Dear Ms. Nielsen and Mr. Curtis,
On November 14, 2007, the Sawyer County Zoning Committee approved under protest your
application for change of zone district on the following described real estate to wit:
Karen Nielsen and Richard Curtis. Part of the NE 1/4 NW 1/4, Parcel .5 .3, 1 .9 acres; and Part of the NW
1/4 NW 1/4, Parcel .6. 1 , all in S 3, T 41N, R 7W. Doc #316979. Change both parcels from District
Residential/Recreational One to Commercial One. Purpose of request is for the location/operation of a
real estate office, office space, retail shop and coffee shop and possibly a service station. The Town
Board denied the applications. This application was originally presented to the Committee in May 2006
at which time the Committee denied the applications but waived the 12 month waiting period to reapply.
The applicant reapplied for the April 2007 public hearing and the application was tabled to the May 18,
2007 public hearing. The application was again tabled to no later than the August 2007 public hearing.
The Town Board has again denied the application with additional comments. The application was tabled
from the August 17 public hearing to September where the Zoning Committee denied the application. On
October 18, 2007 the County Board refused to deny the petition and sent the petition back to the Zoning
Committee to draft an amendment to effectuate the petition and report the amendment back to the Board
at which time the Board may enact ar reject the amendment.
The Sawyer County Zoning Committee motioned to approve under protest. Nothing has changed from
the original application.
Findings of Fact of the Zoning Committee: The Committee recommends that the County Board make
findings of fact with their decisions.
The Sawyer County Board of Supervisors must ratify the approval of the change in zone district before
it becomes final. This will be scheduled for the County Board meeting on December 20, 2007, 6:30
P.M., in the Circuit Courtroom of the Sawyer County Courthouse.
This decision is a recommendation to the County Board of Supervisars. Any person or persons jointly
aggrieved by the decision of the County Board may commence an action in the circuit court for writ of
certiarari to review the decision in whole or in part, within thirty (30) days after the filing of the decision
in the office of the Board.

On October 18, 2007, the Sawyer County Board of Supervisors refused to deny your
application for change of zone district on the following described real estate to wit:
Part of the NE 1/4 NW 1/4, Parcel .5.3. 1.9 acres; and Part of the NW 1/4 NW
1/4, Parcel .6.1, all in S 3, T 41N, R 7W. Doc #316979. 1.9 acres. Change from
District Residential/Recreational One to District Commercial One.
This action was taken in accordance with Section 59.69 (5) (e) 5 of the Wisconsin
Statutes to wit: ". . .the county board may refuse to deny the petition as recommended by
the agency in which case it shall rerefer the petition to the agency with directions to draft
an ordinance to effectuate the petition and report the ordinance back to the board which
then may enact or reject such ordinance."
The matter will return to the Sawyer County Zoning Committee agenda for the meeting
to be held Wednesday, November 14, 2007, beginning at 8:30 AM at the County
Courthouse at 10610 Main, Hayward WI. This letter is to serve as your notice for
rehearing. It is always helpful if the property owner attends a public hearing in person.

Findings of Fact: The Towns of Spider Lake and Round Lake did not approve. It is hard to determine if it
is damaging to the rights of others or if it would create traffic problems because we don't know what the
business is going to be. It would be restrictive to future owners to disallow specific, unproposed uses.
The Spider Lake plan and Round Lake use plan do not identify this as commercial.
The Sawyer County Board of Supervisors must ratify the denial of the change in zone district before it
becomes final. This will be scheduled for the County Board meeting on October 16, 2007, 6:30 P.M., in
the Circuit Courtroom of the Sawyer County Courthouse.

