Dear Mr. and Mrs. Subera,
On April 21, 2005, the Sawyer County Board of Appeals approved your application for variance
on the following described real estate to wit:
Lot 2, being Part of Govt Lot 2, S 1, T 39N, R SW, Parcel :2.1. Vol 540 Records Page
141. 6.06 acres. Property is zoned Residential/ Recreational One. Application is for the
construction of a 20'x46' (22'x48' with eaves) pole building, far the personal use of the
applicant, on a vacant parcel. The proposed building cannot be constructed on the parcel
containing the applicant's dwelling and meet minimum setback requirements. Variance is
requested as Section 4.26, Sawyer County Zoning Ordinance, would prohibit the con-
struction of an accessory building on vacant property. The Town Board has approved.
The Board of Appeals approved the application as submitted with a 2-year deadline.
Findings of Fact of the Board of Appeals: It would not be damaging to the rights of others or
property values. There would be no change in the use in the zone district. It would not be a self-
created hardship.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-007.

Your application for a variance will be considered at a Public Hearing before the Sawyer
County Zoning Board of Appeals on

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.
It is recommended that either you or a representative be present at the Hearing. A lack of
information about the situation may result in unnecessary delay of a decision. Failure to
appear may result in the denial of the application.
If it is impossible for a representative to be present, please submit a written statement to
this office directed to Raymond Zubrod, Chairman of the Board of Appeals. Ttris
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by confornung to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute a zoning hardship.
Your application will come before the Town Board for their review. Please contact the
Town Clerk, Arlene Bishop; 266-3131 to obtain the time and confirm the date of the
Town Board meeting for your attendance or the attendance of your agent.

I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Board of Appeals Conclusions of Law Form (This is the form that the Board members
will use to determine if your situation meets the requirements far the granfing of the
variance that you have requested.) and a
• completed "Vaziance Application.°
If you believe that you meet the criteria for the requested variance you should review the
application fox correctness. If conect, sigu the application and return it to this office with
a check in the amount of$250.00 made out to the"Sawyer County Zoning
Administration"by Friday, March 4, 2005 for hearings in Apri12005.
Your"Variance Application" will be reviewed at two public meetings. The first meeting
will be held by the Town of Winter. The Town of Winter holds multiple monthly
meetings. You should contact Arlene Bishop, Clerk, Town of Winter, at(715) 266-3131
to confirm the date at which your vaziance application will be discussed. Mrs. Bishop
may be reached at(715) 266-3131, Monday—Wednesday, from 8:00 A.M. to 3:00 P.M.
at fhe town hall.
The Sawyer County Board of Appeals will hold a public hearing at 7:00 P.M., Tuesday,
April 19, 2005 in the assemblv room located in the Sawyer County Courthouse. You or
your representative should attend each hearing, especially the heazing conducted by the
Sawyer County Boazd of Appeals. Only the Board of Appeals can grant the variance, the
recommendation of the Town of Winter is advisory only.
It is your responsibility Yo convince the Board of Appeals to grant the vaziance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
