., Tuesday, October 11, 2005. You
should contact Natalie Clemens, Town of Edgewater Clerk, at(715) 354-7747 to confirm
the date and time. It is very important that you contact Mrs. Clemens as soon as possible,
as the Town of Edgewater may require that you attend a meeting of the Town's Planning
Commission prior to your appearance before the Town Board.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 18, 2005, in the large cotirtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
� � Board.
