At your request, I have reviewed the case law that was cited in Mr, Kilgore's
Scn�en D.Hia:msn letter dated May 9, 2007. Additionally, I have performed additional research
reviewing statutes and case law on the circumstances when a federa] statute is
$andraL.Hupfe� able to preempt state and local laws. In light of tkzzs research, I believe that
Enbnd�e Energy w-ill be able to eoi���incingly prove that the local ordxnance
requiring a conditional use pemut is preempted by federa�statuta.

intended co preempt state law in the contzxt of pipeline regulations. Specifically,

authority may not adopt or continue in force safety stapdards for interstate
pipeline facilities or interstate pipelane transportation." (Westlaw 2007). This
� proviszon has been litigated in several different jurisdictions. Each of these
I jurisdictions has held that states or loca]goverrunents aze barFed fi-om issuing any
kind of ordinance, including conditional use permit zoning, that regulate

Furthermore, I also have shepazdized the cases cited in Mr. 1Kilgore's letter in support of
Enbridge Energy's position. Each of these cases is still valid law with a positive history for each
of the proposition cited by Mr. I{ilgore.
I have attempted to find authority that would lend support to ottr position that Enbridge Energy is
required to comply wiich the conditional use pezmit; ho�vever, I could find no such authozity. The
case 1aw and federal statutes lend strong support to the proposition that a local or state entitg
cannot regulate an interstate pipeline even if those local or state ordinanczs are enacted for a
safety reason. In the context of an intrastate pipeline, a ]ocal or state authoz�ry has the express
statutozy ability to adopt additional or mor� stzingent safety standuds for pipeline Faciliries or
transportation so long as they aze compatible with tbe £ederal guidelizzes and the state or local
entiry follows the appz-opriate procedwral steps.
Therefore, in light of our research, we believe that the Sawyer County Zoning Adzninistration
will be unsuccess:ful in atteniptiug to enforce a conditional use permit upon �nbridge Energy. If

This law firm has assisted Enbridge Energy, Limited Partnership with its current expansion project,
which involves the installation of multiple interstate petroleum pipelines within a defined right-of-way
corridor. It is my understanding that Sawyer County has taken the position that the county's zoning
ordinance contains permitting requirements with which Enbridge must comply. Enbridge has faced
similar issLies in numerous counties in which it operates. The purpose of this letter is to explain the role
of federal law in conjunction with local permitting issues.
Article VI, clause 2 of the United States Constitution, otherwise known as the Supremacy Clause, allows
Congress to pre-empt state and local laws, statutes, ordinances, rules and regulations. The Supremacy
Clause is well-recognized by courts at all levels. In the words of the United States Supreme Court, °`[i_�t
is a fanliliar and well-established principle that the Supremacy Clause . . . invalidates state laws that
interfere with, or are contrary to, federal law." Hillsborouglz County, Florida v. Automated Medical
Lafioratories, Inc., 471 U.S. 707, 712-13 (1985). "Congress is empowered to pre-empt state law by so
stating in express terms." Id. The Seventh Circuit Court of Appeals also recognizes the Supremacy
Clause, stating "[e]xpress preemption oecurs when a federal statute explicitly states that it overrides
state or local law." Hogland v. Town of Clear� Lake, Ind., 415 F.3d 693, 696 (7th Cir. 2005). Finally�,
the Wisconsin Supreme Court acknowledges the Supremacy Clause. As it recently stated, "[fJederal law
pre-empts state law . . . where Congress explicitly mandates pre-emption of state law." Miller Brewing
Co. v. Dept. of Industry, Labor and Human Relation.s, Equal Rights Division, 563 N.W.2d 460, 46�

Congress has expressed explicit intent to pre-empt state law in the context of pipeline regulation.
Specifically, Federal law provides that "a State authority may not adopt or continue in force safety
standards for interstate pipeline facilities or interstate pipeline transportation," and further
provides that the Secretary of Transportion shall establish safety standards for pipelines. Pipeline Safety
Improvement Act of 1992, 49 U.S.G §§ 60104(c) and 60102(a)(2). Federal courts have been aggressive
in upholding the supremacy of the Pipeline Safety Improvement Act; in fact, one federal appellate court
has twice invalidated an entire chapter of Iowa state law that attempted to regulate interstate pipelines.
ANR Pipeline Co. v. Iowa State Co�nmerce Com'n, 828 F.2d 465 (8th Cir. 1987); Kinley v. Iowa, 999
F.2d 354 (8th Cir. 1993). The Kinley case specifically emphasized the breadth of the federal preemption
by refusing to limit the preemption to safety issues: "We also hold that the environmental and damage
remedie� pr��;�;on� are n�t sever?bi_e fr�m thP �rePrnpte� heapng, per?r_'t ap� inspection provisi�ns and
thus are preempted as well." Kinley at 360. Other federal courts have agreed that federal law will
preempt an ordinance whether or not it is "framed as a safety regulation." Williams Pipeline v. City of
Moundsview, 704 F.Supp. 914, 920 (D. Minn. 1989); Northern Border Pipeline Co. v. .Iackson Counry,
512 F.Supp. 1261, 1265 (D. Minn. 1981).
Sawyer County's authority to promulgate and enforce zoning regulations is provided by Chapter 59 of
the Wisconsin Statutes, which specifically states that the purpose far local zoning is to "promot[e] the
public health, safety, and general welfare." Wis. Stat. § 59.69(4) (2006) (emphasis added). The Sawyer
County Zoning Ordinance acknowledges, in Section 1.2, that it is adopted far "the promotion and
protection of the public health, morals, safety, and general welfare." Pursuant to the cases cited above,
and the federal regulations cited above, the Sawyer County Zoning Ordinance is therefore preeinpted
from extending to pipeline regulation of any sort. Any attempt to enforce the ordinance would
constitute a violation of both federal law and the United States Constitution.
If you would like to discuss this issue in greater detail, please feel free to contact me. As you know, the
tight timelines of Enbridge's pipeline installation project have required it to submit applications under
the zoning ordinance. For this reason, I would appreciate it if you could provide me a reply to this letter
at your earliest convenience. Assuming you have no dispute with the law cited in this letter, Enbridge
would immediately withdraw its applications so as to save Sawyer County staff from unnecessary work
in responding to the applications.
