Dear Mr. and Mrs. Wiederin,
On August 17, 2005, the Sawyer County Board of Appeals approved your application for vari-
ance on the following described real estate to wit:
Lots 10 & 11, Block 1, Rockford Beach Subdivision, S 30, T 40N, R 8W, Parcel -
9.1 . 10&11 . Vol 820 Records Page 771 . 60'x100' containing 6,000 square feet. Property
is zoned Residential/Recreational One. Application is for the construction of a 22'x24'
(24'x26' with eaves) garage addition onto an existing dwelling at a setback distance of
48' to the centerline of Poplar Avenue (a town road) and 2T to an adjacent side lot line.
The garage addition will be located no closer to the side lot lines than the existing dwell-
ing. The dwelling is located 73' to the ordinary high water mark of Grindstone Lake.
Variance is requested as Section 4.21(3), Sawyer County Zoning Ordinance, would re-
quire a minimum setback distance of 63' to the centerline of this road and Section 18.4
would require a setback distance of 30' to the side lot line. The Town Board has denied
the application.
The Board of Appeals approved the application as submitted with a 2-year deadline and a Condi-
tional Use Permit for impervious surface if found necessary by the Zoning Committee.
Conclusions of Law of the Board of Appeals: Unnecessary hardship is present since strict appli-
cation of the terms of the zoning ardinance would render conformity with such restrictions un-
necessarily burdensom because of the size of the lot. It is confined. The variance will not be con-
trary to the public interest and will observe the purpose of the ordinance.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-022.

Re: Kimberly and Randal Wiederin
The granting of a oariance on a 6,000 square foot lot to add a garage onto the
current cottage would be for the convenience of the ovner while creating topographical
problems . The Town is not in favor of using public areas to be included in calculations
for impervious surfaces (is) compliance. The covering of the lot with 22.5% (is) would be
detrimental to the shorelands of Grindstone Lake, and if the compacted area entering into
garage $s included in the calculation of (is) becomes 35.6� of the lot. All water goes to
the lake directly or down Poplar Lane to the lake. Reason tells you that on a lot this

Revocation. This order may be revoked by the Boazd after notice and opportunity to be
heard for violation of any of the conditions imposed.
A eals. This decision may be appealed by a person aggrieved by this decision or by any
officer,department,board or bureau of the municipality by filing an action in the circuit
court for this county within 30 days after the date of fiting of this decision. Sawyer
County assumes no liability for and makes no warranty as to reliance on this decision if
construction is commenced prior to the expiration of this 30-day period.

Dear Mr. Wiederin:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of$250.00 made out to the "Sawyer
County Zoning Administration" by Friday, July 1 , 2005 for hearings in August 2005.
The "Variance Application" will be reviewed at two public hearings. The first hearing
will be held by the Town of Bass Lake at 6:30 P.M., Monday, August 8, 2005. You
should contact Shirley A. Miller, Town of Bass Lake Clerk, at (715) 634-8469 (Town
Hall) to confirm this date. It is very important that you contact Mrs. Miller as soon as
possible, as the Town of Bass Lake may require that you attend a meeting of the Town's
Planning Commission priar to your appearance before the Town Board.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, August 16, 2005 in the large Courtroom located in the Sawyer County
Courthouse. You or your agent should attend each hearing, especially the hearing
conducted by the Sawyer County Board of Appeals. Only the Board of Appeals can grant
the variance, the decision of the Town of Bass Lake is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that has
been requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present the facts to the
Board. '
At its October 2002 public hearing, the Board members decided to apply expiration dates
to future variances. You should be prepared to discuss this issue with the Board (i.e.,
proposed date that construction would begin, any anticipated construction delays that may
be caused by the availability of contractars, excavators etc.).
Mr. Wiederin, the small size of your lot (6,000 square feet), combined with the existing
cabin and the proposed garage addition, results in an impervious surface area issue that
will require the approval of a conditional use permit by the Sawyer County Zoning
Committee. If the Sawyer County Board of Appeals approves the requested variance, the
Zoning Committee must then approve the issue of a conditional use permit as the
impervious surface area of the cabin and garage will exceed 15% of the total surface area
of the lot. With the Board of Appeals hearing in August,the next available Zoning
Committee hearing would be on Thursday, October 21. I am aware of the delay that this
will cause in getting the garage constructed, but there will be no way to avoid both of the
required public hearings. Assuming that the Board of Appeals approves your variance
request, you must complete an"Application for a Conditional Use Permit" by Friday,
September 2, 2005 far the October 21s`hearing.
