Dear Mr. Martin,
On November 15, 2005, the Sawyer County Board of Appeals approved as amended your ap-
plication for variance on the following described real estate to wit:
Lot l, being Part of Outlot 8, Village of Stone Lake, S 19, T 39N, R 9W, Parcel -21.84.
Doc #327424; CSM Vol 26 Page 164. 81'x123'containing approximately .23 acres. Prop-
erty is zoned Residential One. Application is for the construction of a single family dwell-
ing at a setback distance of 30' to the centerline of Third Street (a town road). Variance is
requested as Section 4.21(3), Sawyer County Zoning Ordinance, would require a mini-
mum setback distance of 63' from the centerline of this road. The Town Board has ap-
proved the application as amended.
The Board of Appeals approved the application as follows: 1. Increase the setback from the cen-
terline of Third Street North from 30' to 36.5', with a setback of 20' to the right-of-way of the
street. 2. Reduce the setback on the opposite side lot line from 34' to 27.5'. 3.Approve the set-
back between the driveway to this lot and the driveway to the lot to the south at whatever that
setback distance is .
Findings of Fact of the Board of Appeals: It would not be the convenience of the owner. It
would not be the basis of economic gain or loss. There would be no change in the use in the zone
district. It would not be damaging to the rights of others or property values. It would be due to
special conditions unique to the property.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-031.

MINUTES
Chairman, Edgar Gregory, called the meeting to order at 7:00 P.M. Members present:
Bill Christman, Harry Miller, Pat Patko, Rick Traver and Gene Vaenendall.
The purpose of the meeting was to consider a variance application submitted by Habitat
for Humanity of Sawyer County, Inc. for the construction of a single family dwelling on
parce1026-194-00-0804, Village of Stone Lake. A variance is required as the proposed
dwelling will be located 30' from the centerline of Third Street North. The Sawyer
County Loning Ordinance requires a minimum setback disiance of ci3' to the centerline
of this street. Bill Christman explained the need for this variance. The primary issue is
that this lot has Town roads on two of its sides (Third St.North—on the north side of the
lot and Frost Avenue—on the east side of the lot),thus requiring a 63' setback from the
centerline of each of the roads. The lot is not large enough so that both of these setbacks
and all lot line setbacks can also be met.
There was considerable discussion on applying County zoning requirements in a village
situation, in that nearly all construction activities within the Village of Stone Lake
requires the priar approval of one or more variances simply because of the configuration
(size) of the lots and the fact that the village streets are considered to be Town roads by
County Zoning. There was also discussion on the need far garages when constructing
new housing units. This particular application was placed on hold while the applicant
decided whether a garage should be constructed on this lot. The applicant decided that a
- garage would not be required. The issue of the Commission recommending approval of
all such similar variances was discussed and whether the granting of such variances really
meets the planning objective of"Smart Growth."
Motion by Rick Traver to recommend to the Town Board to:
1. Increase the setback distance from the centerline of Third Street North to
the proposed dwelling from 30' to 36.5' resulting in a setback distance of
20' to R-O-W of the street,
2. Reduce the dwelling setback on the opposite side lot line from 34' to 27.5'
and
3. Approve the setback distance between the driveway access to this lot and
that of the driveway access to the lot to the south, regardless of the
distance between the two driveways.
Discussion. The Commission believes that for the safety of its residents, the house
should be located further than 30' to the centerline of Third Street North. The third part
of the motion (driveway setbacks)was made as it is anticipated that the driveway access
to this lot will be closer than 75' to the driveway access to the lot to the south. Currently
both lots are in the same ownership. The Commission also believes that the County
Zoning minimum setback requirement of 75' between driveways accessing a Town road
should not apply in a village setting. Approving the driveway setback now will prevent
the owners of these lots from having to apply for a driveway setback variance should one
be required.
Motion was seconded by Pat Patko. Motion carried unanimously.
Gene Veenendall moved that the meeting be adjourned, seconded by Rick Traver.
Motion carried unanimously.

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on
November 15, 2005
This hearing will begin at 7:00 P.M. at Hayward City Hall located at 15889W 3rd
Street, Hayward,Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
� information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Raymond Zubrod, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hazdship inflicted upon the
owner by confornung to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact
the Town Clerk, Elaine Nyberg; 865-2486 to obtain the time and confirm the date of
t6e Town Board meeting for your attendance or t6e attendance of your agent

Re: Application for Variance
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• revised "Variance Application."
A copy of the original application is attached. I talked to Pete Sanders about the size of
the proposed dwelling and he suggested that I use the same dimensions for the dwelling
that is being constructed on lot #2. I did not include a porch, but if you want a porch on
this dwelling, please let me know so that I can revise the inspection report and the
application accordingly. Also, I did not include a future detached garage site on the
inspection report. If a garage is desired, please let me know so that I can revise the
inspection report.
Your application will be reviewed at two public hearings. The first hearing will be held
by the Town of Sand Lake at 7:30 P.M., Tuesday, October 11 , 2005. You should contact
Elaine Nyberg, Town of Sand Lake Clerk, at (715) 865-2486 (home) to confirm this date.
It is very important that you contact Mrs. Nyberg as soon as possible, as the Town of
Sand Lake may require that you attend a meeting of the Town's Planning Commission
prior to your appearance before the Town Board.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, October 18, 2005 in the large courtroom located in the Sawyer County
Courthouse. You or your representative should attend each hearing, especially the
hearing conducted by the Sawyer County Board of Appeals. Only the Board of Appeals
can grant the variance, the decision of the Town of Sand Lake is advisory only.

It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
At its October 2002 public hearing, the Board members decided to apply expiration
dates to future variances. You should be prepared to discuss this issue with the Board
(i.e., proposed date that construction would begin, any anticipated construction delays
that may be caused by the availability of contractors, excavators etc.).