Rezone Variance Request for Richard Curtis and Karen Nielsen
1) In late April or early May 2007, I appeared before the Town of Round Lake
Planning Committee. After meeting for 45 minutes and reviewing the Town of Round Lake Use
Plan which was prepared by the Northwest Regional Planning Commission, the Town of Round
Lake Planning Committee recommended the variance be granted. The Town of Round Lake
Planning Committee did not make any recommendations for any restrictions or any conditional
conditions.
2) On May 10, 2007, I appeared on behalf of Mr. Curtis and Ms. Nielsen at the
Town of Round Lake Board meeting. The site plan attached as Exhibit A was presented to the
Town of Round Lake Board. At that time, Board member Sandra Schara stated that she had
talked to about fifty people who believed that they would welcome the possibility that a service
station or gas station would be placed on the property due to the distance it would have from the
gas stations at the corner of County Highway B and County Road K. Much discussion was
raised about the lack of specificity, the type of building, parking, and other concerns. At that
time I explained that my clients would meet all setbacks and they would gladly entertain any
suggestions such as berms, and all parking would be on site.
3) a) On July 12, 2007, I again appeared before the Town of Round Lake Board
along with Mr. Bud Rubeck, who will be acting as the construction manager for the development
of the property. The Town of Round Lake Board was presented two new drawings which
displayed the layout and configuration of the building, Exhibits B and C. My clients also agreed
to limit the commercial development to the following uses: retail stores and shops offering
convenience goods and services; business and professional offices and studios; banks, and
savings and loan offices; public and semi-public buildings and institutions; commercial
entertainment facilities; laundromats; and, restaurants.
b) Again, the discussion was held about how the Town of Round Lake Board
believed this matter lacked professionalism and a scale drawing. I tried to explain that my
clients were not going to go to a significant expense regarding architectural drawings until they
knew exactly what they could do, if anything. Chairman Gary Karns stated that he wasn't
prepared to discuss this at this meeting and wished that the Planning Committee had given
further guidance. I believe Board Member Rolfe Hanson made a motion which was seconded by
Mr. Picchietti to deny the application because he believed it would be spot zoning. To the best
of my recollection, Board members Stan Strainis and Sandra Schara voted against the
recommendation to deny, which was ultimately passed when Chairman Karns, although he
wasn't prepared to vote, stated something to the effect that he will vote against it so that this
matter could be brought to a conclusion.
4) The Town of Spider Lake Town Hall and maintenance shed are located directly
north and northwest of the subject parcels. The Town is concerned about parking; however, all
parlcing for the commercial establishments would be located on the property and not on the town

5) In anticipation of concerns expressed by the Town of Round Lake Board and
some of the neighbors, the applicants are willing to be conditionally rezoned. Pursuant to the
Town of Round Lake Use Plan, commercial development is generally located along the corners
of Highway B, Highway 77, and County Road A. See Attached Exhibit D. These parcels are
located along State Highway 77, and immediately next door to the Town of Spider Lake
maintenance shed and Town Hall, which are both quasi-commercial activities. To make things
aesthetically pleasing, my clients are willing to entertain any recommendations for type of
building, vegetative berms, and building materials. My clients would also be required to meet all
current zoning requirements, including state-approved plans far commercial buildings. Clearly,
this parcel of property is not conducive to residential development, and makes sense.
6) My clients believe that the Town of Round Lake Board is unreasonable. My
clients have tried to work with the Town Board, have scaled their proposal down, and are willing
to have conditions placed on the property. The Town of Round Lake Board has stated that we
should try and sell this parcel and then come to the Board for a conditional use permit when we
know what exactly type of commercial enterprise will be put there.
7) My clients are asking that the residence located on the generally westerly parcel
be allowed to remain because it can then be used for a manager of the commercial project. In the
event the soil test indicates that room is needed for the sanitation system, my clients recognize
that we could use the adj acent piece of property to be compliant with all sanitation regulations.

Most respondents, (79%) want to discourage luge retail or fast food chain stores in the Town of
Round Lake. Tourism-related business was the most encouraged type of commercial
development by survey respondents, although only a small majority of 55 percent wants this
encouragement.
Recreational and Environmental Development
There is a strong theme of preservation in the responses from this section. Developing resorts,
marinas, golf courses, and other recreational structures is discouraged by 60 percent of
respondents. Another 62 percent of respondents are in favor of the town purchasing land that
they wish to keep undeveloped. An overwhelming 81 percent are in favor of limiting
development to protect wildlife, natural habitats, and undeveloped land.
There is also strong support for silent sport recrearion among respondents. When asked what
type of recreational activities should be developed in the town,the top 8 responses were:
• Walking paths • Public fishing access
• Parks • Picnic azeas
• Bike trails • Canoeing areas
• Cross country ski trails • Swimming beaches
Over 70 percent of respondents are in favor of controlling the use of jet skis, high powered motor
boats, and regulating the location of motor cross racing and snowmobile racing. When asked
i what their least favorite thing about living in Round Lake is, the most popular answer was

