Dear Mr. Eckerly:
Notice is hereby given that on September 15, 2006 the Sawyer County Zoning
Committee approved with conditions the following application:
Lot 2, being Part of the NW'/4 SE'/4, S 4, T 39N, R 7W, Parcel .14.8. Doc
#318826; CSM Vol 3 Page 347. .68 acres. Property is zoned Residential/
Recreational One. Permit is desired for exceeding the impervious surface limit of
15% to approximately 20.8% by the construction of a 34'x42' accessory building.
The Town Board tabled the application and has now approved. Application tabled
from August at the request of the applicant.
The Sawyer County Zoning Committee approved a 34'x38' accessory building with the
conditions suggested by the Town: That a rain garden be established using native plants
surrounding the building on 3 sides and extending at least 15' from the roof's drip edge;
the structure is to be nature friendly in color; no more cement or asphalt is to be added to
this lot in the future.
Findings of Fact of the Zoning Committee: It would not be detrimental to ecology,
wildlife, wetlands or shorelands. It would have a zero net effect on navigable waters.
The approval of the conditional use will expire on September 15, 2007, if application for
the actual permit to use/construct is not made by that date.
Any person or persons jointly aggrieved by the decision of the Zoning Committee may
commence an action with the Sawyer County Board of Appeals to review the decision in
whole ar in part, within thirty (30) days after the filing of the decision in the office of the
Committee.

The Hunter board tabled this issue at our August meeting because questions were raised concerning
possible easeme�ts crossing this prcrperty where the proposed garage would be locatect
There were conflicting documents from Sawyer County showing a road 8uough two sections,Gov. lot 2
and NW-SE.
Speakixig with l�g time local residents it was brought to my attention that this road was most likely old
Highway CC.
It was detemtined in Sawyer Co. documen[ 12-739-04 5218/2-39-07-04-0: 2:18 that Pine Knoll Road mns
through Gov. lot#2 from Hwy CC to the section line which ends at the east lot line of the Korinke
proper[y. The Quit Claim deed for Pine Knoll Road to the Town of Hunter in document#228846. Vol. 485
pg 248. The Korinke property shows an access tluough the north end�'i[to the Kitsch/Eckerly property.
In the N�-SE section the Town of Hunter released theu nghts to taro propeRies in resolution 8.0 dated
August 11,1971. CSM#2033 recorded in Vo1 9 pages 365 and 366.These properties are 142 and 14.9 on
the survey map.The other four properdes in the NW-SB section(part of Old Hiawatha Resort)aze secviced
with a 20'driveway easement off Hwy CC and aze described in CSM 2141,CSM 2522 and CSM 2545.
The town found no resolution relinquishing the right�'way through any of those properties nor a Quit
Claim Deed for ownership to the town.
I feel confident these properties do not have eazement rights through the KitschlP,ckerly property.

NOW, TI�EREFORE, the owner(s) hereby certifies that, as a condition of issue of said Land Use Peanit, that
the SHORELINE VEGETATION PROTECTION AREA on said real estate is intact to a minimum depth of

4.410 SHORELAND VEGETATION PROTECTION AREA, Sawyer County Zoning Ordinance, in effect on

PROTECTION AREA, Sawyer County Zoning Ordinance remains in effect. Violation of this Agreement will
authorize, in addition to other penalties and relief required under the Sawyer County Zoning Ordinance,

BE IT RESOLVED THAT the Town Board of the Town of Hunter , Sawyer
County, Wisconsin , release any and a11 rights that said Town might have
in the following described parcel of property located in the Town of
Hunter , Sawyer County, Wisconsin :
R11 that part of the Northwest Quarter of the Southeast
Quarter (NW% SE%) of Section Four (4 ) , Township Thirty-
nine ( 39 ) North , Range Seven ( 7 ) West described as fol-
lows: Beginning at a certain point on the shore of Blue-
Lake , which point is 840 feet East of the West line;
thence North 235 feet to the town road; thence in a
Southeasterly direction along the road 513.5 feet to
the East line of said forty; thence South along the
East line 354 feet to the lake shore; thence along the
lake shore in a Northwesterly direction to the place
of beginning.
That it is the intent of the Town of Hunter to release any right and
all right that said Town might have where in the past , the Town of
Hunter has had a roadway running through said property and at the present
time , said roadway having been abandoned by said Town. Further , that
this Resolution be presented at the Annual Town Meeting in April , 1972 ,
and tnat said Resolution be ratified at that time and an additional Quit
Claim Deed signed releasing any and all rights in said property preaently
held by the Town of Hunter.
