with an attached 22'x 42'lakeside deck all at a setback distance of 57'from the centerline of
Maple Terrace Drive (a Town road). Variance is requested as Section 421(3), Sawyer
County Zoning Ordinance,would require a minimum setback distance of 63'to the centerline
of this Town road.Sawyer County Zoning Department staff establishedlflagged minimum set-
backs on this pazcel prior to construction activities.
The sia(6)foot roof over 6ang must be reduced to a 2 foot over6ang and the building is to
be incompliance within sia(6)months. A citation will be issued.
Findings of Fact of the Board of Appeals:It is a self created hazdship.It would be damaging to
the rights of others and property values.It is contrary to the public interest.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice.

It was observed that a dv+�elling had been constructed at a setback distance of 57' to the
centerline of Maple Terr�ce (a Town road) on the Gary Spicer property. The minimum
required setback would be 63' from the centerline of this road. Sawyer County Zoning
Department staff flagged', minimum setback setbacks on this parcel prior to construction
activities. Gene Spicer v�vas the contractor for this project and was present when the

Deaz Gary&Kim:
Recently I was asked to conduct a field inspection to verify a septic/sewer set back
violations on your property at 16792 Maple Terrace,Birchwood, WI. I inspected the
sewer on 10-27-04. There was no home on the property and the septic sewer setbacks
were code complying at the time of inspection.
Unfortunately,the building contractor has constructed the home and overhead deck which
has created several septic/sewer set back violations. Please refer to my enclosed
inspection report and sewer setback requirements, Comm Table 83.43-1
The violations noted:
1.) Concreted septic tank, 36"from home, Code is 5' setback
2.) Deck over tank, code requires a 5' horizontal setback
3.)Temporary deck post over sewer trench,post and deck setback code is 10' horizontal
setback.
Contact a plumber to correct the violations, I would imagine a plumber would have to
, collapse and fill the tank; install a new tank to meet setbacks, remove sections of the first
two trench's to meet the setbacks and to install new trench chambers to meet code
compliance.
This is a self-created hardship and not the fault of the plumber who installed the system.
I will set a deadline of 60 days or no later than 1 Aug OS to correct these problems.
I also noted that the dwelling canopy is at 57' form the centerline of the town road,
county ordinance requires a 63' setback. I wil'1 follow up on the sewer violation; other
zoning personnel will address the building zoning violations.

will use to determine i� your situation meets the requirements for the granting of the
variance that you have requested.) and a

variance, the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
