Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of ttvs decision within
30 days after the date of this notice.

To qualify for your requested variance, you must demonstrate that your p�operty meets �_ `` �,,` ,; `. 2 J
the following three requirements. This is known as the "three-step test."
1) Unique Property Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the

Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.
You are applying for an "area variance. ' An area variance relaxes a
dimensional standard such as a setback, frontage, lot area, or height. For an
area variance, unnecessary hardship exists when compliance would
unreasonabl�prevent the owner from using the propert f�permitted
purpose or would render conformity with such restrictions unnecessarilv
burdensome. The importance of the public purposes of the ordinance, the
degree to which the restriction supports those purposes and the extent of the
relaxation of the restriction are weighs against the limitations full compliance
would impose on use of the property.

Dear Mrs. Acrey:
I have enclosed the following documents with tlus letter.
• Inspection Report for the above property,
• Application for Variance — Additional Informarion,
• Boazd of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
vaziance that you have requested.) and a
• completed "Vaziance Application."
If you believe that you meet the criteria for the reauested variance you should review the
application for correctness. If correct, sign the application and return it to this office with
a check in the amount of$250.00 made out to the "Sawyer County Zoning
Administration" by Friday, June 3, 2005 for hearings in July 2005.
The "Application for Vaziance - Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Boazd of Appeals. Failure to
return both of tbe documents or failure Co complete either document in its entirety will
cause the variance application to be rejected by this office.
Your "Variance Application" will be reviewed at two public hearings. The first heazing
will be held by the Town of Edgewater at 7:00 P.M., Tuesday, July 12, 2005. You should
contact Natalie Clemens, Town of Edgewater Clerk, at (715) 354-7747 to confirm the
date and time. It is very impor[ant that you contact Mrs. Clemens as soon as possible, as
the Town of Edgewater may require that you attend a meeting of the Town's Planning
Commission prior to your appeazance before the Town Board.
The Sawyer County Boazd of Appeals will hold the second hearing at 7:00 P.M.,
Tuesday, 7uly 19, 2005, in the large courtioom located in the Sawyer County Courthouse.
You or yo�:r representative should attend each hearinb, esp�,�ially Yhe �aearir_g conductPd
by the Sawyei County Boazd of Appeals. Only the Board of Appeals can gxant the
variance, the decision of the Town of Edgewater is advisory only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
