On October 18, 2005, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:
Lots 6-8, Block 8, Village of Stone Lake, S 19, T 39N, R 9W, Parcel -20.8.6-8. Vol 582
Records Page 460. 100'x132' containing .303 acres (13,200 square feet). Property is
zoned Residential One. Application is for the construction of an approximately 82'x34'
(86'x38' with eaves) two-family dwelling at setback distances of 26' to the centerline of
an alley, 32' to a rear lot line and on a parcel containing 13,200 square feet. Variance is
requested as Section 4.21(6), Sawyer County Zoning Ordinance would require a mini-
mum setback distance of 30' to the centerline of the alley, Section 18.4 would require a
minimum setback distance of 40' to the rear lot line and Section 18.2 would require a
minimum parcel size of 15, 000 square feet. The Town Board has approved the applica-
tion.
The Board of Appeals approved the application as submitted with a 2-year deadline.
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It
would not be a self-created hardship. There would be no change in the use in the zone district. It
would not be damaging to the rights of others or property values.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-033.

Dear Betty:
Enclosed is a drawing of the total area of lots 6-8. Points of interest are:
• The total land area= 13,200 square feet. This is sufficient for a single
family dwelling (a minimum area of 10,000 square feet is required).
However, a minimum of 15,000 square feet would be required for a two-
family dwelling on this properly.
• The minimum setback requirements would be no closer than:
0 63' to the centerline of both Stubbins Ave. and 1 St Street North,
0 30' to the centerline of the alley and
0 40' to the rear lot line, the lot line opposite to where the driveway
enters the property (Stubbins Ave.).
• After all setback requirements have been met a 30' x 82' =2,460 square
feet buildable area remains. A single-family dwelling could be
constructed in this area with the issue of a land use permit by this office.

Dear Mr. and Mrs. Helwig:
Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on
October 18, 2005
This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Raymond Zubrod, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact
the Town Clerk, Elaine Nyberg, 16199W Musky Point Dr., Stone Lake WI 54876,
715/865-2486, to obtain the time and confirm the date of the Town Board meeting for
your attendance or the attendance of your agent.

Re: Application for Variance
Dear Hal:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criieria for iiie requested variance you sl�ould review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of$250.00 made out to the "Sawyer
County Zoning Administration" by Friday, September 2, 2005 for hearings in October
2005.
Your application will be reviewed at two public hearings. The first hearing will be held
by the Town of Sand Lake at 7:30 P.M., Tuesday, October 11, 2005. You should contact
Elaine Nyberg, Town of Sand Lake Clerk, at (715) 865-2486 (home)to confirm this date.
It is very important that you contact Mrs. Nyberg as soon as possible, as the Town of
Sand Lake may require that you attend a meeting of the Town's Planning Commission
prior to your appearance before the Town Board.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 18, 2005 in the large Courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Sand Lake is advisory only.
It is your responsibility to'convince the Boazd of Appeals to grant the variance that you
have requested.Therefore,you shouid consider using any means at your disposal(i.e.,
photographs,drawings,a good verbal presentation,etc.)as you present your facts to the
Board. .
At its October 2002 public hearing,the Boazd members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Boazd(i.e., n
proposed date that construction would begin,any anticipated construction delays that may �
be caused by the availability of contractors,excavators etc.).