This land is light yellow on the map and shows areas where a higher density residenrial use
would be appropriate. Curiently these lands are a mix of sub-divided plats and lower density
residential. They aze located on the west side of CTH A, south of STH77; east and west of
STH77, north of Twin Lake Road; and east of McClaine Road, norttr of CTH B.
Recommendationr.
� l. Any new Planned Unit Developments or Conservation Subdivisions should be
guided to this area
2. Smgle private lots should be at a three acre minimum. -
CommerciaULight Industrial
These azeas aze defined as pink on the map and consritute azeas of future commerciai or light
industrial gowth. They are found along the STH 77, CTH A and CTH B corridors. Currently
these lands have various light industrial,eactractive and retail uses.
/ Recommendations:
1. Encourage commercial development consistent with rural character by
discouraging lazge"chain"run corporations
2. Allow light indushial operations that have little environmental impact or waste
3. Encourage new businesses to apply vegetative screening and landscaping to help
\ keep the town's vision of nual chazacter and to provide a buffer from any
adjacent residential properties.
Forest/Open Space
This area occupies most of the private land in the town. It is shown as white on the map and
currently has a mixed use of rural residenfial, ab culture/open space, and forest.
Recommendations:
1. Protect the integrity of the natural resource base (woodlands, wetlands) within
these azeas
2. Promote low density developments that currently occupies this area
3. Recommend a minimum pazcel size of 5-10 acres
Conservation/Recreation
Areas under the conservation/recreation category include lands that aze unique to the community
or have significant recreational potentiaL This includes the 80-acre town owned pazcel on CTH
A. It is dark green on the future land use map.
Fuhue Rusric Road — The Round Lake Land Use Committee has identified Lower Twin Lake
Road as a possible future rustic road. This stretch from STH 77 to Twin Lake Road has
lunited development, goes past Tiger Cat Flowage, and has beautiful forest cover. There is
also a possibility to link L,ower Twin Lake Road with Murray Bivd., in the Town;of Spider
Lake,which has been identified as a possible rustic road in Spider Lake's land use plan.

This morning I met with Dave Kafura, DNR Water Management Specialist for the
purpose of determining: (1) the navigability of the pond located on the Cheryl and
Michael Riley property, #10881 W State Highway 77 and (2) is the Nielsen/Curtis
property located within the shorelands of this pond.
Based on a review of historical aerial photos going back to 1939 it was determined that
the pond is navigable, thus resulting in the Nielsen/Curtis property being located within
the shoreland area of this pond.

coffee shop and possibly a service station The Town Board denied the
applications. This application was originally presented to the Committee in May
2006 at which time the Committee denied the applications but waived the 12
month waiting period to reapply. The applicant reapplied far the April 2007
public hearing and the application was tabled to the May 18, 2007 public hearing.
The application was again tabled to no later than the August 2007 public hearing.
The Town Board has again denied the application with additional comments.
The application will be before the Zoning Committee at the September 21, 2007 public
hearing, which will be held in the Sawyer County Courthouse in Hayward, at
8:30AM.
The Zoning Committee will request that DNR Water Management Specialist, Dave
Kafura, determine if the property contains navigable water. Please contact the zoning

On May 19, 2006, the Sawyer County Zoning Committee denied your application for change of
zone district on the following described real estate to wit:
Part of the NE 1/4 NW '/4, S 3, T 41N, R 7W; Parcel .5.3. Doc #316979. 1.9 acres. Change
from District ResidentiaURecreational One to District Commercial One. Purpose of
request is for the location/operation of a real estate office, office space, retail shop and
coffee shop. The Town Board has denied the application.
The Sawyer County Zoning Committee denied the rezone application because a denial by the
Town Board outside of the shorelands cannot be overruled. The Committee also voted to waive
the 12 month waiting period to re-apply for a change of zone district on this property.
The Sawyer Co�mty Board of Supervisors must ratify the denial of the change in zone district
before it becomes final. This will be scheduled for the County Board meeting on June 15, 2006,
6:30 P.M., in the Circuit Courtroom of the Sawyer County Courthouse.
This decision is a recommendation to the County Board of Supervisors. Any person or persons
jointly aggrieved by the decision of the County Board may commence an action with the Sawyer
County Board of Appeals to review the decision in whole or in part, within thirty (30) days after
the filing of the decision in the office of the Committee.
