It would be unnec- essarily burdensome. The above certify that the listed information and intentions are true and correct. 7'he above person/s/ hereby give permission for access to the properry for onsite inspections. / Application For Variance-Additional Information I have been coming to this azea for over 50 yeazs and have watched both Big and Little Round Lakes become extremely populated.Each yeaz,1 have watched new summer homes constructed and each one is lazger than the one before. At the time my Mom and Dad bought the property,it was one of a handful of houses on Little Round Lake. Our family had used this property as a summer home. My parents eventually retired and lived in the house yeaz-round for 10 yeazs until my dad passed away. The ownership of the property eventually reverted to my wife and me and we had been planning for several years to retire to this area. When we moved here permanently in late 2002,we wanted to live in the house for awhile to make surc we knew want we needed vs.what we wanted before remodeling.We were unawaze of any zoning changes for if we had,we would have completed the remodeling eazlier and would not be experiencing the issue before us today. We contacted a builder early in 2004. As a first step,he suggested meeting with a Zoning representative. We had a meeting with the contractor and Zoning representative on our property and they measured and calculated that we were able to add 250 square feet on to our home so the total footage would not exceed the 1500 square feet limit. We were disappointed because 250 square feet is not much of an addition. So we went back to the drawing board,contacted a planner,had plans drawn up and came up with some altematives that we could live with. In anticipation of the remodeling,we had put up a pole bam,moved a lazge antenna tower and have prepared other things such as landscaping,road improvements etc. In early December of 2004, out builder went to Zoning to get the permits. He was told that we couldn't do what we had been planning for six months.We were shocked and didn't know want to do. Eazlier in the year Zoning told us we could add on 250 square feet and now they told him no. I called Zoning and set up a meeting to find out what changed. During that meeting I found out tt�at Zoning had to(d us thc wrong information and that nothing could be done about it except to apply for a variance, which will cost$250.00. 1'his was the first timc that I hcard about an application for a variancc. I thought and stili think it is vcry unfair. I told Ioning that I would apply for a variance and that is why this is bcing prcparcd. Part 1. Applicant supplied Information. When we have friends or company come to stay, it is crdmped and uncomfortable. We are not looking to add on and create a mansion, but to add a modest amount of square footage. We are only adding a master bedroom and bath, expanding one of the 2 existing bedrooms and adding an entrance on the non- lakeside of the building. Currently we do not have an entrance on that side. Over the years we have considered many different alternatives. We rejected knocking the building down and starting over 75' back from the lake for two reasons. The additional cost involved and the location of the brand new pole barn vs where could put the new building. In lieu of not knowing the outcome of the variance request, we have come up with 3 or 4 alternatives. All alternatives are adding on to the back side of the building. Please see the Proposed Additions on the site maps attached. Alternatives 1, 2, and 3 are adding on the existing building. Alternative # 4 is eliminating the crawl space access, which is 7 '7 " X 6 ' = 45.5 sq feet and adding this footage to the new kitchen azea and cantilevering the difference so the wall will be even with the garage. This is actually converting sq footage and the added sq footage is even less, but is the least desirable because we then have part of the building that has no foundation. Erosion during construction will all be on the back side of the house and will be controlled with silt fencing if appropriate. After construction, there will be no change to the impervious surfaces on the lake-sides of the building. The changes aze on the non lake side and the water will be diverted onto our pmperty away from other properties and the lake. All additions are ta the non lake side of our building. We have an existing new pole barn that would prohibit us from starting a new building 75' fcct back from thc lakc and waulc� be ��cry costiy to movc or to changc. Part 2: Three-Step Test. To qualify for your requested variance, you must demonstrate that your property meets the following three requirements. This is known as!he `Yhree-step test." 1) Unipue Propertv Limitations. Unique physical limitations of the property such as steep slopes or wetlands that are not generally shazed by other properties must prevent compliance with ordinance requirements. The circumstances of an applicant (growing family, need for a lazger garage etc.) aze not a factor in deciding vaziances. Nearby ordinance violations, prior variances or lack of objections from neighbors or the Town Boazd do not provide a basis for granting a variance. Do unique physical characteristics of your property prevent compliance with the ordinance? ❑ Yes. Where aze they located on your property? Please show the boundaries of these features on the site map that you used to describe alternatives considered. (e.g., "There is a wetland azea that extends azound one side of the house and also behind the house."). ❑ No. A variance cannot be granted. 2) No Harm to Public Interests. A variance may not be granted which results in harm to public interests. In applying this test, the Board of Appeals must consider impacts of your proposal and the cumulative impacts of similar projects on the interests of the neighbors and the entire community. Some, but not necessarily all of these considerations aze: (1) Public health, safety and welfaze, (2) water quality, (3) fish and wildlife habitat, (4) natural scenic beauty, (5) minimization of property damages and (6) achievement of eventual compliance for nonconforming uses, structures and lots. Explain how the granting of this variance would not harm the public interests or how it may even enhance the public interests. 3) Unnecessary Hazdshin. An applicant may not claim hardship because of conditions which are self- imposed or created by a prior owner(for example, excavating a pond on a vacant lot and then arguing that there is no suitable location for a home.). Courts have also determined that economic or financial hazdship does not justify a variance. When determining whether unnecessary hardship exists, the property as a whole is considered rather than just a portion of the parcel. You aze applying for an"azea variance.' An azea variance rel�es a dimensional standazd such as a setback, frontage, lot azea, or height. For an azea variance, unnecessary hazdship exists when compliance would unreasonablv prevent the owner from using the propertv for a nermitted �urpose or would render conformitv with such restrictions unnecessarilv burdensome. The importance of the public purposes of the ordinance, the degree to which the restriction supports those purposes and the extent of the relaxation of the restriction aze weighs against the limitations full compliance would impose on use of the property.
