Any person or persons jointly aggrieved by the decision of the Zoning Committee may
appeal the decision to the Sauvyer CouMy Board of Appeals to review the legality of the

RE: Johnson Building Permit
I have been asked to render an opinion as to whether a structure built to an average set
back should be allowed to construct additions to that average setback even though the
ordinance has subsequently been amended to not allow average setback construction.
Structures built to an average setback were in compliance at the time because the
ordinance allowed for setbacks to be determined in that manner. Since that time, the
shoreland ordinance has been amended to require a minimum setback of seventy-five
feet. Thus, those structures built to an average setback become pre-existing
nonconforming structures.
A pre-existing nonconforming structure is fine the way it sits but if the owner wishes to
make additions to that structure, the addition must comply with the current ordinance.
The court in Lake Bluff Housing v. City of South Milwaukee, 197 Wis. 2"d 157, 540
N.VJ.2"d 189,(1995)stated,"In order for rights to vest to build under a pazticular version
of a zoning or building code,the applicant must submit an application for a permit which
conforms to the zoning or building code requirements in effect at the time of the
application".
In this situation, the application was made before the cunent change in the shoreland
ordinance so it could be constructed under the just prior shoreland ordinance or the
current ordinance. Under either ordinance a lakeward or side addition would not be
allowed without a variance.

On February 15, 2005, the Sawyer County Board of Appeals denied your application for vari-
ance on the following described real estate to wit:

cords Page 316; CSM Vol 17 Page 87. .74 acres. Property is zoned Residen-
tial/Recreational One. Application is for exceeding the 25% impervious surface within
300 feet of the ordinary high water mark of Round Lake (by the construction of a dwell-
ing and attached garage) for a total impervious surface of 35.3%. Variance is requested as
Section 4.422, Sawyer County Zoning Ordinance, would restrict the maximum total im-
pervious surface area to no more than 15%. The Town Board has approved the applica-
tion.
The Sawyer County Board of Appeals voted to deny the application as submitted.
Findings of Fact and Conclusions of Law of the Board of Appeals: Variance would be eontrary to
public interest. It would be the convenience of the owner. It would be a self-created hardship. It
would be damaging to the rights of others or property values. It would not be due to special con-
ditions unique to the property.
Any person ar persons jointly aggrieved by this decision of the Board of Appeals may commence
an action in the Circuit Court for Writ of Certiorari to review the legality of this decision within
30 days after the date of this notice. In future correspondence, or in applying for permits, please

(b) Condominiums and othermultiple-unit developments. If counties receive an application for
a permit to authorize the construction, expansion, or replacement, of a dwelling unit, building or
other structure in the shoreland zone that is owned as a condominium or is part of a campground,
mobile home park or other multi-unit development, counties shall require the applicant to
document that the entire development complies with the impervious surface standards in sub. (3).
(3) IMPERVIOUS SURFACE STANDARD. (a) Whenever the construction of impervious
surfaces in the shoreland is proposed, counties shall require property owners to implement and
maintain best management practices that result in no increase in storm water discharge from the
lot or parcel as a result of the construction of impervious suAaces, for storms up to and including
the 10 year, 24 hour storm event to the maximum practicable, as that phrase is defined in s. NR
151.002 (25). Examples of best management practices include directing downspouts onto lawns
or rain gardens and away from driveways and other pavement, and avoidance of piping or
channelizing flow from impervious surfaces into waters of the state.
Note:Sedion NR 151.002(25)defines"maximum eMent precticable"to mean"a level of implementing
best management pradices in order to achieve a perfortnance standard specified in this chapter which takes
into account the best available technology, cost effediveness and other competing issues such as human
safety and welfare,endangered and threatened resources, historic propeKies and geographic teatures.'
MEP allows flexibility in the way to meet the perfortnance standards and may vary based on the
peRormance standard and site conditions.
(b) If as a result of the construction of impervious surtaces, the total area of impervious
surfaces on a lot or parcel exceeds 20%of the IoYs or parcel's area and the lot or parcel includes
land within 75 feet of the ordinary high-water mark,the shoreland buffers shall be preserved or
established on the lot or parcel in compliance with the standards in s. NR 115.15.
Note: The department maintains a list of technical standards that it has determined adequate and
effedive for designing best management pradices to control erosion and sediment runoff. Contact the

NR 115.19 Land disturbing activities. (1) PURPOSE. Counties shall adopt land disturbing
activity standards to achieve the purposes of ss. 281.31 (1) and (6), Stats., by minimizing
vegetation removal, soil erosion, soil compaction, and sedimentation in order to limit direct and
cumulative impacts of shoreland development on water quality; near-shore aquatic, wetland and
upland wildlife habitat; and natural scenic beauty.
(2) GENERAL. (a) Erosion control plan and shoreland bufler vegetation plan. Except for the
construction of necessary drains, ditches or embankments for the improvement or protection of a
town highway that is authorized under s. 82.03 (5)(a), Stats., as affected by 2003 Wisconsin Act
214, counties may not allow land disturbing activities in the shoreland zone unless the property
owner submits an erosion control plan and a shoreland buffer vegetation plan to the county for
approval that will minimize erosion and sedimentation caused by the proposed land disturbing
activities and that complies with par. (b)and the shoreland vegetation standards in s. NR 115.15.
Note: Land disturbing activities must also satisfy the requirements of ch. 30,Stats., chs. NR 151 and
216, and other state and federal laws,where applicable, including that erosion control measures required in
the Uniform Dwelling Code(Comm 21.125),the commercial construction site erosion control standards in
the Wsconsin Commerical Building Code(Comm 61.115)and the storm water and clearwater plumbing
system requirements in ss.Comm 82.36 and 82.365 in the Uniform Plumbing Code.
(b) Wetland buffer. Counties may not allow land disturbing activities within 10 feet of the
boundary of any wetland within the shoreland zone.

4.422 IMPERVIOUS SURFACE LIMITATIONS
INTRODUCTION: Extensive research shows that shoreland development
results in increased quantities and velocities of runoff that may overwhelm
infiltration capacity and transport sediment, nutrients and other pollutants
directly to surface waters if proper management is not employed.
1) The ma�cimum total area of impervious surfaces shall not exceed fifteen
percent (15%) of a total shoreland lot area within 300' of the ordinary
high-water mark .
2) The limitation on impervious surfaces may be increased to no more than
twenty-five percent (25%) only with a Conditional Use Permit. A
conditional use application shall include, at a minimum, the following
documentation:
(a) A topographic survey of sufficient scale (not less than 1" = 20')
showing pre-construction and pre-excavation conditions including
slopes/contours, water bodies, wetlands, vegetative cover,
drainageways, roadways, buildings and all other impervious surfaces
and any unique physical features of the lot.
(b) A site plan of similar scale showing the information required in (a) as
proposed post-construction conditions, and shall include all
erosion/sedimentation control measures, diversion/containment structures
and total calculations of lot area and impervious surfaces.
3) The limitation on impervious surfaces located more than 300 feet from
the ordinary high-water mark may be increased to no more than thirty
percent (30%) only with the submission and approval of the Zoning
Department of a Rainwater/Snow Run-off Retention Plan containing the
same information required in 2(a) and 2(b) for a Conditional Use Permit.

We have received a number of inquiries about there being habitable area in the Johnson
garage. Just a heads up, if you and I go on-site, or if other Board members visit the site,
the garage should probably be looked at. In 1986 this office issued a sanitary permit for a
one-bedroom septic system to be connected to the garage. This may or may not be
significant as we do allow septic systems to be connected to garages. We also have a
p rmit on file for the garage.
