Dear Mr. Rainville,
On April 19, 2005, the Sawyer County Board of Appeals reaf�rmed its previous ruling on your
application for variance on the following described real estate to wit:
Lot 7, being Part of Govt Lot 3, S 26, T 39N, R 9W, Parcel :3.3. Vol 524 Records Page
338; CSM Vol 12 Page 44. Approximately 100'x663' containing 1.55 acres. Property is
zoned ResidentiaURecreational One. Application is for the eonstruction of a 20'x40'
(22'x42' with eaves) detached garage at a setback distance of 33' to the ardinary high wa-
ter mark of Ham Lake and 39' to a wetland area adjacent to the lake. Variance is re-
quested as Section 4.49(1), Sawyer County Zoning Ordinance, would require a minimum
setback distance of 75' from both the ordinary high water mark of the lake and the wet-
land area adjacent to the lake. The Town Board has approved.
The Board of Appeals came to a consensus that the decision made was fair.

Not doing so would have a profound negative impact on my property, the land as a

Dear Mr. Rainville:
I have forwarded a copy of your letter dated 3-17-2005 to Mr. Ray Zubrod, Chairman,
Sawyer County Board of Appeals. Obviously you are dissatisfied with the Board's
decision. It is my sense that the Board made its decision within the statutory rules and
case law that govern the criteria for the granting of variances. While I cannot speak for
the Board as to a reconsideration of your variance application, the normal procedure for
an aggrieved party to seek regress is through the Sawyer County Circuit Court.

The Board of Appeals denied the application as submitted.
Findings of Fact and Conclusions of Law of the Board of Appeals: It would be the convenience
of the owner. There is no hardship, if any it is self-created. It would be damaging to others and
property values. It is not due to change of zone district or special conditions unique to the prop-
erty.
Any person or persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please
refer to Variance OS-005.

Dear Mr. Rainville:
I have enclosed the following documents with this letter.
• Inspection Report for the above property,
• Application for Variance—Additional Information,
• Board of Appeals Conclusions of Law Form(This is the form that the Board members
will use to determine if your situation meets the requirements for the granting of the
variance that you have requested.) and a
• completed "Variance Application."
If you believe that you meet the criteria for the requested variance you should review the
inspection report and application for correctness. If correct, sign the application and
return it to this office with a check in the amount of$250.00 made out to the "Sawyer
County Zoning Administration"by Friday, January 7, 2005 for hearings in February
2005. If you are still interested in having this matter before the March 2005 hearing, the
application must be returned by Friday, February 4, 2005
The "Application for Variance -Additional Information" must also be filled out and
returned with the Variance Application. Both documents together make up the entire
application that will be reviewed by the Sawyer County Board of Appeals. Failure to
return both of the documents or failure to complete either document in its entirety will
cause the variance application to be rejected by this office.
Your application will be reviewed at two public hearings. The first hearing will held by
the Town of Sand Lake at 7:30 P.M., Tuesday, February 8, 2005 (Tuesday, March 8,
2005). You should contact Elaine Nyberg, Town of Sand Lake Clerk, at(715) 865-2486
(home)to confirm this date.
The Sawyer County Board of Appeals will hold the second hearing at 7:00 P.M.,
� ..: : : ;Tuesday,February 15;2005 (Tuesday, March 15; 2005) in the large courtroom located in
th`e Sawyer County Courthouse. You or your representative should attend each hearing,
especially the hearing conducted by the Sawyer County Board of Appeals. Only the Board
of Appeals can grant the variance, the decision of the Town of Sand Lake is advisory
only.
It is your responsibility to convince the Board of Appeals to grant the variance that you
have requested. Therefore, you should consider using any means at your disposal (i.e.,
photographs, drawings, a good verbal presentation, etc.) as you present your facts to the
Board.
Please contact Mrs. Kitty Taylor if you have any questions. Office hours are 8:00 A.M. to
4:00 P.M., Monday through Friday.
As we discussed, one issue that the Board will be interested in is if the garage can be built
in any other location on the property that would not require the granting of a variance. If
the answer to that question is "yes"then you should not expect the Board to grant the
variance. One of the criteria that the Board applies when considering whether to grant a
variance is the issue of economic gain for the applicant. The Board will most assuredly
inform you that they do not grant variances that will result in a financial gain for the
applicant.
Also, I assumed that the garage would be constructed with a one foot eave overhang.
Please inform me if this is not the situation as all setbacks were based on the one foot
overhang.

Re: Shoreline Vegetation Protection Area(SVPA) Inspection and Garage Setback from a
_Wetland Area
Dear Mr. Rainville:
On October 22, 2004 you applied for a Land Use Pernut for construction activities on
your property—a new detached garage. Section 4.419 MITIGATION
REQUIREMENTS, of the Sawyer County Zoning Ordinance requires,that as a condition
for the issue of this permit, that you certify the condition of your property's SVPA. The
SVPA is defined as, "A strip of land 35 feet wide inland from the ordinary high-water
mark of any navigable body of water, including but not limited to: streams, rivers,ponds,
flowages and lakes. Term used synonymously with buffer zone,buffer area and buffer
strip. You indicated on the permit application that mitigation would not be required.
Today I visited your property to verify the condition of the SVPA. It is also my
determination that the SVPA does not require mitigation. Since mitigation is not
required, you must maintain the SVPA in accordance with Section 4.410 SHORELINE
VEGETATION PROTECTION AREA—copy attached.
During my visit I noticed that LUP#04-616 indicated that the garage was to be located
40' from the wetland area. This wetland area (a wetland adjacent to navigable
waters) requires a minimum 75' setback, not 40'. I set four yellow zoning flags along
the wetland boundary(one in the ground and three attached to shrubs etc.). The
minimum setback would be 75' from these flags.

Part 2: Three-Step Test.
To qualify for your requested variance, you must demonstrate that your property meets
the following three requirements. This is known as the "three-step test."
1) Unique Propertv Limitations.
Unique physical limitations of the property such as steep slopes or wetlands
that are not generally shared by other properties must prevent compliance with
ordinance requirements. The circumstances of an applicant (growing family,
need for a larger garage etc.) are not a factor in deciding variances. Nearby
ordinance violations, prior variances or lack of objections from neighbors or
the Town Board do not provide a basis for granting a variance.

A variance may not be granted which results in harm to public interests. In
applying this test, the Board of Appeals must consider impacts of your
proposal and the cumulative impacts of similar projects on the interests of the
neighbors and the entire community. Some, but not necessarily all of these
considerations are: (1) Public health, safety and welfare, (2) water quality, (3)
fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of
property damages and (6) achievement of eventual compliance for
nonconforming uses, structures and lots.

or how it may even enhance the public interests.
3) Unnecessar�Hardship.
An applicant may not claim hardship because of conditions which are self-
imposed or created by a prior owner (for example, excavating a pond on a

Courts have also determined that economic or financial hardship does not
justify a variance. When determining whether unnecessary hardship exists,
the property as a whole is considered rather than just a portion of the parcel.

This hearing will begin at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main
Street, Hayward, Wisconsin.

this office directed to Raymond Zubrod, Chairman of the Board of Appeals. This
statement should include a description of the general terrain; surrounding development;
your proposed intentions; and the purpose of the request. Photographs of the property
and/or buildings are requested. Explain the undue zoning hardship inflicted upon the
owner by conforming to the required minimum regulation, which induced the variance
request. Convenience and financial loss or gain does not constitute zoning hardship.
Your application will come before the Town Board for their review. Please contact
